Moorpark, California October 18, 1995
A Special Meeting of the City Council of the City of Moorpark was
held on October 18, 1995 in the Conference Room of said City
located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 6:40 p.m.
2. ROLL CALL:
Present: Councilmembers Hunter, Wozniak, and Mayor
Lawrason
Absent: Councilmember Perez
Staff Present: Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Cheryl Kane, City
Attorney
CONSENSUS: By consensus, the Council determined to reorder
the agenda to go into Closed Session and defer the
Action/ Discussion item until after 7:00 p.m. so this item
could be considered in the Council chambers.
4. CLOSED SESSION:
MOTION: Mayor Lawrason moved and Councilmember Hunter
seconded a motion to adjourn to Closed Session for a
discussion of all items listed:
A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to
subdivision (b) to Section 54956.9 of the Government
Code: (Number of cases to be discussed - two)
B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation pursuant to Subdivision (c) of
Section 54956.9 of the Government Code: (Number of cases
to be discussed - two)
C. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION
(Subdivision (a) of Section 54956.9 of the Government
Code): Dillon vs. the City of Moorpark.
The motion carried by voice vote 3 -0, Councilmember Perez
absent for the vote.
Present in Closed Session were Councilmembers Hunter, Wozniak
and Mayor Lawrason; Steven Kueny, City Manager; Cheryl Kane,
City Attorney; Richard Hare, Deputy City Manager.

The Council adjourned from Closed Session at 6:59 p.m.
Mr. Kueny stated that only item 4.C. was discussed and there
was no action to report.
AT THIS POINT in the meeting a recess was declared. The time
was 6:59 p.m.
The Council reconvened into open session at 7:17 p.m.
3. ACTION /DISCUSSION:
A. Consider Vacant City Council Seat. Staff Recommendation:
Direct staff as deemed appropriate.
Ms. Hare gave the staff report, recapping for the Council
the provisions of Ordinance No. 77 which was adopted by
the City in 1986 to address the filling of vacancies on
the Council.
Ms. Kane clarified that the City's ordinance was in
conflict with state statute as to the necessity for
filling the vacancy by appointment until a Special
Election could be held.
MOTION: Councilmember Wozniak moved to continue to 10/25/95
considering the appointment of a new Councilmember to fill the
vacant seat and the calling of the Special Election for March
26, 1996. The motion died for lack of a second.
MOTION: Councilmember Wozniak moved and Mayor Lawrason
seconded a motion to call a Special Meeting for October 25,
1995 at 7:00 p.m. to consider the need for an interim
appointment. The motion carried by voice vote 3 -0,
Councilmember Perez absent for the vote.
Mr. Kueny explained that resolutions to call the Special
Election would be prepared for November 1, 1995.

5. ADJOURNMENT:
MOTION: Councilmember Hunter moved and Councilmember Wozniak
seconded a motion to adjourn. The motion carried by voice
vote 3 -0, Councilmember Perez absent for the vote. The time
was 7:30 p.m.
