Moorpark, California April 26, 1995
A Special Meeting of the City Council of the City of Moorpark was
held on April 26, 1995 in the Council Chambers of said city located
at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 7:20 p.m.
2. ROLL CALL:
Present: Councilmembers Hunter, Perez, Wozniak and
Mayor Lawrason
Absent: Councilmember Montgomery
Staff Present: Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Cheryl Kane, City
Attorney; Jim Aguilera, Director of Community
Development; Dirk Lovett, Assistant City
Engineer; Paul Porter, Senior Planner; Celia
LaFleur, Administrative Secretary
3. ACTION /DISCUSSION:
A. Consider Resolution No. 95- Authorizing Staff to Apply
for One Time Onlv Funds from Area Aaencv on Aaina for
Capital Purchase at Senior Center. Staff Recommendation:
Adopt Resolution No. 95- regarding application for One
Time Only Funds from Ventura County Area Agency on Aging.
MOTION: Councilmember Wozniak moved and Councilmember Hunter
seconded a motion to adopt Resolution No. 95- regarding
application for One Time Only Funds from Ventura County Area
Agency on Aging. The motion passed with a 4 -0 voice vote.
4. A. Consider the Planning Commission Recommendation to Adopt
the Hillside Ordinance. Staff Recommendation: 1) Open
the public hearing, take public testimony, and close the
public hearing; 2) Find that the Hillside Ordinance is
categorically exempt pursuant to State CEQA Guidelines
Section 15061(b)(3) in that the proposed amendments to
the Zoning Ordinance do not have the potential for
causing a significant effect on the environment; and 3)

Senior Planner, Paul Porter gave a brief presentation
that identified the intent of the ordinance to: a) retain
natural grade elevations of significant ridgelines and

land forms; b) to allow density transfers, where
appropriate, to facilitate development in appropriate
locations while retaining significant natural slopes and
an area's environmental sensitivity; and c) to reduce
visual impacts.
Eddie Ramseyer, 1881 Knoll Drive, Ventura, commented that
Section 16.10B.1. "Maximum height for manufactured
slopes..." of the ordinance (page 16 of 25) needed
clarification." Also, that a one -to -one grading cut
provided a natural look, but less useable land. He said
his recommendation was a 2 to 1 cut.
Dennis Hardgrave, 651 Via Alondra #714, Camarillo, said
he was concerned that 1) the ordinance was vague and may
not allow flexibility for development; and 2) that the
land forms of Specific Plan No. 1 fall outside of the
restrictions in the ordinance.
Eddie Bergfield, 7505 Walnut Canyon Road, Moorpark,
commented that the City should work to maintain the
natural beauty of the hillsides and avoid clustering on
ridgelines.
Gary Austin, 17512 Von Karman Blvd., Irvine, commented
that the proposed workshop for the northern part of the
City should be scheduled after the receipt of the Draft
Environmental Impact Report (DEIR) for Specific Plan No.
8 and used as part of the Workshop.
Staff informed the Council that the city expects to
receive the DEIR within three weeks.
Councilmember Wozniak questioned if the ordinance
included the Redevelopment Agency and how it would be
addressed and implemented.
Mr. Kueny responded that project development in
redevelopment project areas were not distinguished from
other developments and the City could exempt or make an
allowance within a Development Agreement.
Councilmember Perez questioned the 15' vs. 30' slope
benching.
Mr. Aguilera explained that the 30' slope benching was
visually preferable.

MOTION: Councilmember Hunter moved and Councilmember Perez
seconded a motion that the public hearing remain open and
directed staff to provide the ordinance incorporating the
change from 15' to 30' slope benching to the Council at the
May 3, 1995, City Council meeting for first reading. The
motion carried by voice vote 4 -0, Councilmember Montgomery
absent for the vote.
5. A. Consider Preliminary Cost Estimates and Scope of Work for
Development of Citywide Traffic Mitigation Fee Program.
Staff Recommendation: 1) Review the staff report and
attachments, 2) Discuss and provide direction to staff
regarding future roadways to be funded by a Citywide
Traffic Mitigation Fee, 3) Direct staff to proceed with
the development of a citywide Traffic Mitigation Fee
through completion of the tasks outlined in the staff
report; 4) Assign the Transportation and Streets
Committee to work with staff. (Continued from 4/5/95)
Senior Planner, Debbie Traffenstedt, gave the staff
report.
Councilmember Wozniak commented that the Workshop to
discuss land planning and circulation for the northern
portion of the City should address circulation patterns,
impact of development, number of freeways to consider and
what can be done for the northern portion of the City.
Mayor Lawrason concurred with staff's recommendation for
land /circulation planning. He identified at least five
proposed developments and existing quarries in the
northern portion of the City. He said these development
proposals need to be looked at more carefully.
MOTION: Councilmember Wozniak moved and Mayor Lawrason
seconded a motion to proceed with the development of a
Citywide Traffic Mitigation Fee through completion of the
tasks outlined in the staff report, and to assign the
Transportation and Streets Committee to work with staff and
provide this item at the Joint Workshop Meeting of the City
Council and Planning Commission. The motion carried voice
vote 4 -0, Councilmember Montgomery absent for the vote.
5. B. Consider Workshop to Discuss Land Planning and
Circulation for Northern Portion of the City.
CONSENSUS: By consensus, the Council determined to notice
Ventura County Planning, Supervisor Mikels' Office, Caltrans,
and Local Agency Formation Commission (LAFCO) affected land

owners; and to cablecast on Government Channel 10 a Joint
Workshop of the City Council and Planning Commission for May
24, 1995, a character generator notice to be cablecast.
C. Consider Dates for Joint Meetinas with the Plannina
Commission and Parks and Recreation Commission
MOTION: Councilmember Wozniak moved and Councilmember Hunter
seconded a motion to schedule May 10, 1995, for a Joint Annual
Meeting of the Council and Planning Commission followed by a
Joint Annual Meeting of the Council and Parks and Recreation
Commission; not to be cablecast. The motion carried by voice
vote 4 -0, Councilmember Montgomery absent for the vote.
6. ADJOURNMENT:
