HomeMy WebLinkAboutMIN 1995 1025 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California October 25, 1995 A Special Meeting of the City Council of the City of Moorpark was held on October 25, 1995, in the Conference Room of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 7:08 p.m. 2. ROLL CALL: Present: Councilmembers Hunter, Perez, Wozniak and Mayor Lawrason Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Lillian Hare, City Clerk. 3. CONSENT CALENDAR: A. Consider Authorizing Mayor to Siqn Agreement with UWC Moorpark Investors. Ltd. for One Year Maintenance Agreement for Country Trail Park. Staff Recommendation: Authorize the Mayor to sign all agreement documents with UWC - Moorpark Investors, Ltd. for the one year maintenance period for Country Trail Park. MOTION: Councilmember Wozniak moved and Councilmember Perez seconded a motion to approve the staff recommendation to authorize the Mayor to sign all agreement documents with UWC - Moorpark Investors, Ltd. for the one year maintenance period for Country Trail Park. The motion carried by voice vote 4 -0. 4. ACTION /DISCUSSION: A. Consider Whether to Make an Interim Appointment to Fill the Vacant City Council Seat. Staff Recommendation: Direct staff as deemed appropriate. Ms. Hare gave the staff report. Eloise Brown, 13193 Annette Street, addressed the Council requesting that they not appoint but wait for a Special Election to fill the vacant Council seat. Francis Okyere, 484 E. Los Angeles Avenue, addressed the Council on behalf of the Chamber of Commerce. He indicated that the Chamber of Commerce supports the Council making an appointment to fill the vacant seat. In response to Council question, Mr. Kueny stated that relative to Council voting, a 2 -2 vote is a denial unless the project is covered by the permit streamlining act in which case a 2 -2 vote would be no action and would equate to approval. He said the three projects covered by the permit streamlining act which could come before the Council prior to the March election are the Colmer Tract Minutes of the City Council Moorpark, California Page 2 October 25, 1995 on Pecan Avenue, the Carlsberg Tentative Tracts, and possibly the Bollinger project. He said the Senior Planner indicated that the Bollinger project might not be covered under the Act. If covered, he said, the applicant might be willing to grant an extension. Mayor Lawrason indicated his concern that important actions may result in a denial because of the vacancy on the Council. He expressed his belief that it is the Council's responsibility to make an appointment. Councilmember Perez said he believed that no one would be served by not making a decision regarding an appointment. Councilmember Wozniak said it was more important that the people of the community be served than applicants. He said he did not favor making an appointment. Councilmember Hunter said he believed it is the fundamental right of the community to elect the person to serve on the Council. He said he would defer to the citizens and not support making an appointment. MOTION: Councilmember Perez moved and Mayor Lawrason seconded a motion to set in motion and consider the steps to make an appointment to fill the vacancy on the City Council. The motion failed by roll call vote 2 -2, Councilmembers Hunter and Wozniak dissenting. MOTION: Councilmember Hunter moved and Councilmember Wozniak seconded a motion to adjourn. The motion failed by roll call vote 2 -2, Councilmember Perez and Mayor Lawrason dissenting. MOTION: Councilmember Perez moved and Councilmember Hunter seconded a motion to move reconsideration of adjournment. The motion carried by roll call vote 4 -0.
