Moorpark, California December 6, 1995
A Special Meeting of the City Council of the City of Moorpark was
held on December 6, 1995, in the Conference Room of said City
located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 6:38 p.m.
2. ROLL CALL:
Present: Councilmembers Hunter, Perez, Wozniak and
Mayor Lawrason
Staff Present: Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Cheryl Kane, City
Attorney; Lillian Hare, City Clerk.
CONSENSUS: By consensus the Council determined to consider
3.A. after closed session so that this matter could be
discussed on camera.
4. CLOSED SESSION:
MOTION: Councilmember Wozniak moved and Councilmember Hunter
seconded a motion to adjourn to Closed Session for a
discussion of all items listed on the agenda:
A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to
subdivision (b) to Section 54956.9 of the Government
Code: (Number of cases to be discussed - two)
B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation pursuant to Subdivision (c) of
Section 54956.9 of the Government Code: (Number of cases
to be discussed - two)
C. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION

E. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION
(Subdivision (a) of Section 54956.9 of the Government
Code): Dillon vs. the City of Moorpark
The motion carried by voice vote 4 -0.
Present in Closed Session were all Councilmembers; Steven
Kueny, City Manager; Richard Hare, Deputy City Manager;
Cheryl Kane, City Attorney; and Lillian Hare, City Clerk.
Ms. Hare left the closed session at 6:50 p.m.
The Council reconvened into open session at 7 :10 p.m.
Mr. Kueny stated that only items 4.C. and 4.D. were
discussed and there was no action to report.
AT THIS POINT IN THE MEETING A RECESS WAS DECLARED. The time
was 7 :10 p.m.
The Council reconvened into open session in the Council
Chambers at 7:30 p.m. All Councilmembers were present.
3. ACTION /DISCUSSION:
A. Consider Proposal by Ralph Mahan Regarding the
Development of a Golf Course in the Happy Camp Area.
Staff Recommendation: Direct staff as deemed
appropriate.
Ralph Mahan explained his project and requested City
participation for the project.
Mayor Lawrason asked about the legality of the City's
entering into an agreement where City participation is a
part of the project.
Roseann Mikos, 14371 E. Cambridge Street, Moorpark,
addressed the Council in opposition to the project. She
indicated that Mr. Mahan has planted thousands of
eucalyptus trees which are not native vegetation.
Bill Poleri, 6863 Trojan Court, Moorpark, spoke in
opposition to the project and the noise it would create
because of increased traffic.

Councilmember Wozniak indicated that he was opposed to
spending City money on development of the project.
CONSENSUS: By consensus the Council determined to receive
and file the report and to direct staff that no agenda item be
prepared for Council cor:sideration on this matter unless
requested by the Council; a brief explanation on the legality
of City participation in projects requiring City participation
to be provided from the City Attorney.
4. ADJOURNMENT:
Councilmember Wozniak moved and Councilmember Hunter seconded
a motion to adjourn the meeting. The motion carried by voice
vote 4 -0. The time was 7:50 p.m.
