Moorpark, California December 6, 1995
A Regular Meeting of the City Council of the City of Moorpark was
held on December 6, 1995 in the Council Chambers of said City
located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 7:15 p.m.
2. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Lillian Hare.
3. ROLL CALL:

A. Holiday Choral Presentation by the Combined Choirs from
Flory School and the Senior Center Golden Tones.
This presentation commenced at 7:45 p.m. prior to the
convening of the Council. In addition, Ray Hebel and
the Madrigal singers from the Moorpark Memorial High
School entertained the audience.
B. Proclamation for Bicentennial of El Rancho Simi.
Mayor Lawrason presented a proclamation to Pat Habins
and Andy Macek.
C. Introduction of New Employee, Martin Cole, Management
Analyst.

CONSENSUS: By consensus the Council determined to order
the agenda as requested by the City Manager.
6. PUBLIC COMMENT:
Jim Hartley, 5950 Gabbert Road, Moorpark, addressed the
Council. He said he was supportive of a golf course in
the city and the revenue which the city could generate
from a golf course.
7. COMMITTEE REPORTS:

8. CONSENT CALENDAR:
MOTION: Councilmember Wozniak moved and Councilmember Perez
seconded a motion to pull Items 8..D., 8.F. and 8.K. and
approve the balance of the Consent Calendar. The motion
carried by roll call vote 4 -0.
A. Consider Approval of Minutes of a Special Meeting of
the City Council of October 25, 1995.
Consider Approval of Minutes of a Regular Meeting of
the City Council of November 1, 1995.

Building. Staff Recommendation: Direct staff to
prepare a draft agreement to memorialize the
understanding for construction of the proposed
restroom/concession facility and license for use of
Poindexter Park with Moorpark Little League for
presentation to City Council .
E. Consider Minor Modification No. 6 to Planned
Development Permit No. 897 for Approval of a 4, 850
Square Foot Building to be Used as a Day Care Facility
and a 1, 750 Square Foot Restaurant Building on the
Application of George Shakiban. Staff Recommendation:
Receive and file the report .
G. Consider Authorization to Advertise for Receipt of Bids
for the Construction of the Tierra Rejada Road
Subdrainage System. Staff Recommendation: Approve the
plans and specifications for the Subsurface Drainage
System and authorize staff to advertise for receipt of
bids .
H. Consider Authorizing Recordation of the Notice of
Completion for the Construction of Conduits for
Decorative Street Lights and Other Utilities on High
Street . Staff Recommendation: 1) Accept the work as
completed, subject to satisfactory completion of the
maintenance period; 2) Instruct the City Clerk to file
the Notice of Completion for the project; 3) Authorize
the release of the retention upon satisfactory
clearance of the thirty five (35) day lien period.
I . Consider Resolution No . 95-1162 Establishing Parking
Restrictions on Shadyridge Drive. Staff
Recommendation: Adopt Resolution No. 95-1162 .

J. Consider Resolution No. 95 -1163 Adopting New City
Council Rules of Procedure and Rescinding Resolution
No. 94 -1022. Staff Recommendation: Adopt Resolution
No. 95 -1163.
L. Consider Resolution No. 95 -1165 a Request for a Two
Year Time Extension for Vesting Tentative Tract Map No.
4620 on the Application of Dean Rasmussen. Staff
Recommendation: Adopt Resolution No. 95 -1165 approving
a two year time extension of Vesting Tentative Tract
Map No. 4620.
The following items were pulled from the Consent
Calendar for individual consideration:
D. Consider Minor Modification No. 1 to Major Modification
No. 2 of Commercial Planned Development No. 89 -1 on the
Application of Mi Pollo, Inc.(El Pollo Loco Restaurant
located on Pad B). Staff Recommendation: Receive and
file the report.
Mr. Aguilera stated that conditions 3 and 4 were
amended by staff as follows:
No. 3 - all windows and doors shall have a similar arch
to that proposed on the south elevation, except those
windows which will have the diamond graphics above them
as depicted in the proposal.
No. 4 - the diamond graphics located around the
building shall be reviewed and approved by the Director
of Community Development. The stucco finish for the
diamonds and the area surrounding the diamonds shall
have a smooth trowel finish. Color chips are to be
submitted to the Director for review and approval.
MOTION: Councilmember Perez moved and Councilmember Hunter
seconded a motion to receive and file the report with the
amendments as stated by Mr. Aguilera above. The motion
carried by voice vote 4 -0.

F. Consider Authorization to Advertise for Receipt of Bids
for the Construction of a Temporary Traffic Signal at
the Intersection of Tierra Rejada Road and Moorpark
Road. Staff Recommendation: Approve the plans and
specifications and authorize staff to advertise for
receipt of bids.
In response to Councilmember Hunter, Mr. Gilbert
indicated that the project would proceed in February
and construction would last approximately 3 weeks.
MOTION: Councilmember Hunter moved and Councilmember Perez
seconded a motion to approve the plans and specifications
for the project and authorize staff to advertise for receipt
of bids. The motion carried by voice vote 4 -0.
K. Consider Resolution No. 95 -1164 for Approval of Major
Modification No. 1 to CPD 90 -2 on the Application of
American Stores Properties, Inc. Staff Recommendation:
Adopt Resolution No. 95 -1164.
Councilmember Hunter indicated that he had abstained
from all votes related to this project and would do so
now.
MOTION: Councilmember Wozniak moved and Councilmember
Perez seconded a motion to approve Resolution No. 95 -1164
approving Major Modification No. 1 to CPD 90 -2. The motion
carried by voice vote 3 -0, Councilmember Hunter abstaining.
11. ACTION /DISCUSSION:
C. Consider Solid Waste Exclusive Residential and
Commercial Franchise Agreements with G.I. Rubbish and
Moorpark Rubbish Disposal and Adopt Resolution No. 95-
Establishing Service Rates, rescinding Resolution Nos.
94 -1091 and 95 -1105. Staff Recommendation: Approve
solid waste exclusive residential and commercial
franchise agreements with G.I. Rubbish for one year and
Moorpark Rubbish Disposal for five years, subject to
final language approval by the City Manager and City
Attorney; 2) Adopt Resolution NO. 95- establishing
service rates, rescinding Resolution Nos 94 -1091 and
95 -1105; and 3) Issue PRC notification to the remaining
commercial franchised haulers, E.J. Harrison and
Rubbish Control, of the Council's intent to award
exclusive franchises, effective December 8, 1995.

Ms. Lindley gave the staff report. She indicated there
were still outstanding issues and asked the Council to
extend the existing contracts through December 22, 1995
and to continue the item to December 20, 1995.
MOTION: Councilmember Wozniak moved and Councilmember
Hunter seconded a motion to extend the existing agreements
to December 22, 1995 and to continue this item to December
20, 1995. The motion carried by voice vote 4 -0.
E. Consider Preliminary Quality of Life
Thresholds /Standards for New Growth Management Program.
Staff Recommendation: 1) Provide comments on draft
quality of life thresholds/ standards, including the
appropriateness of the issues addressed; and 2) direct
staff to proceed with development of implementation
measures, obtain other agency review of draft
thresholds /standards, and schedule a subsequent City
Council action /discussion item to obtain further
Council authorization prior to proceeding with other
work tasks.
Mr. Kueny suggested continuing this item to January 3,
1996. He indicated that an agenda item would be placed
on the next meeting to consider the agenda for the
January 3 meeting. He indicated that he would suggest
that no items of new business be placed on that agenda.
MOTION: Councilmember Perez moved and Councilmember
Wozniak seconded a motion to continue this item to January
3, 1996. The motion carried by voice vote 4 -0.
9. PUBLIC HEARINGS:
A. Consider the Adoption of Revised Building Codes. Staff
Recommendation: Open the public hearing; accept public
testimony; close the public hearing and conduct Second
Reading of Ordinance No. 210.
The staff report was given by Claude Stewart.
Mayor Lawrason opened the Public Hearing. As there
were no speakers for this item, Mayor Lawrason closed
the Public Hearing.

MOTION: Councilmember Wozniak moved and Councilmember
Hunter seconded a motion to waive further reading and
declared Ordinance No. 210 read for the second time. The
motion carried by voice vote 4 -0.

Hunter seconded a motion to adopt Ordinance No. 210 as read.
The motion carried by voice vote 4 -0.
B. Consider Approval of Vesting Tentative Tract Map Nos.
4973 and 4974 (Carlsberg Financial). Staff
Recommendation: 1) Open the public hearing and accept
public testimony; 2) Determine that the environmental
effects discussed in the Subsequent EIR prepared for
the Amended Carlsberg Specific Plan and the
environmental effects of these proposed subdivisions
are sufficiently similar to warrant the reuse of the
Subsequent EIR; 3)
Make the appropriate findings for each of the
entitlements requested by the applicant; and 4) Direct
staff to prepare a resolution which will reflect the
Council's action for the requested Tentative Tract Maps
for presentation at the City Council meeting of
December 20, 1995.
Mr. Porter gave the staff report.
Mayor Lawrason indicated his displeasure at receiving
information so late in the process.
Mr. Kueny went over the following changes to the
proposed Conditions of Approval:
Page 7, Condition 18 - with regard to this condition
which reads "Landform and grading design shall be
consistent with the City of Moorpark grading standards
in effect on September 7, 199411, Mr. Kueny asked the
Community Development Director to confirm that the
Condition conforms to the Amended Specific Plan and
the grading is shown on the Tentative Map.
In response to Mr. Kueny, Mr. Aguilera indicated that
the condition conforms to the amended Specific Plan and
the grading shown on the Tentative Map.
Page 9, Condition 25, which reads "Prior to
recordation, the Applicant at its sole cost and expense
shall offer to dedicate the park land and the natural
preserve land to the City of Moorpark as shown on the

Amended Specific Plan Exhibit No. 7. The Applicant
shall contribute its fair share of the cost of the
improvements and maintenance as specified in the
Specific Plan and Settlement Agreement" illicited a
request from the Mayor to know if the "fair share" is
the entire cost of the improvements and maintenance.
In response to Mayor Lawrason, Mr. Kueny indicated that
"fair share" was as defined in the Settlement
Agreement. He also said that the document needs to
refer to the amended Specific Plan throughout.
Page 10, Condition No. 30, which reads in part, "All
plans for the guzzler shall be reviewed and approved by
the City prior to issuance of grading permits" to be
changed to read "All plans for the guzzler shall be
reviewed and approved by the Director of Community
Development prior to....."
"Plaintiff" to be changed to be "developer" throughout
the document and "Defendant" to be changed to be "City"
throughout the document.
Page 12, Condition No. 35, last paragraph, the
reference showing ownership interest to be changed to
"developer" and Exhibit B to be corrected to be Exhibit
A.
Page 13, Condition No. 38, which reads "Recorded phased
final maps of each lot within the master Tentative
Tract Maps shall be permitted. Additional Tentative
Tract Subdivision Maps of the lots are to be filed
subsequent to or concurrent with the Master Tentative
Tract Maps (SP -62)" to be clarified with less awkward
wording.
Page 16, Condition No. 56, which reads in part,
"Preservation, transplanting and planting of oak trees
or other significant trees and /or plants shall be
considered" to be clarified as to whether there are
other significant trees or only oaks trees to be
considered. To be made consistent with the second
paragraph of the condition.
Page 21, Condition No. 68, second paragraph regarding
street related issues, to be made consistent with all
other street related conditions throughout the
document.

Page 24, Condition No. 76, the second paragraph which
reads, "The final location of the bus route and
facilities shall be approved by the Director of
Community Development" to be changed to replace the
word "route" with "turnout ".
Condition 83 to be changed to read, "Moorpark
Avenue /Los Angeles Avenue Intersection Improvements:
Prior to issuance of the first zone clearance for
occupancy within Tract 4973 or any subsequent map the
applicant shall pay a fair share of the costs to
convert the shared southbound lane to a second
southbound left -turn lane and convert south -bound
right -turn lane to shared southbound through
lane /southbound right -turn lane (project share 34
percent)."
Condition 84 to be changed to read, "Spring Road /Los
Angeles Avenue: Prior to issuance of the first zone
clearance for occupancy within Tract 4973 or any
subsequent map the applicant shall pay a fair share of
the intersection modification costs to add a third
eastbound and westbound lane, remove second eastbound
left -turn lane; and modify signal to provide a
southbound right -turn overlap with the eastbound left -
turn movement and westbound right -turn overlap with the
south -bound left -turn movement, including any signal
modification costs. (Project share 50 percent)."
Page 25, Condition No. 85 - the City Manager indicated
staff would come back with language relative to this
condition on traffic.
Page 29, Condition No. 99, which reads, "As an option
in place of the surety performance bond requirements,
the applicant or his successors will be allowed to
record the Final Map if the Applicant or his successors
agrees to have a subordinate lien to the benefit of the
City placed on the subject property" is not a standard
condition that the City uses. Mr. Kueny said the City
does not accept a subordinate lien in lieu of a bond.
He said this condition would be rewritten to be
consistent with City standards.
Condition 104 which reads, "The subdivider shall
dedicate to the City of Moorpark the access rights
adjacent to Los Angeles Avenue....." to be changed to
read, "The subdivider shall dedicate to the City of

Moorpark the access rights adjacent to New Los Angeles
Avenue "; in addition, staff to clarify whether or not
Tierra Rejada Road is impacted by this tract- as well as
Peach Hill Road.
Page 31, g., the phrase "Apply nonhazardous chemical
stabilizers to all inactive portions of the
construction site" should not just be deleted but
address alternatives.
Page 32, Condition No. 121 which reads, "Construction
activities should be limited to weekdays and Saturdays
... to be changed to read, "Construction activities
shall be limited to weekdays and Saturdays.... ";
Condition to be made consistent with City ordinance.
Page 34, Conditions 142 and 144 relative to Fire
Department requirements for the completion of Science
Drive to be made consistent.
Page 34, Condition 145 which reads, "A fuel
modification zone shall be maintained 100 feet wide" to
be amended to indicate where the fuel modification zone
will be located.
Mr. Kueny indicated that he had gone through all the
changes for Tract 4973.
For Tract 4974, the following revisions were
recommended by the City Manager:
Page 47, Condition No. 57 which reads, "When water is
present in the seasonal pool, it shall not be
artificially drained or otherwise subjected to
disturbance...." to be reviewed to determine whether a
staff person should be designated to monitor
performance.
Page 48, Condition No. 58 - this condition which is
relative to the preservation, transplanting, and
planting of oak trees or other significant trees will
be made consistent after staff review just as in the
similar condition for Tract 4973.
Page 54, Condition No. 73 - this condition relative to
signalization improvements will be modified to indicate
that there will be a traffic signal at Peach Hill and
Science Drive. The rest of the condition to be
deleted.

Page 54, Condition No. 74 which reads, "Left turn
storage lanes are required at all intersections along
Science Drive as shown on the Specific Plan. No other
median breaks are allowed unless approved by the City
Engineer." to be changed to delete "unless approved by
the City Engineer ".
Page 54, Condition No. 75 relative to the construction
of the north leg of the intersection of Science
Drive /Tierra Rejada Road, to be placed in Condition 72
for clarity.
Page 55, Condition No. 79, this condition which reads,
"The applicant shall include a bus stop or stops in the
final street improvement plan if required by the
Director of Community Development" to be clarified as
to bus "turnouts" not "routes" and to identify the
streets as Science Drive and Tierra Rejada Road.
Page 56, Condition No. 83, this condition which is
relative to trail easements and improvements and
begins, "The final map shall indicate the location of
all trail easements...." to be made consistent with the
language for both tracts.
Page 61, Condition No. 110, to be changed to read, "The
subdivider shall dedicate to the City of Moorpark the
access rights adjacent to Los Angeles Avenue, Spring
Road, Peach Hill Road, Tierra Rejada Road and Science
Drive except for access locations approved by Amended
Specific Plan or subsequent action of the City
Council."
Page 66, Conditions No. 148 and 150 to be reconciled
and 150 clarified as per Tract 4973.
Mr. Kueny indicated that the language for the
conditions of .both tracts would be checked for
consistency.
Mayor Lawrason opened the Public Hearing.

Ron Tankersly, 2800 28th Street, Santa Monica,
addressed the Council in behalf of the applicant. He
indicated that the applicant was concerned with the
following:
1. Condition 16 - he said the oak trees should
be the only trees which need to be mitigated.
2. Condition 85 - he said he did not believe
there were any unmitigated traffic issues left.
3. Condition 106 - he indicated this condition
should be deleted for the project.
4. Condition 73 - he indicated this condition
needed to be reworded and he would be willing to
work with staff to accomplish that.
5. He said Conditions 42 and 44 of Fire
Department conditions were not consistent.
6. Condition 153 - he said this condition should
be pursuant to a sales agreement or condemnation
(Ventura County Waterworks District No. 1
condition).
Mr. Kueny indicated his agreement with the applicant on
Condition 106.
Roseann Mikos, 14371 E. Cambridge Street, Moorpark,
addressed the Council on behalf of the Environmental
Coalition. She said regional pathway plan language
should be included in the conditions for this project.
She further stated that the wording "seasonal pool"
should be changed to "vernal pool ". She also indicated
that the Arroyo Simi Management Plan should be
referenced regarding development along the Arroyo.
MOTION: Councilmember Perez moved and Councilmember Hunter
seconded a motion to continue this item to December 20, 1995
with the Public Hearing to remain open. The motion carried
by voice vote 4 -0.

11. ACTION /DISCUSSION:
December 6, 1995
A. Consider Appointment to Fill a Vacancy on the Teen
Council. (Continued item)
NOMINATION: Mayor Lawrason nominated and Councilmember
Perez seconded the nomination of Renee Beck to the Teen
Council. The motion carried by voice vote 4 -0.
B. Consider Selection of Member of the City Council to
Serve on the Economic Development Collaborative of
Ventura County. Staff Recommendation: Appoint a
member to this Committee if there is interest among the
Councilmembers.
CONSENSUS: By consensus Councilmember Perez was selected
to serve on the Economic Development Collaborative of
Ventura County.
D. Consider Adoption of Resolution No. 95- Certifying
the Final Environmental Impact Report (EIR) for the
Moorpark Country Club Estates Project (Bollinger
Development Corporation). Staff Recommendation: Adopt
Resolution No. 95- certifying 1) The final EIR
reflects the independent judgment of the City of
Moorpark as lead agency; 2) the Final EIR has been
completed in compliance with the California
Environmental Quality Act and the City's CEQA
procedures; and 3) the City Council received and
considered the information contained in the Final EIR
prior to making any approval decision for the project.
Ms. Traffenstedt gave the staff report.
Steve Craig, from The Planning Corporation, the City's
contractor for the EIR, summarized the document.
Paul Bollinger, 2820 Townsgate, Thousand Oaks,
addressed the Council in support of his project.
Rob Talmadge, 351 Rolling Oaks Drive, addressed the
Council as a consultant for the applicant. He
indicated he was available to answer any questions and
indicated they were ready to move forward with the
project.

Jim Hartley, 5950 Gabbert Road, indicated that he
believed the EIR was incomplete. He said the applicant
has not contacted the adjoining neighbors on the south
and no notice has been given to the public by the
developer of the project. He said the Parks and
Recreation Commission has not been contacted and the
plan is inconsistent with the Recreation Element of -the
General Plan. He said a buffer area on both sides of
the project should be considered.
Scott Hunter, 2900 Madera Road, Simi Valley, addressed
the Council on behalf of Bugle Boy Industries, In.c. He
stated that the Walnut Canyon hydrology information
should be updated. He said there should be a
discussion of the upstream watershed relative to the
project which was above Bugle Boy's property in Walnut
Canyon.
Mr. Craig said that there would be no increased
drainage offsite respective to the Bugle Boy property.
In response to Councilmember Hunter, Mr. Aguilera said
that the applicant may have filed previous to the
adoption of a Hillside Ordinance and therefore would
not be subject to the ordinance. He also said that a
development agreement could be drafted to indicate that
the project is exempt from the Hillside Ordinance.
Ms. Traffenstedt indicated that the only change staff
was requesting to the EIR was regarding the mitigation
requirement imposed for school impacts which reads:
The project's contribution to offsetting
cumulative impacts on educational quality
shall be mitigated by the contribution of a
$20,000 Educational Quality Grant to the
District. These funds shall be restricted to
the purchase of library books and the
improvement of existing library resources
(including special education teaching
materials) at either elementary or secondary
school facilities.
She said that the School District confirmed that only
statutory fees need be assessed.
CONSENSUS: By consensus, the Council determined to modify
the mitigation requirement imposed for school impacts in the
EIR to the statutory fees allowed.

MOTION: Councilmember Wozniak moved and Mayor Lawrason
seconded a motion to request that staff prepare a resolution
certifying the final EIR and indicating that it reflects the
independent judgment of the City of Moorpark as lead agency;
that the Final EIR has been completed in compliance with the
California Environmental Quality Act and the City's CEQA
procedures; and that the City Council received and
considered the information contained in the Final EIR prior
to making any approval decisions for the project. The
motion carried by roll call vote 4 -0.
Councilmember Perez indicated that in no way should the
vote on the EIR presuppose the outcome of the project's
approval.
Councilmember Hunter indicated he concurred with
Councilmember Perez.
13. CLOSED SESSION:
MOTION: Councilmember Hunter moved and Councilmember Perez
seconded a motion.to adjourn to Closed Session for a
discussion of all items.

AT THIS POINT IN THE MEETING a recess was declared. The
time was 11:05 p.m. The Council reconvened into Closed
Session at 11:10 p.m.
Present in Closed Session were all Councilmember; Steven
Kueny, City Manager; Richard Hare, Deputy City Manager;
Cheryl Kane, City Attorney; and Ken Gilbert, Director of
Public Works.
Mr. Gilbert left the Closed Session at 11:25 p.m.
The Council reconvened into Open Session 11:40 p.m.
Mr. Kueny said there was no action to report and only items
13.A., 13.C, 13.D. and 13.E. were discussed.
14. ADJOURNMENT:
Mayor Lawrason adjourned the meeting. The time was 11:40
p.m.
