Moorpark, California March 13, 1996
A Adjourned Regular Meeting of the City council of the City of
Moorpark was held on March 13, 1996, in the Council Chambers of
said City located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 7:45 p.m.
2. PLEDGE OF ALLEGIANCE:
Councilmember Wozniak led the Pledge of Allegiance.
3. ROLL CALL:
Present: Councilmembers Hunter, Perez, Wozniak and
Mayor Lawrason
Staff Present: Steven Kueny, City Manager; Cheryl Kane, City
Attorney; Dirk Lovett, Assistant City
Engineer; Charles Abbott, City Engineer;
Deborah Traffenstedt, Senior Planner; Lillian
Hare, City Clerk
4. PUBLIC COMMENT:
None.
8. PUBLIC HEARINGS:
C. Consider Approval of the Moorpark Country Club Estates
Project Proposed by Bollinger Development Corporation
(General Plan Amendment No. 94 -1, Zone Change No. 94 -1,
Vesting Tentative Map No. 4928, Residential Planned
Development Permit No. 94 -1, and Conditional Use Permit
No. 94 -1) . Staff Recommendation: 1) Open the public
hearing and take public testimony; 2) Consider draft
conditions of approval and provide staff with any
comments regarding required revisions; 3) Direct staff to
provide the City Council with the Addendum to the Final.
EIR and any recommended revisions to conditions for a
continued public hearing on March 13, 1996; 4) Direct
staff to provide the City Council with a draft Mitigation
Monitoring Program, EIR Findings, and Statement of
Overriding Considerations, for the City Council's meeting
on March 20, 1996; and 5) Continue the public hearing to
March 13, 1996. _

Ms. Traffenstedt gave the staff report. She indicated
that staff was recommending that the City Council
consider the option of planning and zoning the golf
course area as open space. In addition she indicated
that the conditions of approval as currently proposed
require dedication of an irrevocable easement for the
trail.
AT THIS POINT IN THE MEETING a recess was declared. The time
was 9:05 p.m. The Council reconvened at 9:20 p.m.
The Council reviewed the conditions of approval for the
residential planned development permit No. RPD 94 -1
conditions of approval.
PERMITTED USES
Condition No. 1. This condition was revised to add the
word "residential" and the last sentence as follows,
"recordation of a final map is required prior to approval
of a zoning clearance for a residential building permit
in any phase as shown on sheet 4 of the vesting tentative
map ".
STREET IMPROVEMENTS
Condition 56. This condition revised as follows relative
to the first portion of the first sentence, "prior to
occupancy of the first residential unit of Tract 4928..."
INTERIOR STREETS
Condition 58. The language of this condition regarding
public streets to be revised to be consistent with the
conditional use permit document.
The Council went through the conditions of approval for the
vesting tentative map No. 4928 as follows:
OUTSTANDING CITY CASE PROCESSING COSTS
Condition 14. Mr. Bollinger requested that this
condition be revised to allow the payment of the fees
prior to the permit release. No action to revise the
condition was taken by the Council.

ASSESSMENT DISTRICT "C" STREET
Condition 19. The language of this condition to be
modified to be consistent with the conditional use permit
document.
GENERAL GRADING SEQUENCE
Condition 32. Mr. Bollinger requested that this
condition be revised to indicate that a rough grading
permit "shall" be approved rather than "may" be approved
if the condition requirements have been met. He further
indicated that he would provide a bond. Mr. Kueny
indicated that the developer agreement will cover phased
grading more specifically.
SURETY FOR COMMON MAINTENANCE AREA IMPROVEMENTS
Condition 44. Mr. Kueny reviewed this condition with the
Council. Mr. Bollinger indicated his concurrence with
this condition.
LANDSCAPING REQUIREMENTS
Condition 48.(n) This portion of the condition which
is relative to an irrevocable offer of dedication for an
easement to the City for the purpose of maintaining all
landscaping slope areas adjacent to public and private
roadways is to be revised to be consistent with the
conditional use permit document.
EASEMENT PROHIBITING FUTURE RESIDENTIAL DEVELOPMENT IN
GOLF COURSE AREAS
Condition 52. Mr. Kueny indicated that Mr. Bollinger has
agreed to put additional language in the development
agreement that will address this condition.
MULTI USE TRAIL EASEMENT
Condition 56. Mr. Bollinger indicated that he did not
agree that a ten year surety for the trail construction
should be required. Mr. Kueny said that this condition
would probably be addressed in the development agreement
but if not placed in the development agreement, the
condition should continue in the map document.
CITY ENGINEER CONDITIONS OF APPROVAL - GENERAL
REQUIREMENTS
Condition 86. This condition relative to phased grading
to be made consistent with the conditional use permit
document.

CONSENSUS: By consensus, the Council determined to grant
authority to the City Manager to approve rough grading permits
which will be granted in accordance with the approved phasing
plan.
Condition 89. Mr. Bollinger requested that the language
of this condition be revised as follows, "the grading
plan shall provide that grade of slopes be hydro seeded
or permanently landscaped within 45 days of completion of
rough grading... ".
CONSENSUS: By consensus, the Council determined to revise
the condition as requested by Mr. Bollinger above.
WALNUT CANYON ROAD
The condition of this section to reflect the intersection
improvements to be obtained by the realignment of C
Street.
GRIMES CANYON ROAD
Condition 144. This condition to be placed as the last
condition in this section and to be revised to read,
"Prior to occupancy of the first residential unit of
tract 4928 or the golf course facility, whichever occurs
first, the subdivider shall improve Grimes Canyon Road ".
INTERIOR STREETS (PUBLIC)
Condition 149. This condition to be rewritten to be
consistent with the conditional use permit document. The
reference to a tunnel being constructed under C Street
north of the west golf course ninth hole green clubhouse
access road to be deleted.
The tunnel under C Street at the Gabbert Street crossing
to remain.
OTHER FEES AND IMPROVEMENT DESIGN REQUIREMENTS
Condition 164 & 165. Mr. Bollinger indicated his
concurrence with these conditions.
Condition 168(B). Mr. Bollinger indicated that this
condition conflicts with condition 149 which specifies a
5' foot shoulder for the north side of C Street. He
requested revision to the language.
CONSENSUS: By consensus, the Council determined to request
staff to clarify the language as requested by Mr. Bollinger
above.

ROAD AND DRIVEWAY REQUIREMENTS
Condition 203 and 204. These conditions to apply to
private roads only.
The Vesting Tentative Map No. 4928 document to be revised
throughout relative to references to owners' association
and homeowners' association.
A. Dwayne Jones, 1055 Marine View, addressed the Council
expressing his approval of the project. He indicated
that his only concern was with the access to the project
off of Walnut Canyon. He indicated the access should be
200' feet to the south for safety reasons.
Tim Kelly, 14357 E. Cambridge Street, addressed the
Council and indicated that he felt the EIR did not
adequately address growth or air quality impacts. He
said this project would violate the City's Hillside
Ordinance and be growth inducing.
Patrick Leyden, 12752 Summer Street, addressed the
Council in support of the project.
In response to Council concerns, Mr. Bollinger indicated
that he and his engineer would look at a realignment of
C Street.
CONSENSUS: By consensus, the Council determined to direct
staff that the trail was to continue as part of the project.
Councilmember Perez requested information on the point of
entry for the trail and security.
Pete Peters, 7155 Walnut Canyon, addressed the Council
regarding the trail. He said that he supported the trail
which could be given to the Santa Monica Conservancy upon
completion.
CONSENSUS: By consensus, the Council determined to direct
staff to prepare the resolutions of approval, the document of
overriding consideration for the mitigation monitoring program
and the appropriate findings for the March 20 City Council
meeting, and to direct that the Public Hearing be continued
open to an Adjourned Meeting on Monday, March 18, at 7:00 p.m.

12. CLOSED SESSION:
MOTION: Councilmember Hunter moved and Mayor Lawrason
seconded a motion to adjourn to Closed Session for a
discussion of item 12.D.:
D. PUBLIC EMPLOYEE PERFORMANCE EVALUATION (pursuant to
Government Code Section 54957
Title: City Manager, Deputy City Manager, Director of
Community Services, Director of Community Development,
Public Works Director, City Clerk, Chief of Police, City
Engineer, and City Attorney
The motion carried by voice vote 4 -0.
AT THIS POINT IN THE MEETING a recess was declared. The time
was 10:25 p.m.
The Council reconvened into Closed Session at 10:30 p.m.
Present in Closed Session were all Councilmembers and Steven
Kueny, City Manager.
The Council reconvened into Open Session at 11:00 p.m.
Mr. Kueny stated there was no action to report and only item
12.D. was discussed.
6. ADJOURNMENT:
Councilmember Hunter moved and Councilmember seconded a motion
to adjourn to Monday, March 18 at 7:00 p.m. The motion
carried by voice vote 4 -0. The time was 11:01 p.m.
