Moorpark, California March 18, 1996
A Adjourned Regular Meeting of the City council of the City of
Moorpark was held on March 18, 1996, in the Council Chambers of
said City located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 7:45 p.m.
2. PLEDGE OF ALLEGIANCE:
Councilmember Hunter led the Pledge of Allegiance.
3. ROLL CALL:
Present: Councilmembers Hunter, Perez, Wozniak and
Mayor Lawrason

4. PUBLIC COMMENT:
None.
8. PUBLIC HEARINGS:
C. Consider Approval of the Moorpark Country Club Estates
Project Proposed by Bollinger Development Corporation
(General Plan Amendment No. 94 -1, Zone Change No. 94 -1,
Vesting Tentative Map No. 4928, Residential Planned
Development Permit No. 94 -1, and Conditional Use Permit
No. 94 -1) . Staff Recommendation: 1) Open the public
hearing and take public testimony; 2) Consider draft
conditions of approval and provide staff with any
comments regarding required revisions; 3) Direct staff to
provide the City Council with the Addendum to the Final
EIR and any recommended revisions to conditions for a
continued public hearing on March 13, 1996; 4) Direct
staff to provide the City Council with a draft Mitigation
Monitoring Program, EIR Findings, and Statement of
Overriding Considerations, for the City Council's meeting
on March 20, 1996; and 5) Continue the public hearing to
March 13, 1996.
Mr. Kueny indicated that Mr. Bollinger had agreed to a
time extension for the project.

Mayor Lawrason noted that the Public Hearing remained
open.
Roseann Mikos, 14371 E. Cambridge Street, addressed the
Council regarding the Bollinger project. She said she
was glad that a time extension was to be granted so the
public would have an opportunity to review the documents
relative to the project. She expressed concerns with
traffic mitigation. She said that there is a
recirculated EIR for Transit Mix Concrete's conditional
use permit. She said the recirculated EIR should be
reviewed for anything pertinent to truck traffic from the
Bollinger project. She also stated that the voters
should be allowed to determine whether such huge projects
as the Bollinger project would be approved.
The Council reviewed the conditional use permit (CUP 94-
1)conditions of approval as follows:
Use Inauguration
Condition 4. Mr. Bollinger requested the deletion of
the language referencing that the Director of Community
Development may grant a 30 year extension through the
permit adjustment process if at the end of the first 3
year period all approved uses and facilities have been
constructed.
Severabilitv
Condition 8. Mr. Kueny indicated that the City Attorney
would provide revised and updated language for the
severability condition.
Condition Compliance Costs
Condition 11. Mr. Bollinger requested the dollar amount
of the fees that will be charged relative to condition
compliance. In response Mr. Kueny indicated it was
customary for developers to pay conditional compliance
costs as those costs were incurred. He said staff would
provide a current dollar amount but stated that the
condition should remain in the conditions of approval.
Citywide Traffic Mitigation Fees
Condition 16. Mr. Kueny indicated that the condition
should be revised to show that the citywide traffic
mitigation fee is calculated at 3,000.00 x 5.6 x 9.18
acres for the proposed golf courses.

Mr. Bollinger requested deletion of this condition.
In response, Mr. Kueny indicated to the Council
that this was a "deal point" for discussion with
the Development Agreement Ad Hoc Committee or full
Council.
Relation to Vesting Map No. 4928
CONSENSUS: By consensus the Council determined to revise
condition No. 22 to read, "no zoning clearance for golf course
installation of irrigation and permanent landscaping, and
construction of golf course buildings, shall be issued until Phase
1 of Vesting Map No. 4928 has been recorded ".
Assessment District for "C" Street Related Improvements
Condition 28. Mr. Kueny indicated that this condition would
be revised to include language that would allow the
enforcement of the vehicle and municipal codes on C Street
prior to its acceptance by the city.
General Grading Sequence
Condition 31. This condition to be revised relative to (1) to
read, " a mass or rough grading permit shall be approved prior
to recordation..."
Drainaae Between Lots
Condition 36. This condition relative to cross lot drainage
to be made internally consistent with other entitlements.
Perimeter Fencing /Wall Requirements
Condition 38. Mr. Bollinger objected to the requirement of 8'
foot fencing.
Multi Use Trail
Condition 39. The Council determined to retain this condition
as presently written.
Pattern Pavement
Condition 40. This condition to be revised to begin,
"patterned pavement may be provided... ".

Condition 41. An exhibit to be provided referencing who will
be required to maintain the 100' foot non buildable area,
restricted use easement.
Landscaping Requirements
Condition 42. An exhibit to be provided which will show
landscaping and irrigation.
Condition 42. Graffiti prevention:
This condition to be rewritten to read, "At major and
minor entrances and anywhere a wall exists, the area
directly in front of the wall shall be planted with
clinging vines or other similar planting to prevent
graffiti."
Surety for Rough Grading
Condition 45. This condition to be rewritten to allow
approval of an early grading agreement by the City Manager.
Integrated Golf Course Management (IGCM) Plan
Condition 66. This condition relative to golf course ponds to
be rewritten to clarify that the intent has to do with
vegetation and not fish.
General Requirements
A condition to be added as the last condition stating that a
fish and game filing fee would be required.
Street Improvements
Grimes Canyon Road. A reference to the exhibit to be made as
conceptually acceptable with final determination by the City
Engineer.
Interior Streets. Staff to make clear in the condition that
there is only one tunnel.
Drain Construction the Following Condition Shall Apply
Condition 124. This condition relative to allowable
construction hours to be clarified that the intent is no hours
in excess of 9 -5 on Saturdays. In addition, the condition is
to indicate that inspection of Saturday work will comt�
"premium ".

Prior to Zoning Clearance /Building Permit
Condition 142. This condition relative to golf cart crossings
at roadways to be deleted.
Condition 145. This condition to be rewritten to read, "all
ingress and egress from the clubhouses shall be provided with
a minimum maintained 5' foot candles of light or other minimum
as approved by the Director of Community Development after
consultation with the Chief of Police.
Fire Hydrant /Fire Flow Requirements
Condition 175 which require an approved spark arrester to be
installed on all chimneys to be deleted.
AT THIS POINT IN THE MEETING a recess was declared. The time was
9:00 p.m. The Council reconvened at 9:15 p.m.
Mr. Haaland, engineer for Mr. Bollinger, presented an exhibit
of the realignment of C Street which alignment would allow for
a 300' foot site distance gain on the north and require less
grading overall. In addition, Mr. Haaland indicated that by
moving lot No. 2, the alignment would be improved even
further.
AT THIS POINT IN THE MEETING Mayor Lawrason closed the Public
Hearing.
The Council considered the addendum to be final EIR as
follows:
The adoption of a development agreement should be added
as No. 4 in the addendum analysis.
Throughout the document references to 218 custom homes
should be deleted.
Following, "The redesigned project, compared to the
original project, has the following general attributes ",
No. 10 should be revised to delete the reference to
approximately 5 acres.
No. 12 to be rewritten to reference linking Walnut Canyon
Road and Grimes Canyon Road, and to reference the
elimination of the driveways on C Street and to reference
the new alignment of C Street.

The Council reviewed the Mitigation Monitoring Program.
1. Plan Check Monitoring participants to be revised to
include Community Development Department staff, landscape
architects, County Public Works Agency staff, a biologist and
flood control personnel.
2. Field Monitors to be revised to include City Engineering
staff, Community Development staff, biologist, flood control
personnel, and landscaping architect.
3. The reporting program to involve preparation of a weekly
written report to the City rather than monthly.
4. Under construction crew orientation, language to be
included to have the developer designate a contact person.
S. Regarding dispute arbitration procedures, "arbitration"
to be changed to read dispute procedures. The authority for
this process to come from the Community Development Director.
6. The selection and assignment of appropriate monitors
section to be deleted.
7. The air quality mitigation measures to be revised to
indicate that no dirt is to be transported off site unless
approved by the Director of Community Development.
Mr. Bollinger expressed his desire that the same consultants
be hired for the monitoring program as had been used thus far
in his project planning.
Mr. Bollinger indicated that he would grant an extension to
the City up to and through April 18; with the added provision
that as soon as four Councilmembers were present and voting on
or after March 27, his project would be voted upon.
CONSENSUS: By consensus the Council determined to accept the
offer of extension from Mr. Bollinger.

6. ADJOURNMENT:
Mayor Lawrason adjourned the meeting. The time was 9:45 p.m.
