Moorpark, California August 7, 1996
A Special Meeting of the Moorpark City Council was held on August
7, 1996 at the Moorpark Community Center located at 799 Moorpark
Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 6:40 p.m.
2. ROLL CALL:
Present: Councilmembers Brown, Hunter, Perez, Wozniak,
and Mayor Lawrason
Staff Present: Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Cheryl Kane, City
Attorney; Nelson Miller, Director of Community
Development
3. CLOSED SESSION:
Mr. Kueny requested that the City Council adjourn to Closed
Session under all items. Mr. Kueny announced that the facts
and circumstances for one case under item 3.A. that might
result in litigation against the City are the deliberations
and votes of the City Council on July 2, 1996 regarding appeal
96 -1 which facts and circumstances are described in a letter
dated July 31, 1996 from Jeffrey W. Kramer, Esq. of the law
firm of Troy & Gould, on behalf of his client, Ali and Anna
Boukhari.
MOTION: Councilmember Hunter moved and Councilmember Brown
seconded a motion to adjourn to Closed Session for a
discussion of all items:
A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to
Subdivision (b) to Section 54956.9 of the Government
Code: (Number of cases to be discussed - two)
B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation pursuant to Subdivision (c) of
Section 54956.9 of the Government Code: (Number of cases
to be discussed - two)
C. CONFERENCE WITH REAL PROPERTY NEGOTIATOR

Negotiating parties: City of Moorpark and Southern
California Edison
Under Negotiation: Price and Terms of Payment
The motion carried by unanimous voice vote. The time was 6:41
p.m.
Present in Closed Session were all Councilmembers; Steven
Kueny, City Manager; Richard Hare, Deputy City Manager; Cheryl
Kane, City Attorney; Nelson Miller, Director of Community
Development.
Mr. Kueny left the Closed Session at 6:41 p.m. Mr. Kueny
returned to the Closed Session at 6:47 p.m.
The Council adjourned to Open Session at 7 :05 p.m.
Ms. Kane stated that in Closed Session the City Council
discussed the one case under Item 3.A., that was announced by
Mr. Kueny having first determined that a Closed Session was
authorized pursuant to Government Code Section 54956.9(b) (2)
and they stayed in Closed Session under Government Code
Section 54956.9(b) (1) because based on existing facts and
circumstances there is a significant exposure to litigation
against the local agency.
Ms. Kane stated that Items 3.B, and 3.C. were not discussed.
4. ADJOURNMENT:
Mayor Lawrason adjourned the meeting at 7 :05 p.m.
