HomeMy WebLinkAboutMIN 1996 1009 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California October 9, 1996 A Special Meeting of the City Council of the City of Moorpark was held on October 9, 1996, in the Conference Room of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: The meeting was called to order by Mayor Pro Tem Wozniak at 7 :08 p.m. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember Hunter. 3. ROLL CALL: Present: Councilmembers Brown, Hunter, Perez, and Mayor Pro Tem Wozniak Absent: Mayor Lawrason Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Ken Gilbert, Director of Public Works; Lillian Hare, City Clerk. 4. PRESENTATION /ACTION /DISCUSSION: A. Consider Direction to Staff to Make a Written Offer to Southern California Edison to Acquire a Portion of 506 -010- 045 for the Full Amount of the Appraisal. Staff Recommendation: Direct the City Manager to make a written offer to Southern California Edison for the full amount of the appraisal. Mr. Gilbert gave the staff report. In response to Councilmember Wozniak, Mr. Kueny indicated that an offer would be made to Southern California Edison tomorrow after which they would have until Monday, October 28, 1996 to respond. He indicated that the process of condemnation can take 30 to 90 days. Rudy Gonzales, 3589 Foothill Drive, Thousand Oaks, addressed the Council on behalf of Southern California Edison. He introduced Paula Aimes, Licensing Specialist for Southern California Edison. Minutes of the City Council Moorpark, California Page 2 October 9, 1996 Ms. Aimes addressed the Council and indicated that Southern California Edison would agree to a friendly condemnation to allow the City to take early possession of the property within 6 to 10 days. Mr. Kueny responded to the Council that the City Attorney has advised it will take about 30 days to go through the court process to obtain early possession of the property. He said the City Attorney has advised that the City must first make an offer. He said the offer portion of the process cannot be skipped. Councilmember Perez indicated his dismay at the layers of bureaucracy behind which Southern California Edison has hidden during this process. Councilmember Hunter indicated his concurrence that there has been a level of insulation between the City and Southern California Edison. He indicated his frustration that the City has not been allowed to deal with the decision makers at Edison. Councilmember Brown indicated the importance of dealing with the decision makers only. In response to Councilmember Hunter, Mr. Kueny said that the funding for the property would come two thirds from the Los Angeles Area of Contribution and one third from the Tierra Rejada /Spring Road Area of Contribution. MOTION: Councilmember Hunter moved and Councilmember Brown seconded a motion to approve the appraisal report prepared by Bernie Garcia & Associates setting forth the appraised value of the subject easements; to establish the amount of just compensation for the acquisition of the subject easements to be the amount set forth in the said appraisal report; to direct the City Manager to make an offer to Southern California Edison to acquire said easements, the offer to be the full amount of said just compensation; the date by which a response is required from Southern California Edison to be revised to Monday, October 21, 1996 contingent upon the City Attorney's advice; the date to remain Monday, October 28, 1996 . if the City Attorney does not concur with the earlier date. ADJOURNMENT: MOTION: Councilmember Hunter moved and Councilmember Perez seconded a motion to adjourn. The motion carried by voice vote 4 -0, Mayor Lawrason absent for the vote.
