CALL TO ORDER: Mayor Pro Tem Wozniak called the meeting to order at 11:15 p.m. 2. ROLL CALL: Present: Councilmembers Brown, Perez, and Mayor Pro Tem Wozniak Absent: Councilmember Hunter and Mayor Lawrason Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Cheryl Kane, City Attorney; and Nelson Miller, Director of Community Development 3. CLOSED SESSION: MOTION: Councilmember Perez moved and Councilmember Brown seconded a motion to adjourn to Closed Session for discussion of all items listed: A. CONFERENCE WITH REAL PROPERTY NEGOTIATOR Property: Portion of 506 -010 -045 Negotiating parties: City of Moorpark and Southern California Edison Under Negotiation: Price and terms of payment B. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION Subdivision (a) of Section 54958.9 of the Government Code): Dillon vs. The City of Moorpark C. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Subdivision (a) of Section 54956.9 of the Government Code) : Ali Z. Boukhari v. The City of Moorpark, Eloise Brown, Patrick Hunter, Bernardo M. Perez, Paul W. Lawrason Jr., and John E. Wozniak The motion carried by voice vote 3 -0, Councilmember Hunter and Mayor Lawrason absent for the vote. Present in Closed Session were Councilmembers Brown, Perez and Mayor Pro Tem Wozniak; Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Cheryl Kane, City Attorney; and Nelson Miller, Director of Community Development. OW (jZ2 Minutes of the City Council Moorpark, California Page 2 October 2, 1996 The Council reconvened into Open Session at 6:50 p.m. Mr. Kueny stated that only Items 3.A. and 3.B. were discussed, that there was no action to report regarding Item 3.A., but that the following action was taken regarding 3.B.: MOTION: Mayor Pro Tem Wozniak moved and Councilmember Perez seconded a motion to direct the City Attorney to seek Supreme Court review in the case of Dillon v. The City of Moorpark. The motion carried by voice vote 3 -0, Councilmember Hunter and Mayor Lawrason absent for the vote. 4. ADJOURNMENT: Mayor Pro Tem Wozniak adjourned the meeting.
