HomeMy WebLinkAboutMIN 1996 0814 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California August 14, 1996 A Special Meeting of the Moorpark City Council was held on August 14, 1996 at the Moorpark Community Center located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 7 :25 p.m. 2. ROLL CALL: Present: Councilmembers Brown, Hunter, Perez, Wozniak, and Mayor Lawrason Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Cheryl Kane, City Attorney; Nelson Miller, Director of Community Development; Dirk Lovett, Assistant City Engineer; Deborah Traffenstedt, Senior Planner; and Dorothy Vandaveer, Deputy City Clerk CONSENSUS: By consensus, the Council determined to consider Presentation /Action /Discussicn Item 4.A. prior to the public hearing Item 3.A. 4. PRESENTATIONS /ACTION /DISCUSSION: A. Consider Adoption of Resolution No. 96 -1217 Approving Appeal No. 96 -1 Filed by Aquaria, Inc., Sherman Family Investment Group, Ltd., Teledyne Laars and Kavlico Corporation Appealing the Action of the Planning Commission Approving Conditional Use Permit No. 95 -2 to Permit a Service Station /Mini -Mart at Condor Drive and Los Angeles Avenue and Denying Conditional Use Permit No. 95 -2. Staff Recommendation: Adopt Resolution No. 96 -1217 Approving Appeal No. 9(-' and denying Conditional Use Permit No. 95 -2. Nelson Miller gave the staff report. He suggested that the Council consider mak :_ng the following changes to the resolution read as f( laws: "NOW, 'THEREFORE, THE CITY !- OUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, D,)ES RESOLVE AS FOLLOWS: SECTION ?. Uniform, consistent, and reliable traffic circulation, including he :safe movement of vehicles, Minutes of the City Council Moorpark, California Page August 14, 1996 pedestrians, and bicycl-.sts, is a paramount concern to the City Council. SECTION 2. Based on information contained in the staff report, public testimony, and other information, including supplemental traffic studies presented to the City Council; the City Council finds that due to adverse impacts regarding additional traffic generated as a result of the "Project ", traffic circulation associated with the Project, and the Project's proximity to existing freeway ramps, the Project would be detrimental to the public interest, healft, safety, convenience, and welfare. SECTION 3. The City council approves Appeal No. 96 -1 appealing the action of the Planning commission approving Conditional Use Permit No. 95 -2 to permit a service station /mini- market at -he Northeast corner of Los Angeles Avenue and Condor Drive on Assessor's Parcel No. 513 -0- 060 -27. SECTION 4. The City C;r nci denies Conditional Use Permit No. 95 -2." MOTION: Councilmember Hunter moved and Councilmember Perez seconded a motion to adopt Resolution No. 96 -1217 as amended above. The motion carried b,.! unanimous voice vote. 3. PUBLIC HEARINGS: A. Consider the Special Devices Incorporated (SDI) Project: General Plan Amendment No. 95 -1, Zone Change No. 95 -3, Vesting Tentative Map No. 5004, and Industrial Planned Development (IPD) Permit No. 95 -2. Staff Recommendation: Adopt Resolution No. 96 -1217 approving Appeal No. 96 -1 and denying conditional t.se, Permit No. 95 -2. Debbie Traffenstedt gav(� t`iQ staff report. Minutes of the City Council Moorpark, California Page 3 August 14, 1996 Steve Craig, Consultant, spoke as a representative of The Planning Corporation, Santa Barbara. He addressed issues of drainage, hydrology, flood control and the discharge of water into the Arroyo Simi, biological resources as well as environmental issues. Ile summarized the alternatives that have been looked at and how the applicant has altered the project accordingly. Mayor Lawrason opened the public hearing. Tom Treinen, 16830 W. Placerita Canyon Road, Newhall, spoke as a representative of Special Devices, Inc. He provided a background o� the ompany's development and growth. He stated that they need this faci'ity in Moorpark for their compan/'s growth. James Littlefield, spokE as a representative of Special Devices, Inc. He said the company is very quality oriented and that they 4 -- 1 1 be a leader in tl-:e nation soon in air bag production. Robert Ritchie, spoke is a representative of Special Devices, Inc., 16830 Plac:erita Canyon Road, Newhall. He spoke as President of tle Aerospace Division and stated that his division is growing and they need the space of the proposed new facility in Moorpark. John Cuthbert, 2160 Via Veneto, Camarillo, spoke as a representative of Specii1 Devices, Inc. He provided a history of the company. Byron Pinckert, 16969 'Ion Karmon, Irvine, spoke as a representative of Hill P.nckert Architects, Inc. He said that the entire pro- -jec.± has been designed to maintain very low density on the rite. He indicated that there will be relatively :.tt e - irading done. Ed Ball, spoke as a consultant to SDI, from Ball Properties, 31717 La Tienda Dr., Westlake Village. He addressed the concern r.f�garding the runoff water from a catastrophe such as a re that might - ontaminate the water supply. He saic that SDI would be willing to accept a condition tha*. they provide detention basins around the perimeter of --I,:e Nii l d ng to retain -he water in the event. of a catastrophe. He said the fire department has visited the Arizona plant and they have imposed stiff conditions which SDI will strive to meet or exceed. Ee commented on the following Tentative Tract Map conditions: Condition No. 18 - Mr. Bal- said that the applicant would prefer that SDI or the Owners Association control the landscape within the hol:ndaries and not provide an irrevocable offer of an easement to the City for the purpose of maintaining landscaping and related drainage improvement. Mr. Kueny stated that this is a standard condition and that the intent is t.o r.ake sure the landscaping is maintained. CONSENSUS: By consensus, the 'council determined to leave Condition No. 18 as stated ir. _:.e staff report. Condition No. 44 - Telev;:zdo,r Cable Service Mr. Ball said the facL--i':y does not need cable tv service. Mr. Kueny stated that this condition is consistent with the franchise agreement ar:--� it is not a cost issue. He said it is good plannine: have the line installed. Mr. Ball stated that the problem is scheduling the cable personnel to be on site wher: the applicant is ready to backfill the trench. Fe said if the cost could be limited to 50 cents per .linear- foot then the applicant would be amenable to t:hF CONSENSUS: By consensus, the ::ouncil determined to leave Condition No. 44 as stated ii *-::e staff report. Condition No. 82 - Mr. Sall requested the condition be changed from: "To reduce debris from entering sidewalk and streets, the approved grading plan s:-1aII show a slough wall, approximately 18 inches hic_:h, with curb outlet drainage Minutes of the City Council Moorpark, California Page 5 August 14, 1996 to be constructed behind the back of the sidewalk where slopes exceeding 4 feE•t in height are adjacent to sidewalk. ......." To read as follows: "To reduce debris from entering sidewalk and streets, the approved grading plan shall show a slough wall or other engineering means, approximately 18 inches high, with curb outlet drainage to be constructed behind the back of the sidewalk where slopes exceeding 4 feet in height are adjacent to sidewalk........" Councilmember Hunter stated that the words "subject to the approval of the City Engineer" need to be added. Mr. Kueny stated that the words need to be added only in relation to the private s-reet. CONSENSUS: By consensus, the - ouncil determined to add the words "subject to the approval cf the City Engineer" after the words "or other engineering means" as added above, in relation to the drainage on the private street on the proposed site. Condition No. 89, item 1. - Mr. Ball requested that the condition he changed frcrr: " Corcrete drainage structures shali be tan colored concrete, as approved ty the Director of Community Development., and to the extent possible shall incorporate natural structure and -ar.dscape :o reduce their visibility." To read as follows: "Concrete drainage structures shall be regular concrete, as approved by the Director of Community Development, and to the extent possible shall incorporate natural sEructure and landscape tc: .-educe their visibility." CONSENSUS: By consensus, the council determined to approve the condition as amended above. Condition No. 104 - Mr. Ball requested clarification regarding the definitions of the plans involved with the master drainage and mas1:er flcod control improvements. Minutes of the City Council Moorpark, California Page 6 August 14, 1996 Mr. Kuen.y stated that staff will bring back revised language to clarify that the City is addressing a master drainage and hood control plan. Condition No. 105 - Mr. Hall said the applicant wants to exclude Lots B, C and 4 from any flood control improvements. Mr. Lovett stated that the condition should remain as written, but lot 4 can be excluded from the flood control improvemerits . CONSENSUS: By consensus, the Council determined to approve Condition 105 with the exclusion of Lot 4 from the flood control improvement requirements. Mr. Bali continued by requesting the following changes to the IPD coedi -ions: Condition. No. 28 - Landscaping and Signage at Entranceway Mr. Ball requested the condition be changed from: "The entranceway to the proposed project and driveways for Lots 1, 2 and 3 shall incorporate coordinated landscaping and signage. An orderly and consistent street tree planting program shall be required from the New Los Angeles Avenue lriderpass into the parking area for Lot 3 to guide visitors to the building entrance. The project entry shall receive enhanced landscape accent treatment:,." To read as follows: "The entranceway to the proposed project and driveways for Lots 1, 2 and 3 shall incorporate coordinated landscaping and signage. An orderly and consistent street tree planting program shall be required on the north side of Los Pnceles Avenue from the New Los Angeles Avenue underpass into th(, parking area for Lot 3 to guide visitors to ;.he b-.z -lding entrance. The project entry shall receive enhanced ]ardscape accent treatments." Mr. Kueny said staff c,in come back with language for this. He said staff needs to look on the north side to see what SDT is proposilc: versus what Caltrans has not Minutes of the City Council Moorpark, California Page -7 August 14, 1996 provided. He said the Council may be interested in this area being landscaped. Councilmember Perez said there are some collaborative projects where Caltrans has provided landscaping and he would like some information on those situations. Condition No. 42 - Relative to Utility Lines Mr. Ball said SDI wants to exclude the lines on Los Angeles Avenue from being undergrounded. CONSENSUS: By consensus, the Council determined that utility lines on Los Angeles Avenue will not be required to be undergrounded as indicated in !' ondition No. 42. Condition No. 161 which reads: "An alarm system shall be installed and shall be wired to all exterior doors and windows and to any roof vents or other roof openings whey -� access may be made." Mr. Ball requested that this item be deleted because SDI will have personnel on t'IEI site 24 hours a day everyday due to shift wcrk. Mr. Kueny said page -7 of the staff report dated August 9 addresses this by addir.g "or other security measures shall be implemented as approved by the Police Chief." Roseann Mikos, 14371 E. Cambridge, spoke representing the Environmental Coalition. She stated concerns over the potential ecological impact this project would have on the surrounding open spa -F-. Jim Stueck, 4767 Elderberry Avenue, spoke as President of the Chamber of Commerce and. stated that the Chamber Board of Direc`crs voted unani::iously to support this project. Gerald Gcldstein, 11932 cs Angeles Avenue, stated that the architect-,Ire of the project should be made more environmen.:ally friendly sc. tie project will blend better into --he surrcunding env ronment. Ed Ball addressed the Ccu.ncii and stated that on their investigation they found icience there had been a large Minutes of the City Council Moorpark, California Page 8 August 14, 1996 landslide on the property. He said they will be avoiding that portion of the site for development. He continued by stating that the liquefaction under a worst case scenario would occur in an area that will not affect permanent structures. Mayor Lawrason closed the public hearing. AT THIS POINT in the meeting, the Council declared a recess. The time was 9 :35 p.m. The Council reconvened at 9 :55 p.m. In response to Councilmember Wozniak, Ms. Traffenstedt said that on the Bollinger project it was stated in the conditions that it would be unlikely that reclaimed water would be available during construction. She said staff will verify that the language for this project is consistent with that of -he Bollinger project. MOTION: Councilmember Perez moved and Councilmember Brown seconded a motion to 1) direct staff to prepare the Final EIR (including Responses to Comments), Mitigation Monitoring Program, EIR Findings, ana Statement of Overriding Considerations; and 2) direct. staff to prepare a draft approval resolution and zone change ordinance. The motion carried by unanimous voice vo.E. 5. CLOSED SESSION: None was held. 6. ADJOURNMENT: MOTION: Councilmember Hunter moved and Councilmember Perez seconded a motion to adjourn the meeting.
