Moorpark, California May 7, 1997
A Special Meeting of the City Council of the City of Moorpark was
held on May 7, 1997, in the Council Chambers of said City located
at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Hunter called the meeting to order at 5:30 p.m.
2. ROLL CALL:
Present: Councilmembers Evans, Rodgers Teasley,
Wozniak, and Mayor Hunter.
Absent: Councilmember Perez
Staff Present: Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Cheryl Kane, City
Attorney; Nelson Miller, Director of Community
Development
4. CLOSED SESSION:
Mr. Hare indicated that under item 3.A. the Council would be
considering the claim of Lisa Barajas.
MOTION: Councilmember Wozniak moved and Councilmember Evans
seconded a motion to adjourn to Closed Session for a
discussion of all items listed:
A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to
Subdivision (b) to pursuant to: (Number of cases to be
discussed - 7)
B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation pursuant to Subdivision c of
Section 54956.9 of the Government Code: (Number of cases
to be discussed - 7)
C. PUBLIC EMPLOYEE PERFORMANCE EVALUATION (pursuant to
Government Code Section 54957)
Title: City Manager, Deputy City Manager, Director of
Community Development, Director of Community Services,
Public Works Director, City Clerk, Chief of Police, City
Engineer, and City Attorney

D. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION
(Subdivision (a) of Section 54956.9 of the Government
Code) Moorpark LeClub, et al vs. The City of Moorpark
E. CONFERENCE WITH LABOR NEGOTIATOR (pursuant to Government
Code Section 54957.6)
Agency Negotiator: Steven Kueny
Employee Organization: Service Employees International
Union Local 998, AFL-CIO, CLC
The motion carried by unanimous voice vote.
Present in Closed Session were all Councilmembers but
Councilmember Perez; Steven Kueny, City Manager; Richard Hare,
Deputy City Manager and Cheryl Kane, City Attorney. The time
was 5:32 p.m.
The Council reconvened into Open Session at 5:58 p.m.
MOTION: Councilmember Teasley moved and Councilmember Evans
seconded a motion to reject the claim of Lisa Barajas and to
so notify the claimant. The motion carried by unanimous voice
vote.
The Council reconvened into Closed Session at 6:00 p.m.
Present in Closed Session were all Councilmembers including
Councilmember Perez who joined the meeting at 6:00 p.m.;
Steven Kueny, City Manager; Richard Hare, Deputy City Manager;
and Cheryl Kane, City Attorney.
Councilmember Teasley left the meeting at 6:58 p.m.
The Council with the exception of Councilmember Teasley, who
left the meeting at 6:58, reconvened into Open Session at 7:02
p.m.
The City Attorney, Ms. Kane, reported that the City Council
directed her to initiate legal action in four cases and that
the names of the cases, defendants and other particulars will
be disclosed to any person upon inquiry once the lawsuit has
been formally commenced (unless to do so would jeopardize
service of process or existing settlement negotiations).

Mr. Kueny stated there was no other action to report and only
Items 3.A. and 3.B. were discussed.
