HomeMy WebLinkAboutMIN 1997 0312 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California March 12, 1997 A Special Meeting of the City Council of the City of Moorpark was held on March 12, 1997, in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Pro Tem Perez called the meeting to order at 7:11 p.m. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember Wozniak. 2. ROLL CALL: Present: Councilmembers Evans, Perez, Rodgers Teasley, and Wozniak. Absent: Mayor Hunter Staff Present: Steven Kueny, City Manager; Nelson Miller, Director of Community Development; and Dorothy Vandaveer, Deputy City Clerk. 3. PRESENTATIONS /ACTION /DISCUSSION: A. Consider Sphere of Influence Study. Staff Recommendation: Direct staff as deemed appropriate. Mr. Miller gave the staff report. He introduced Arnold Dowdy, Executive Director of Ventura County LAFCO, and Bruce Smith from the Ventura County Planning Division. Mr. Smith addressed the Council and indicated that the County has requested his division to look at agricultural zoning because there are some uses allowed in that zone that may be inappropriate. In response to Councilmember Evans, one of the questions asked by the Board of Supervisors is, "Where has the loss of agricultural land been due to annexation ?" In response to Councilmember Perez, Mr. Smith said the County Planning Division will be reporting back to the Board of Supervisors on how individual cities will Minutes of the City Council Moorpark, California Page 2 March 12, 1997 participate in the program developed as a result of the study provided to the Board of Supervisors. Councilmember Wozniak asked for a response on what control a city gains by increasing its sphere of influence. Mr. Smith indicated that a City may exert an added degree of influence in the County process by extending their sphere of influence. Mr. Smith said the City would gain a certain degree of stronger control in certain situations. In response to Council question, Mr. Smith said there are certain things the City can consider but the County has a regional responsibility to meet certain requirements set forth by the State. Councilmember Perez asked if the City's general plan addresses any areas outside the City's Sphere of Influence. In response, Mr. Nelson indicated that in the final adopted general plan there were no such areas except the Specific Plan 8 area. Councilmember Perez asked why the City boundary is equal to the City's Sphere of Influence. Mr. Smith said of the City entitlements, meet the needs much is still need. that upon incorporation a large percentage was vacant land with no land use so it was felt there was sufficient land to of the City. He said the question is how vacant and how much more does the City In response to Council question, Mr. Dowdy said the ultimate philosophy is that land within a City's sphere of influence will one day become a part of the City. He said this can send a message to land owners and developers. He said that there is only one way to have absolute control of an area and that is to annex it into the City. Mr. Kueny said without a plan for development, the City would be unlikely to get LAFCO to approve an increase in the Sphere of Influence. Minutes of the City Council Moorpark, California Page 3 Mr. Dowdy replied yes. March 12, 1997 Roseann Mikos, 14371 East Cambridge Street, addressed the Council. She asked the Council not to consider expanding the City's Sphere of Influence until City build out. She also voiced her opinion that Specific Plan 8 should not have been included in the general plan in 1992. Joe Ahearn, 484 East Los Angeles Avenue, addressed the Council. He said the greenbelt needs to be protected by whatever mechanism is available. Jerry Goldstein, 11932 Los Angeles Avenue, provided a brief history of the incorporation of the City. AT THIS POINT in the meeting, Councilmember Wozniak left the dais. The time was 8:10 p.m. He returned to the dais at 8:12 p.m. In response to Councilmember Teasley, Mr. Miller said a sphere defines areas intended for annexation or urbanization. Councilmember Teasley asked, "If the sphere is extended, who controls zoning ?" In response, Mr. Miller said the County will consult the City to comply with the general plan for possible future annexation. Mr. Kueny explained that to annex an area, the same steps need to be followed as in Specific Plan 8. He said the area needs to be a part of the general plan as a specific plan and then when the specific plan is approved, the City can approach LAFCO for annexation. Councilmember Teasley said that if one were to assume the City has no control over non sphere areas now, then if we increase our sphere of influence area, we have more control. In response, Mr. Smith said yes if it is an urban land use development other than open space or agricultural. Councilmember Evans asked the estimated cost to proceed with the sphere of influence study. Minutes of the City Council Moorpark, California Page 4 March 12, 1997 Mr. Kueny suggested that if the Council goes forward with a study it should be funded by property owners of the specific area being considered. He said a decision would need to be made on the area to be involved. He said the Council will also want to have a sense of where the community is on this issue. 4. ADJOURNMENT: MOTION: Council Member Perez moved and Council Member Evans seconded a motion to adjourn. The motion carried by voice vote, 4 to 0, Mayor Hunter absent for he vote.
