Moorpark, California May 28, 1997
An Adjourned Regular Meeting of the City Council of the City of
Moorpark was held on May 28, 1997, in the Council Chambers of said
City located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Hunter called the meeting to order at 6:15 p.m.
2. PLEDGE OF ALLEGIANCE:
Captain Lewis led the Pledge of Allegiance.
3. ROLL CALL:
Present: Councilmembers Evans, Perez, Rodgers Teasley,
Wozniak and Mayor Hunter.
9. PRESENTATIONS /ACTION /DISCUSSION:
C. Consider Urgency Ordinance to Impose a Moratorium on Rent
Increases in Mobile Home Parks. Staff Recommendation:
Adopt Ordinance No. and refer this matter to the
Budget and Finance Committee for further study.
Mr. Hare read the proposed changes to the ordinance made
by the City Attorney after her review. Mr. Hare
indicated that staff met with representatives of the
Villa Del Arroyo Mobile Home Park yesterday. He said
they are providing additional information requested by
staff.
In response to Council question, Ms. Kane confirmed that
because of statements made, the City was operating under
threat of litigation. She recommended that the City
Council take public testimony and then adjourn to closed
session for a discussion of the matter.
Frank Hilton, 15750 Los Angeles Avenue, Space 23,
addressed the Council regarding the settlement agreement.
He said that agreement was not a harmonious agreement.
He indicated there were many complaints regarding the
condition of the Villa Del Arroyo Mobile Home Park.
Glen Mondo, 200 E. Sand Point, Santa Ana, representing
the owner's of the Villa Del Arroyo Mobile Home Park
addressed the Council and said he disputed the urgent
nature of the ordinance and would like to avoid expensive
litigation.

Lois Barrus, 15750 Los Angeles Avenue, indicated the
support of the Villa Del Arroyo Homeowners' Association
for the ordinance creating a moratorium on rent
increases.
Richard Elias, 725 Brea Canyon, Walnut, addressed the
Council representing the owner of the Villa Del Arroyo
Mobile Home Park. He said they volunteered to work with
all parties to avoid litigation including supporting a 90
day voluntary moratorium on rent increases. He said
after that point they will go forward with rent increases
as allowed in the rent control ordinance. He said if
challenged, they would have to defend their rights. He
said they would notice prospective tenants that a rent
increase was being held in abeyance and that rent
adjustments at the time of resale would be put into
effect at the time, not retroactively. He indicated they
would proceed with liti ation if the outcome of the
committee discussions werp not palatable to them.

12. CLOSED SESSION:
The City Attorney, Ms. Kane, announced that the facts and
circumstances creating significant exposure to
litigation, which facts and circumstances are known to
potential plaintiffs, consists of an urgency ordinance
under consideration that would impose a moratorium on
mobile home rent increases. Ms. Kane indicated the
Council would be going into closed session.under item
12.A., Conference with Legal Counsel - Anticipated
Litigation Significant Exposure to Litigation Pursuant to
Subdivision (b) of Section 54956.9.
MOTION: Councilmember Evans moved and Councilmember Teasley
seconded a motion to adjourn to Closed Session for a
discussion of item 12.A. The motion carried by unanimous
voice vote. The time was 7:00 p.m.
Present in Closed Session were all Councilmembers; Steven
Kueny, City Manager; Richard Hare, Deputy City Manager;
Cheryl Kane, City Attorney; Nancy Burns, Management
Analyst.
The Council reconvened into open Session at 8:16 p.m.
Mr. Kueny stated there was no action to report and only
item 12.A. was discussed.
AT THIS POINT in the meeting, the Council returned to
consideration of Item 9.C.
MOTION: Councilmember Evans and Councilmember Teasely
seconded a motion to go forward with the adoption of the
ordinance. The motion carried by unanimous voice vote.
Ms. Kane read Ordinance No. 231 in its entirety.
MOTION: Councilmember Evans moved and Councilmember Teasely
seconded a motion to adopt Ordinance No. 231 as read. The
motion carried by unanimous voice vote.
Mayor Hunter announced that it was the intent of the
Council to provide the owner's of the Villa Del Arroyo
Mobile Home Park, the resident's and the public an
opportunity to participate in drafting the subsequent
ordinance. He indicated that an agenda item for June 4,
1997 would be scheduled for the City Council meeting to
discuss the appointment of a committee.
Mayor Hunter also stated that City staff would review
allegations made related to code violations in the Villa
del Arroyo Mobile Home Park.

11. ADJOURNMENT:
MOTION: Councilmember Evans moved and Councilmember Wozniak
seconded a motion to adjourn the meeting. The motion carried
by unanimous voice vote.
