Moorpark, California June 18,1997
A Special Meeting of the City Council of the City of Moorpark was
held on June 18, 1997, in the Council Chambers of said City located
at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Hunter called the meeting to order at 6:25 p.m.
2. ROLL CALL:
Present: Councilmembers Evans, Perez, Wozniak, and Mayor
Hunter.
Absent: Councilmember Teasley
Staff Present: Steven Kueny, City Manager; Ken Rozell,
Assistant City Attorney; Ken Gilbert, Director
of Public Works; Martin Cole, Management
Analyst; Richard Hare, Deputy City Manager;
Lillian Hare, City Clerk
3. PRESENTATIONS /ACTION /DISCUSSION:
A. Consider Procurement of a Skiploader with Scraper and
Adoption of Resolution 97 -1328 Increasing the Budget
Amount for Said Equipment. Staff Recommendation:
Authorize staff to purchase a Skip Loader /Scraper from
Valley Ford Tractor for $39,824.07; Adopt Resolution 97-
1328 increasing the funding (from Gas Tax Fund) for the
subject item from $32,500 to $39,830. (Roll Call Vote)
Mr. Gilbert gave the staff report.
MOTION: Councilmember Wozniak moved and Councilmember Perez
seconded a motion to adopt Resolution 97 -1328 authorizing staff
to purchase a skip loader /scraper from Valley Ford Tractor.
The motion carried by roll call vote 4 -0, Councilmember Teasley
absent for the vote.
B. Consider Resolution 97 -1329 Establishing the City's Gann
Appropriation Limit for Fiscal Year 1997/98. Staff
Recommendation: Adopt Resolution 97 -1329 establishing the
City's Gann Appropriation Limit for Fiscal Year 1997/1998.
(Roll Call Vote)
AT THIS POINT IN THE MEETING Councilmember Teasley joined the
meeting.

MOTION: Councilmember Perez moved and Councilmember Evans
seconded a motion to approve Resolution 97 -1329 establishing
the City's Gann Appropriation Limit for Fiscal Year 1997/1998.
The motion carried by unanimous roll call vote.
4. CLOSED SESSION:
MOTION: Mayor Hunter moved and Councilmember Wozniak seconded
a motion to adjourn to Closed Session for a discussion of all
items listed:
A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to Subdivision
(b) to pursuant to: (Number of cases to be discussed - 2)
B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation pursuant to Subdivision ( c ) of
Section 54956.9 of the Government Code: (Number of cases
to be discussed - 2)
C. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION
(Subdivision (a) of Section 54956.9 of the Government
--- Code) Moorpark LeClub, et al vs. The City of Moorpark
D. CONFERENCE WITH LABOR NEGOTIATOR (pursuant to Government
Code Section 54957.6)
Agency Negotiator: Steven Kueny
Employee Organization: Service Employees International
Union Local 998, AFL -CIO, CLC
The motion carried by unanimous voice vote.
Present in Closed Session were all Councilmembers, Steven
Kueny, City Manager; Richard Hare, Deputy City Manager;
Ken Rozell, Assistant City Attorney.
The Council reconvened into Open Session at 6:55 p.m.
Mr. Kueny stated there was no action to report and only
item 4.A. was discussed.
