Moorpark, California January 21, 1998
A Special Meeting of the City Council of the City of Moorpark was
held on January 21, 1998 in the Community Center of said City located
at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Hunter called the meeting to order at 6 :41 p.m.
2. ROLL CALL:
Present: Councilmembers Evans, Perez, Teasley, Wozniak
and Mayor Hunter.
Staff Present: Steven Kueny, City Manager; Cheryl Kane, City
Attorney; and John Nowak, Assistant City
Manager.
3. PUBLIC COMMENTS:
None.
4. PRESENTATIONS /ACTION /DISCUSSION:
A. Addendum No. 1 to Lease Agreement with Boething Treeland
Farms Inc. Staff Recommendation: Approve Addendum No. 1 to
the Lease Agreement between Boething Treeland Farms, Inc.
and the City of Moorpark.
MOTION: Councilmember Evans moved and Councilmember Wozniak
seconded a motion to approve staff recommendation. The motion
carried by unanimous voice vote.
5. CLOSED SESSION:
MOTION: Mayor Hunter moved and Councilmember Wozniak seconded
a motion to adjourn to closed session for a discussion of all
items listed:
A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to Subdivision
(b) of Section 54956.9 of the Government Code: (Number of
cases to be discussed - 4)
B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation pursuant to Subdivision (c) of
Section 54956.9 of the Government Code: (Number of cases to
be discussed - 4)
C. CONFERENCE WITH REAL PROPERTY NEGOTIATOR
Property: 23 W. Los Angeles Avenue
Negotiating Parties: The City Council of the City of
Moorpark and Sunbelt Properties
Under Negotiation: Price and terms of payment.

D. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION
Subdivision (a) of Section 54956.9 of the Government Code
The People of the State of California v. William Thomas
Tanner, Madalaine Irene Shenkel
The motion carried by unanimous voice vote.
Present in closed session were all Councilmembers; Steven
Kueny, City Manager; Cheryl Kane, City Attorney; and John
Nowak, Assistant City Manager.
Mr. Miller entered the closed session at 6 :56 p.m.
The Council reconvened into open session at 7 :03 p.m. Mr.
Kueny stated there was no action to report and that only
Items 5.C. and 5.D. were discussed.
6. ADJOURNMENT:
Mayor Hunter adjourned the meeting aV1:04 p.
