HomeMy WebLinkAboutMIN 1998 0204 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California February 4, 1998 A Special Meeting of the City Council of the City of Moorpark was held on February 4, 1998 in the Community Center Conference Room of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Hunter called the meeting to order at 6:36 p.m. 2. ROLL CALL: Present: Councilmembers Evans, Perez, Teasley, Wozniak, and Mayor Hunter. Staff Present: Steven Kueny, City Manager; Nancy Burns, Senior Management Analyst; Cheryl Kane, City Attorney; Nelson Miller, Director of Community Development; John Nowak, Assistant City Manager; and Deborah Traffenstedt, City Clerk. 3. PUBLIC COMMENT: None. 4. PRESENTATIONS /ACTION /DISCUSSION: A. Consider Appeal of County of Ventura Planning Commission Approval of Modification No. 1 to Conditional Use Permit No. CUP -4933, a Golf Course and Driving Range Project Proposed North of Tierra Rejada Road and East of State Route 23, Within the Moorpark Area of Interest. Staff Recommendation: Direct staff as deemed appropriate. CONSENSUS: The Council's decision was to take no action to appeal the decision. B. Consider General Plan Amendment No. 97 -1, to Amend the Land Use and Circulation Elements; Zone Change No. 97 -5, to Establish Zone Districts and Controlling Development Standards; and the Moorpark Downtown Specific Plan No. 95 -1. Staff Recommendation: Continue the hearing from February 5, 1998, to a specific date certain. Minutes of the City Council Moorpark, California Page 2 February 4, 1998 Mayor Hunter stated that his preference would be to hold three more meetings: The first meeting would be to discuss the Downtown Advisory Committee's recommendations and the implementation plan; the second meeting would be to discuss recommended zoning changes; and the third meeting would be for continued Council deliberations. CONSENSUS: The consensus of the Council was to continue the scheduled public hearing from February 5, 1998, to a special meeting on March 11, 1998, at 7:00 p.m., and any subsequent meeting date would be determined at the March 11 meeting. 5. CLOSED SESSION: The City Attorney, Ms. Kane, announced that the facts and circumstances creating significant exposure to litigation consist of a statement threatening litigation regarding amendments to the City's mobilehome rent stabilization ordinance that was made by Robert Coldren to Ms. Kane, City Attorney. Ms. Kane indicated that the Council would be going into closed session under item 5.A., Conference with Legal Counsel - Anticipated Litigation, Significant Exposure to Litigation, Pursuant to Subdivision (b) of Section 54956.9 of the Government Code. MOTION: Mayor Hunter moved and Councilmember Wozniak seconded a motion to adjourn to closed session for a discussion of Item 5.A., two cases, only. The motion carried by unanimous voice vote. The time was 6:45 p.m. A. Los Angeles Avenue Negotiating Parties: The City Council of the City of Moorpark and Sunbelt Properties Under Negotiation: Price and terms of payment. E. CONFERENCE WITH REAL PROPERTY NEGOTIATOR Property: A.P.N. 511 -0- 070 -310 Negotiating Parties: The City Council of the City of Moorpark and the Roe 1996 Trust F. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION Subdivision (a) of Section 54956.9 of the Government Code The People of the State of California v. William Thomas Tanner, Madalaine Irene Shenkel Present in closed session were all Councilmembers; Steven Kueny, City Manager; Nancy Burns, Senior Management Analyst; Cheryl Kane, City Attorney; Nelson Miller, Director of Community Development; and John Nowak, Assistant City Manager. The Council reconvened into open session at 7:18 p.m. Mr. Kueny stated there was no action to report and that only Item S.A. was considered. 6.
