Moorpark, California July 15, 1998
A Special Meeting of the City Council of the City of Moorpark was
held on July 15, 1998, in the Community Center Conference Room of
said City located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Hunter called the meeting to order at 6:24 p.m.
2. ROLL CALL:
Present: Councilmembers Evans, Perez, Teasley, Wozniak, and
Mayor Hunter.
Staff Present: Steven Kueny, City Manager; John Nowak,
Assistant City Manager; Cheryl Kane, City
Attorney; and Dirk Lovett, City Engineer.
3. PUBLIC COMMENT:
None.
4. PRESENTATION /ACTION /DISCUSSION:
A. Consider Request for the Release of Irrevocable Standby
Letters of Credit for Associated Grading, Erosion and
Interchange Improvements (Special Devices Incorporated,
Tract 5004). Staff Recommendation: 1) Accept the
Caltrans performance and payment bonds (Performance Bond
No. B2881823, Payment Bond no. B2881823) as a substitute
for the existing letters of credit, subject to the staffs
verification for the inclusion of the traffic signal
costs; 2) Upon staff acceptance for the Caltrans
performance and payment bonds, authorize the City Clerk
to release Irrevocable Standby Letter of Credit No.
3003007 (Interchange); 3) Upon staff acceptance of the
Caltrans performance and payment bonds, authorize the
City Clerk to release Irrevocable Standby Letter of
Credit No. 3003011 (Interchange); and 4) Authorize the
City Clerk to reduce to fifty percent, Irrevocable
Standby Letter of Credit No. 3003008 (grading & erosion),
subject to City receipt of rough grading certifications.

Mr. Jones, representing Special Devices Incorporated,
responded to questions raised by the Council.
MOTION: Councilmember Perez moved and Councilmember Wozniak
seconded a motion to approve staff recommendation with Item 1)
amended to add a condition that the traffic signal must be
finished prior to Certificate of Occupancy being issued. The
motion carried by unanimous voice vote.
5. CLOSED SESSION:
Mr. Kueny announced that only Item 5.0 needed to be discussed.
MOTION: Councilmember Wozniak moved and Councilmember Teasley
seconded a motion to adjourn to closed session for a
discussion of Item 5.C., only. The motion carried by
unanimous voice vote.

Present in closed session were all Councilmembers; Steven
Kueny, City Manager; John Nowak, Assistant City Manager and
Cheryl Kane, City Attorney.

The Council reconvened into open session at 6:57 P.M. The
City Attorney reported that by a unanimous vote, the City
Council directed the City Attorney to not seek appellate
relief in the case of the Libertarian Party of Ventura et al.
vs. Richard Dean as Registrar of Voters of Ventura County et
al., which challenged the sufficiency of the SOAR petition.
