HomeMy WebLinkAboutMIN 1998 0806 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California August 6, 1998 A Special Meeting of the City Council of the City of Moorpark was held on August 6, 1998, in the Community Center Conference Room of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Councilmember Teasley called the meeting to order at 4:05 p.m. 2. PLEDGE OF ALLEGIANCE: 3. ROLL CALL: Present: Councilmembers Perez, Teasley, and Wozniak. Absent: Councilmember Evans and Mayor Hunter Staff Present: John Nowak, Assistant City Manager; and Lisa Pope, Deputy City Clerk. 4. PUBLIC COMMENT: None. 5. PRESENTATION /ACTION /DISCUSSION: A. Consider the Placement of Measure H (a Special Tax for Legal Defense Cost) on the November 3, 1998 Election Ballot. Staff Recommendation: Direct staff as deemed appropriate. Councilmember Teasley indicated that the meeting had been called to discuss Measure H and whether it should be left on the ballot. She discussed the language of the measure. Councilmember Wozniak stated there was still potential for litigation. He indicated that he wanted to allow the voters to determine if they were willing to pay for the cost of litigation. He stated there was no harm in leaving the measure on the ballot. Minutes of the City Council Moorpark, California Page 2 August 6, 1998 Councilmember Perez stated the measure should be removed from the ballot because the City Attorney had reviewed the language of Measure F which reduced the likelihood of litigation. Councilmember Teasley stated Measure H would be precedent setting and therefore it should be removed from the ballot. Councilmember Wozniak indicated his support for leaving Measure H on the ballot. MOTION: Councilmember Perez moved and Councilmember Wozniak seconded a motion to adopt Resolution No. 98 -1497 to remove Measure H from the November 3, 1998 ballot. The motion carried 2 -1 ( Councilmember Wozniak dissenting, Councilmember Evans and Mayor Hunter absent). 6. CLOSED SESSION: None was held. 7. ADJOURNMENT MOTION: Councilmember Perez moved and Councilmember Teasley seconded a motion to adjourn. The ,/ption carried unanimously.
