Moorpark, California July 1, 1998
A Special Meeting of the City Council of the City of Moorpark was
held on July 1, 1998, in the Community Center Conference Room of
said City located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Hunter called the meeting to order at 6 :10 p.m.
2. ROLL CALL:
Present: Councilmembers Evans, Perez, Teasley, Wozniak,
and Mayor Hunter.
Staff Present: Steven Kueny, City Manager; John Nowak,
Assistant City Manager; Cheryl Kane, City
Attorney; Nelson Miller, Director of Community
Development; and Lisa Pope, Deputy City Clerk
5. CLOSED SESSION:
Mr. Kueny announced that Items 5.C., 5.D., 5.E., and 5.F.
would be discussed.
MOTION: Mayor Hunter moved and Councilmember Wozniak seconded
a motion to adjourn to closed session for a discussion of
Items S.C., 5.D., 5.E., and S.F. The motion carried by
unanimous voice vote. The time was 6:14 p.m.

Registrar of Voters of Ventura County et al.
E. PUBLIC EMPLOYEE PERFORMANCE EVALUATION
Title: Administrative Services Director, City Attorney,
City Clerk, City Manager, City Engineer, Chief of Police,
Director of Community Development, Director of Community
Services, Public Works Director
F. CONFERENCE WITH LABOR NEGOTIATOR
Unrepresented employees: Assistant City Manager, City
Clerk, City Engineer, Director of Community Development,
Director of Community Services, Public Works Director,
Administrative Services Manager, Planning Manager,
Principal Planner, Senior Management Analyst
Present in closed session were all Councilmembers; Steven
Kueny, City Manager; John Nowak, Assistant City Manager;
Cheryl Kane, City Attorney; and Nelson Miller, Director of
Community Development.
The Council reconvened into open session at 6:50 p.m. Mr.
Kueny stated there was no action to report and that Items
5.A., S.C., 5.D., 5.E., and 5.F. were considered.
3. PUBLIC COMMENT:
Richard Francis, 711 South `A', Oxnard, discussed the
litigation between the Libertarian Party and Richard Dean as
Registrar of Voters for Ventura County. He indicated the
plaintiff's were willing to entertain a stipulation to end
litigation if the Council were to place the measure on the
ballot and effectively withdraw the citizens petition.
Roseann Mikos, 14371 E. Cambridge Street, stated it was in
City's best interest to settle the lawsuit. She recommended
the Council place the measure on the ballot by legislative
action.
Ms. Kane announced that she had received the stipulation and
it did not include the City placing the initiative on the
ballot. She indicated that the Council was not in favor of
the stipulation.

4. PRESENTATION /ACTION /DISCUSSION:
A. Consider Resolution No. 98- Calling and Giving Notice
of the Holding of the General Municipal Election and
Requesting Consolidation with the Statewide General
Election and Rescinding Resolution No. 98 -1474,
Resolution No. 98- Providing for the Filing of
Rebuttal Arguments for City Measures Submitted at
Municipal Elections and Resolution No. 98- Setting
Priorities for Filing a Written Argument Regarding City
Measures and Directing the City Attorney to Prepare an
Impartial Analysis. Staff Recommendation: 1) Adopt
Resolution No. 98 -1480 Calling and Giving Notice of the
Holding of the General Municipal Election and Requesting
Consolidation with the Statewide General Election and
rescinding Resolution No. 98 -1474; 2) Adopt Resolution
No. 98 -1481 Providing for the Filing of Rebuttal
Arguments for City Measures Submitted at Municipal
Elections; and 3) Resolution No. 98 -1482 Setting
Priorities for Filing a Written Argument Regarding City
Measures and Directing the City Attorney to Prepare an
Impartial Analysis.
Roseann Mikos, 14371 E. Cambridge Street, urged Council
to make certain that the proponents of SOAR were given
the opportunity to provide arguments in favor of SOAR.
Mr. Kueny stated the City Clerk would determine which
arguments would be used per the Elections Code.
MOTION: Councilmember Wozniak moved and Councilmember Perez
seconded a motion to adopt Resolution No. 98 -1480 calling and
giving notice of the holding of the General Municipal Election
and requesting consolidation with the Statewide General
Election and rescinding Resolution No. 98 -1474. The motion
carried by unanimous voice vote.
MOTION: Councilmember Perez moved and Councilmember Wozniak
seconded a motion to adopt Resolution No. 98 -1481 providing
for the filing of rebuttal arguments for City measures
submitted at Municipal Elections. The motion carried by
unanimous voice vote.
MOTION: Councilmember Evans moved and Councilmember Perez
seconded a motion to adopt Resolution No. 98 -1482 Setting
Priorities for Filing a Written Argument Regarding City
Measures and Directing the City Attorney to Prepare an

Impartial Analysis as amended. The motion carried by
unanimous voice vote.
MOTION: Mayor Hunter moved and Councilmember Evans seconded
a motion to appoint an ad hoc committee of Councilmembers
Evans and Teasley to prepare arguments for all four measures.
The motion carried by unanimous voice vote.
6. ADJOURNMENT:
MOTION: Councilmember Evans moved and Councilmember Teasley
seconded a motion to adjourn. The time was 7:13 p.m. The
