HomeMy WebLinkAboutMIN 1999 0317 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California March 17, 1999 A Special Meeting of the City Council of the City of Moorpark was held on March 17, 1999, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Hunter called the meeting to order at 5:57 p.m. 2. ROLL CALL: Present: Councilmembers Evans, Harper, Rodgers, Wozniak, and Mayor Hunter. Staff Present: Steven Kueny, City Manager; Cheryl Kane, City Attorney; and John Nowak, Assistant City Manager. 3. PUBLIC COMMENT: None. 4. PRESENTATION /ACTION /DISCUSSION: A. Consider Report on Condition Compliance for Marketplace Properties Commercial Center, Located Northwest of the Intersection of Spring Road and Tierra Rejada Road. Staff Recommendation: Direct staff as deemed appropriate. CONSENSUS: By consensus, the Council determined to table Item 4.A. until just prior to the regular City Council meeting call to order, to allow discussion to be broadcast over the City's government channel. B. Consider Canceling City Council Regular Meeting of April 7, 1999. Staff Recommendation: Direct staff to schedule a Council recess for April 7, 1999, and post a notice of meeting cancellation. CONSENSUS: By consensus, the Council approved canceling the April 7, 1999 regular meeting, and directed staff to post a notice of meeting cancellation. Minutes of the City Council Moorpark, California Page 2 March 17, 1999 C. Consider a Deferral of the Tax Equity Fiscal Responsibility Act Hearing. Staff Recommendation: If the April 7 regular meeting is canceled, staff recommends the City Council establish April 21, 1999 regular City Council meeting as the date for the Tax Equity Fiscal Responsibility Act hearing for Archstone Communities. MOTION: Mayor Hunter moved and Councilmember Wozniak seconded a motion to approve establishing the April 21, 1999 regular City Council meeting as the date for the Tax Equity Fiscal Responsibility Act hearing for Archstone Communities. The motion carried by unanimous voice vote. S. CLOSED SESSION: Mr. Kueny announced that the City Council would be going into closed session for discussion of one case under Item S.A. and discussion of Item 5.H. on the agenda. The City Attorney announced that the facts and circumstances creating significant exposure to litigation consist of a written communication threatening litigation received from William E. Paterson, Esquire. MOTION: Councilmember Harper moved and Councilmember Wozniak seconded a motion to adjourn to closed session for a discussion of one case under Item S.A. and Item S.H. The motion carried by unanimous voice vote. The time was 6:05 p.m. A. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Subdivision (a) of Section 54956.9) City of Moorpark vs. Bowen Present in closed session were all Councilmembers; Steven Kueny, City Manager; Cheryl Kane, City Attorney; and John Nowak, Assistant City Manager. The Council reconvened into open session at 7 :01 p.m. Mr. Kueny stated there was no action to report and that only Items S.C. and S.H. were considered. AT THIS POINT in the meeting, the Council took a recess. The time was 7 :02 p.m. The Council reconvened at 7:18 p.m. Mayor Hunter announced that the Council would return to its discussion of Item 4.A. Minutes of the City Council Moorpark, California Page 4 March 17, 1999 4. PRESENTATION /ACTION /DISCUSSION: A. Consider Report on Condition Compliance for Marketplace Properties Commercial Center, Located Northwest of the Intersection of Spring Road and Tierra Rejada Road. Staff Recommendation: Direct staff as deemed appropriate. Mr. Loftus gave the staff report. In response to Mayor Hunter, Mr. Loftus stated that staff would be viewing the sample corrected lights, that would have the opaque glass installed, and that a decision would then need to be made regarding whether those same improvements should be implemented for the other light fixtures in the center. In response to Councilmember Harper, Mr. Loftus stated that he would be on -site to view the corrected lights at approximately 7 p.m. on March 18. CONSENSUS: By consensus, the Council determined to receive and file the report. 6. ADJOURNMENT: Mayor Hunter adjourned the meeting at 7:32 p.m. ATTEST: Deborah S.
