HomeMy WebLinkAboutMIN 1999 0929 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California September 29, 1999 A Special Meeting of the City Council of the City of Moorpark was held on September 29, 1999, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Hunter called the meeting to order at 8:05 p.m. Councilmember Wozniak led the Pledge of Allegiance. 2. ROLL CALL: Present: Councilmembers Evans, Harper, Rodgers, Wozniak, and Mayor Hunter Staff Present: Steven Kueny, City Manager; Wayne Loftus, Acting Director of Community Development; and Deborah Traffenstedt, City Clerk. 3. PUBLIC COMMENT: Gerald Goldstein, 11932 Los Angeles Avenue, suggested that the eastern most parking spaces at the City Community Center be converted into a bus driveway with a curb -cut onto Moorpark Avenue. He also requested a waiver of the City's requirement for closed -toed shoes for certain senior activities. Luis Rosales, 4494 Vista Meadow Court, expressed concern with Performance Nursery in the Mountain Meadows area. He stated that the Nursery is using an illegally graded road for access. He further stated that the truck traffic on that road was a safety concern and that the noise was impacting the peace of their neighborhood. In response to Mayor Hunter, Mr. Kueny stated that staff was working on an easement or license agreement to recognize use of the private road by Performance Nursery. He further stated that consideration of the license or agreement would be on the Council's October 20, 1999 meeting agenda. Consider Zoning Ordinance Amendments: ZOA 99 -05, Lighting Standards, and ZOA 99 -06, Intermediate Care Facilities in RO (Single Family Estate) Zone. (Continued from September 15, 1999 with Public Hearing Closed.) Staff Recommendations: 1) Determine that the proposed Lighting Regulations qualify for a Negative Declaration and that the Code Amendment related to care facilities is exempt under provision of CEQA; 2) Introduce Ordinance No. 264 for first reading, adding or amending provisions of Table 17.20.050 amending the RO Zone in the Municipal Code as described in Attachment 1; and 3) Introduce Ordinance No. for first reading, adding Chapter 17.30, "Lighting Standards" to the Municipal Code as described in Attachment 2. Mr. Loftus gave the staff report. He requested continuance of this item to the October 6, 1999 Council meeting. In response to Mayor Hunter, Mr. Loftus stated that a decision on the Negative Declaration could be postponed. In response to Councilmember Rodgers, Mr. Loftus stated that the proposed Zoning Code amendment for intermediary care facilities would not change the requirement for a conditional use permit. Ms. Traffenstedt read the title for Ordinance No. 264, amending Title 17, Zoning, of the Municipal Code by amending Table 17.20.050 to add intermediate care facilities for seven or more persons as a conditional use within the RO (Single- Family Estate) Zone. MOTION: Councilmember Harper moved and Councilmember Rodgers seconded a motion to determine the Zoning amendment to be exempt from CEQA and to waive further reading of Ordinance No. 264. The motion carried by unanimous voice vote. MOTION: Councilmember Harper moved and Councilmember Rodgers seconded a motion to declare Ordinance No. 264 introduced for first reading. The motion carried by unanimous voice vote. Minutes of the City Council Moorpark, California Page 3 September 29, 1999 CONSENSUS: By consensus, the City Council determined to continue introduction of an ordinance for first reading that added Chapter 17.30 "Lighting Standards" to the Municipal Code, to the Council's October 6, 1999 meeting. B. Consider Zone Ordinance Amendments: ZOA 99 -07, to Permit Limited Retail Commercial Uses within the CO (Commercial Office) Zone within the Downtown Specific Plan Area; and ZOA 99 -08, Creating a Shortened Procedure for Conversion of Uses from Residential to Commercial or Office Use within the Downtown Specific Plan Area. (Continued from September 15, 1999 with Public Hearing Closed.) Staff Recommendations: 1) Determine that the Code Amendments related to limited retail commercial uses within the CO Zone, and to approve that the approval of applications for the conversion of uses from residential to commercial or office uses within the Downtown Specific Plan area having a base zoning of CO (Commercial Office) are exempt under provision of CEQA; and 2) Introduce Ordinance No. 265 for first reading to amend Table 17.20.060 and to revise Chapter 17.44 of the Municipal Code as described in Attachment 1. Mr. Loftus gave the staff report. Ms. Traffenstedt read the title for Ordinance No. 265, Adopting Amendments to Title 17, Zoning, of the Municipal Code of the City of Moorpark, by Amending Chapter 17.44 "Entitlement- Process and Procedure" to Incorporate Language Related to Downtown Specific Plan Discretionary Permits, Defining Notice Requirements for Such Permits, and Clarifying Appeal Requirements; and, Amending Table 17.20.060 to Permit Limited Retail Commercial Uses within the C -O (Commercial Office) Zone Only Within the Downtown Specific Plan; and, Amending Section 17.16.080.B. Revising the Purposes of the Downtown Specific Plan Overlay Zone. MOTION: Councilmember Harper moved and Councilmember Rodgers seconded a motion to determine the Zoning amendments to be exempt from CEQA and to waive further reading of Ordinance No. 265. The motion carried by unanimous voice vote. The motion carried by unanimous voice vote. C. Consider City's Position on AB -1363. Staff Recommendation: Direct staff as deemed appropriate. Councilmember Evans gave the report. He expressed concern with provisions of the proposed legislation and suggested that the Council send a letter to the Governor requesting a veto. He also requested that the letter be sent by both facsimile and mail. MOTION: Councilmember Evans moved and Councilmember Wozniak seconded a motion to authorize the Mayor to sign a letter to the Governor requesting a veto of AB -1363, and directed staff to send the letter by both facsimile and mail. The motion carried by unanimous voice vote. 6. ADJOURNMENT: MOTION: Councilmember Harper moved and Councilmember Rodgers seconded a motion to adjourn. The motion carried by unanimous voice vote.
