HomeMy WebLinkAboutMIN 1989 1129 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California November 29, 1989 The Special Meeting of the City Council of the City of Moorpark, California was held on November 29, 1989, in the Council Chambers of City Hall of said City, located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: The Meeting was called to order at 6:37 p.m. by Mayor Paul Lawrason. 2. ROLL CALL: Present: Councilmembers Brown Harper, Montgomery, Perez, and Mayor Lawrason Steven Kueny, City Manager; Richard Hare, Deputy City Manager; and Cheryl Kane, City Attorney. 3. CLOSED SESSION: MOTION: Councilmember Montgomery moved and Councilmember Brown seconded a motion to go into Closed Session to discuss the following items: A. Potential litigation pursuant to Government Code Section 54956.9(b)(1). B. Potential litigation pursuant to Government Code Section 54956.9(c). C. Litigation concerning City of Moorpark vs. Moorpark Unified School District. D. Litigation concerning Moorpark Unified School District vs. City of Moorpark. E. Negotiation for real property at 289 Casey Road (former high school site - Moorpark Unified School District) pursuant to Government Code Section 54945.8. F. Litigation concerning Villa Del Arroyo vs. City of Moorpark. G. Litigation concerning Ventura County Community College District vs. City of Moorpark. H. Litigation concerning the County of Ventura vs. City of Moorpark. I. Litigation concerning Rosenkrantz vs. City of Moorpark. The Council reconvened into Open Session at 7:02 p.m. Mr. Kueny stated that only items 3.A. and 3.F. had been discussed during Closed Session. Ms. Kane stated that negotiations had been completed with Embassy regarding their request for modification of their use permit and that the President of Embassy had signed an agreement, which could be placed on the December 6 City Council meeting to authorize the Mayor to execute the agreement on behalf of the City. Mr. Kueny stated it was the intention of the Council to return to Closed Session at the conclusion of the Mobile Home Rent Review Hearing. AT THIS POINT in the meeting Mayor Lawrason declared a recess. The meeting reconvened at 7:14 p.m. Present were all Councilmembers and Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Pat Richards, Director of Community Development; Lt. Rodriguez, Sheriff's Department; and Lillian Kellerman, City Clerk. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember Montgomery. 5. PUBLIC COMMENT: Connie Lawrason, 4291 Ambermeadow, addressed the Council regarding the dangerous truck traffic on Highway 118. 6. HEARING ON DISCRETIONARY SPACE RENT APPLICATION: B. Consider Proposed Rent Increase for Villa del Arroyo Mobile Home Park Mr. Kueny gave the staff report concerning the application for a discretionary rent increase received by the City on September 15, 1989. He indicated that with the exception of 3 spaces, the percent of increase ranged from 8 - 25 percent. He said that since 1983, the Villa del Arroyo Park has had an increase each year averaging less than the Consumer Price Index. He said the Villa del Arroyo manager, attorney and appraiser were not present and that the staff recommendation was to open the public hearing, take public testimony, and continue the hearing to a later date. Mayor Lawrason opened the hearing. Walt Heminuk, 15750 Los Angeles Avenue #77, said that the proposed rent increase was too high. He said it would be a 27% increase in his rent. Angelo Gizis, 15750 Los Angeles Avenue #95, said his mobile home cost him $570 a month plus space rent; he said it wasn't low income housing. He said he felt the decision had already been made by the Council in favor of the owner of the Villa del Arroyo because of the lawsuit between the mobile home park owner and the City. Frank Hilton, 15750 Los Angeles Avenue #23, said that the mobile home park could charge an increased rent whenever a mobile home changed ownership. He said the park incurs no loss of rent and doesn't have to paint or make repairs. He said Villa del Arroyo compared unfavorably to other mobile home parks in Ventura County. Cheryl Fay, 15750 Los Angeles Avenue #17, said that a rent increase would be gouging. She said if the owner of the mobile home park thinks he is losing so much money, why does he own so many mobile home parks. Blair Ball, 15750 Los Angeles Avenue #55, said he had lived in the mobile home park for 5 years and had seen only a few improvements. He said raising the rents without major improvements is not fair. He said the water meter charge was a rent increase in itself. Ginny Beebe, 15750 Los Angeles Avenue #229, said the residents of the Villa del Arroyo were getting less for more money. She said the mobile home park started out as affordable housing and asked the Council to please keep it that way. Terry Crume, 14801 Marquette, a Realtor with Better Homes and Gardens, said that the Santa Barbara lawsuit on mobile home rent control had not yet been settled and that the case should not be used as a precedence yet. She said the land the mobile home park is on was purchased in 1977 for $450,000 and was now worth $4,960,000. Les Champion, 15750 Los Angeles #73, said only one year out of eleven did the mobile home park not get an increase. He said he didn't use any gas but still had to pay a gas meter charge. He said increased profit should only be allowed the owner of the park within the guidelines previously set by the Council. Dennis Reid, 15750 Los Angeles Avenue #93, said that when the park opened space rent was based on the distance from the club house. He said now the owner wants all the rents to be the same. He said the negatives about the park were noise and Minutes of the City Council Moorpark, California Page 4 November 29, 1989 pollution and they were not mentioned in the application for rent. He said the current rents were fair value and should only increase under the existing rent control ordinance. Ernest Lemos, 15750 Los Angeles Avenue 1203, said he felt that the matter had already been settled. He said the average American was being priced right out of the housing market. He said his mobile home was his future. Mayor Lawrason asked if there was anyone else who wished to speak. There was no response from the audience. MOTION: Councilmember Montgomery moved and Councilmember Brown seconded a motion to leave the hearing open and continue it to December 13, 1989. The voice vote was unanimous. AT THE HOUR OF 9:04 P.M. the Council reconvened into Closed Session. Present in Closed Session were all Councilmembers; Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Pat Richards, Director of Community Development; Lt. Rodriguez, Sheriff's Department; and Cheryl Kane, City Attorney. Lt. Rodriguez left the Closed Session at 9:16 p.m. Mr. Richards left the Closed Session at 9:37 p.m. The Council reconvened into Open Session at 11:09 p.m. Ms. Kane announced that only items 3.A., 3.B., 3.E., 3.F., and 3.H. had been discussed and there was no action to report out of Closed Session.
