HomeMy WebLinkAboutORD 301 2004 0505ORDINANCE NO. 301 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 2.12.120 OF CHAPTER 2.12 (CITY MANAGER) OF THE MUNICIPAL CODE, PROVIDING AUTHORITY TO SIGN WRITTEN CONTRACTS WHEREAS, Government Code Section 40602 states that the legislative body may provide by ordinance that written contracts made or entered into by the City may be signed by an officer other than the mayor; and WHEREAS, it is administratively expeditious that the City Manager and the City Manager's designee be authorized to sign certain contracts; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 2.12.120 of the Moorpark Municipal Code is hereby amended in its entirety to read as follows: Section 2.12.120 Authority to sign written contracts. A) The city manager may execute on behalf of the city any contract which has received prior approval of the city council. B) The city manager shall be authorized without prior approval to execute contracts up to a maximum of fifty thousand dollars ($50,000) for which a budget appropriation has already been approved by the city council. C) The city manager's designee shall be authorized without prior approval to execute contracts up to a maximum of ten thousand dollars ($10,000) for which a budget appropriation has already been approved by the city council. D) A list of contracts executed by the city manager and /or his designees pursuant to subsections B and C of this section shall be presented to the council for their information in a subsequent monthly report. If any section, subsection, sentence, clause, phrase, part or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 3. This Ordinance shall become effective thirty (30) days after its passage and adoption.
