HomeMy WebLinkAboutRES CC 1983 25 1983 0803RESOLUTION NO. 83 -25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK APPROVING RESIDENTIAL PLANNED DEVELOPMENT PERMIT 940 (U.S. CONDOMINIUM) WHEREAS, at a duly noticed public hearing on July 20, 1983, Residential Planned Development Permit No. 940 was considered by the City Council; WHEREAS, PD -940 (U.S. Condominium) was approved by the County of Ventura; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark hereby ratifies and approves Residential Planned Development Per- mit 940 (U.S. Condominium) as conditioned by the County of Ventura, and subject to the following additional conditions: A. That prior to occupancy, the developer shall install street trees, grass and an irrigation system in the parkway on the southerly side of Campus Park Drive between the curb and the side- walk adjacent to the subject permit. The maintenance of this area shall be the responsibility of the Homeowners' Association. B. That prior to the issuance of a zone clearance, the developer shall enter into an agreement with the developer of PD -903 (Griffin Homes) for the reimbursement of one -half of the cost of providing stamped concrete improvements within the median divider in Campus Park in front of the subject permit. C. That prior to an occupancy the developer shall agree to participate in an assessment district formed at least within the College Park area for the purpose of maintaining improvements within the rights -of -way of Campus Park Drive and /or Princeton Avenue, provided that the assessment district includes equal participation of all costs by all property owners within the CoLlege Park area. SECTION 2. The City Council of the City of Moorpark hereby ratifies the certification by the County of Ventura of the environmental document for PD -940, and further finds that the addition of the conditions described in Section 1 herein do not necessitate the preparation of a subsequent environmental document because the conditions will not result in new significant environ- mental impacts. -1- SECTION 3. The Residential Planned Development Permit approved by the County of Ventura reflects the County governmental structure and contains references to officials, official titles, commissions, and other designations which are not a part of the structure of this City's government. Whenever the Permit approved by the County refers to an officer, office, official title, or other designation, the reference shall be interpreted to mean that office, title, or designation in the governmental structure of the City, or if there is none, any official or titleholder in the City who has been specifically directed by the City Council or the City Manager to perform the fundtions referred to as the duties imposed.
