A RESOLU'T'ION OF THE CITY COUNCIL OF' THE CITY OF
MOORPARK APPROVING THE ENGINEER'S REPORT FILED
PURSUANT TO SECTION 22586 OF THE CALIFORNIA
STREETS AND HIGHWAYS CODE, DECLARING ITS INTEN-
TION TO ORDER THE FORMATION OF THE "CITY OF
MOORPARK LANDSCAPING AND LIGHTING MAINTENANCE
DISTRICT NO. AD 83 -1" IN ACCORDANCE WITH SEC-
TION 22587 OF SAID CODE, AND ORDERING THE
FORMATION OF SAID DISTRICT IN ACCORDANCE WITH
SECTION 22594 OF SAID CODE.
A. WHEREAS, Griffin Homes - Moorpark, a general. part-
nership (hereinafter "Griffin "), owns that certain real property
located in the City of Moorpark, County of Ventura, State of
California, more particularly described as follows:
Lots 1 through 107, inclusive, of Tract
3841 -1 as shown on a Map recorded on
March 1, 1983, in Book 95, Pages 15 to
20, of the Miscellaneous Records in the
Office of the County Recorder, and Lots
108 through 191, inclusive, of Tract
3841 -2 as shown on a Map recorded on
March 1, 1983, in Book 95, Pages 21 to
25, of the Miscellaneous Records in the
Office of the County Recorder (herein-
after the "Property ");
B. WHEREAS, Griffin intends to develop the Property
as a multi -phase residential planned unit development (herein-
after the "Project ");
C. WHEREAS, as a condition for approval. of the recor-
dation of the aforesaid final tract maps, the County of Ventura,
as the predecessor, of the City of Moorpark, required that that
certain street median along 'Tierra Rejada Avenue, that those
certain tree wells along Los Angeles and 'Tierra Rejada Avenues
and that certain open -space park -site adjacent to the Property,
as more particularly shown on Exhibit "A" attached hereto (herein-
after the "Improvemerit Areas "), be- improved with landscaping and
related improvements to a stand�rrd acceptable to the County of
{ Ventura, that Griffin maintair. t.ne lrr,pr,ovement Areas for a period
of twelve (12) months after the landscaping and related improve-
ments have been installed, and that. a means for assuring the
continued maintenance, operation and servicing of the Improvement
Areas, and all improvements thereto, be established to the reason-
able satisfaction of the County of Ventura;
D. WHEREAS, Moorpark became an incorporated City on
July 1, 1983, and has succeeded to the interest of the County of
Ventura;
E. WHEREAS, in response to the aforesaid conditions
of approval of the recordation of the final tract maps, Griffin
has executed and filed with the City Clerk a Petition wherein
Griffin has, among other things, (i) requested the formation of a
landscape maintenance assessment district; (ii) waived all statu-
tory hearings of objections and protests by interested property
owners to the formation of said district; and (iii) proposed to
improve the Improvement Areas and maintain same for a period of
twelve (12) months;
F. WHEREAS, this Council has previously adopted Reso-
lution No. &3-43entitled "A Resolution of the City Council of the
City of Moorpark to Initiate Proceedings for the Formation of the
'City of Moorpark Landscaping and lighting Maintenance District
No. AD 83 -1,' An Assessment District to be Established Pursuant
to the 'Landscaping and Lighting Art, of 1972,11' to provide for
the continued maintenance, operation and servicing of the Improve-
ment Areas, and all improvements thereto, and for the payment of
all costs and expenses incurred for such maintenance, operation
and servicing;
G. WHEREAS, pursuant to the aforesaid Resolution No.
8_1=a3 an Engineer's Report has been prepared in accordance with
Article 4 (Sections 22565 thr,ouclh 22')74, inclusive) of Chapter 1
of Part 2 of Division 15 of the St.r,eet.s and Highways Code of the
State of California, and has b(.?e r) f i I ced with the City Clerk pursu-
ant to Section 22586 of said Cade,. A ropy of the Report is attach-
ed hereto as Exhibit "f3" ( here i rr,af t er ref erred to as the "Engi-

neer's deport ");
H. WHEREAS, it has been determined by the City Coun-
cil of the City of Moorpark that the public interest, convenience
and necessity require the maintenance of the Improvement Areas by
a landscaping and lighting maintenance district; and
I. WHEREAS, pursuant to Sections 22587 and 22594 of
the aforesaid Code, this Council desires to adopt this Resolution
approving the Engineer's Report, declaring its intention to form
and ordering the formation of the City of Moorpark Landscaping
and Lighting Maintenance District: No. AD 83 -1, as more particular-
ly described hereinbelow.
NOW, THEREFORE, in furtherance of the foregoing reci-
tals, the City Council. of the City of Moorpark does hereby find,
determine, resolve and order as follows:
1. Approval of Engineer's Report. This Council hereby
approves the Engineer's Report as filed with the City Clerk.
2. Declaration of Intention to Form a Maintenance
District and to Levy and Collect Assessments. This Council hereby
declares its intention to form the "City of Moorpark Landscaping
and Lighting Maintenance District No. AD 83 -1" (hereinafter refer-
red to as "District No. AD 83 -1 "), pursuant to and in accordance
with the provisions of the "Landscaping and Lighting Act of
1972," as set forth in Part 2 of Division 15 (Sections 22500 et
seq.) of said Code, to provide for, the continued maintenance,
operation and servicing of the Improvement Areas, and all improve-
ments thereto. Further, this Council hereby declares its inten-
tion to levy and collect assessments to pay all costs and ex-
penses incurred pursuant: to and in accordance with said Act. The
proposed assessments are more particularly described in the Engi-
neer's Report.
3. Description of Improvements. The improvements to
the Improvement Areas shell include shrubbery, trees, ground
cover, automatic irrigation equ]pment , separate water, meter and
other related improvements (here.iri,ifter referred to as the "Tm-
provements "). The Improvements are iiiort- particularly described in
the Engineer's Report. The Improvements are to be located within
public streets, rights -of -way and park -site as shown in the Engi-
neer's Report.
4. Description of Landscape Maintenance District.
District No. AD 83 -1 shall consist of Lots 1 through 107, inclu-
sive, of Tract 3841 -1 as shown on a Map recorded in Book 95,
Pages 15 to 20, inclusive, of Miscellaneous Records in the Office
of the County Recorder for Ventura County, California, and Lots
108 through 191, inclusive, of Tract 3841 -2 as shown on a Map
recorded in Book 95, Pages 21 to 25, inclusive, of Miscellaneous
Records in the Office of the County Recorder for said County. The
exterior boundaries of District No. AD 83 -1 are more particularly
described on Exhibit "B" attached to the Engineer's Report.
5. Distinctive Designation. The distinctive designa-
tion for the District formed pursuant to this Resolution shall be
"City of Moorpark Landscaping and bighting Maintenance District
No. AD 83 -1."
6. Waiver of Hearings of Objections and Protests.
This Council. hereby finds that Griffin is the sole owner of all
real property within District No. AD 83 -1, that pursuant to the
Petition dated August 26, 1983, on file with the City Clerk,
Griffin has waived all required Statutory notices of hearings of
objections and protests to the formation of said District, that
said waiver, is valid, effective and binding, and that this Coun-
cil may, at this time, order the formation of District No. AD
83 -1 without further notice or hearings.
7. Order Authorizing Improvements. This Council here-
by authorizes Griffin to commence constructing, planting and
otherwise installing the Improvements described in paragraph 3
hereinabove. Griffin shall bear 1311 costs and expenses of con-
structing, planting and /or otherwise installing said Improve-
ments. Further, Griffin shall record with the County Recorder for
Ventura County, California, an irrevocable- offer of dedication to
the City of the Improvement Are is, irid all Improvements thereto,
prior to the first. close of es(rro, -j for the sale of a Lot in Dis-
trict No. AD 83 -1. Such offer of dedication shall be in form and
content acceptable to the City Attorney. Griffin shall complete
said Improvements to the reasonable satisfaction of the City
prior to July 1, 1984, and thereafter shall, at its sole cost and
expense, maintain the Improvement Areas in a good, clean, safe
and attractive condition acceptable to the City and maintain,
repair and replace any Improvements thereto as reasonably re-
quired by the City until June 30, 1985, at which time the afore-
said offer of dedication shall. be accepted by the City as set
forth in paragraph 9 hereinbelow. It is the Council's express
intent that all landscaping become established and the related
Improvements be proven to function properly prior to District No.
AD 83 -1 assuming responsibility for said Improvement Areas, and
Improvements thereto.
8. Order to Form Maintenance District. This Council
hereby orders the formation of "City of Moorpark Landscaping and
Lighting Maintenance District No. AD 83 -1," to provide for the
continued maintenance, operation and servicing of the Improvement
Areas, and all Improvements thereto, and for the payment of all
costs and expenses incurred for such maintenance, operation and
servicing, and hereby confirms the diagram of and assessments for
said District as set forth in the Engineer's Report.
9. Acceptance of Dedication. On or about June 1, 1985
(during the period Griffin is maintaining the Improvement Areas,
and Improvements thereto, as provided in paragraph 7 herein -
above), the City shall inspect the Improvement Areas, and Improve-
ments thereto, and shall promptly notify Griffin of any deficien-
cies or other adverse conditions which must be corrected prior to
the acceptance of the offer of dedication by the City. If at the
time of such inspection said Areas, and Improvements thereto, are
established and functioning properly, the City shall accept the
aforesaid offer of dedication at. the next, regularly scheduled
meeting of the Council closest in time to June 30, 1985.
10. Maximum Assessment.. The maximum assessment which
may be levied against each assessable lot or parcel within Dis-
trict No. AD 83 -1 shall be as set forth in the Engineer's Heport.
11. Commencement of Assessments. This Council hereby
resolves and orders that the levy of assessments for District No.
AD 83 -1 shall commence for fiscal year 1984 -85. Since Griffin is
obligated to maintain the Improvement Areas until June 30, 1985,
the proceeds of the assessments collected for fiscal year 1984 -85
shall be set aside as a reasonable reserve fund for District No.
AD 83 -1. The maximum assessment shall be prorated in the event
the acceptance of the offer of dedication occurs after July 1 of
said fiscal year.
12. Recordation of Notice. The City Clerk is hereby
directed to cause a Notice of the Formation of the City of Moor-
park Landscaping and Lighting District No. AD 83 -1" to be record-
ed with the County Recorder. Said Notice shall set forth a de-
scription of all of the real property within said District and
the maximum assessment which may be levied against the assessable
lots and parcels within the District for the fiscal year 1984 -85.
13. Certification of Adoption. The City Clerk shall
certify to the adoption of this Resolution.

ENGINEER'S REPORT
CITY OF MOORPARK
LANDSCAPE MAINTENANCE ASSESSMENT
DISTRICT NO. 83 -1
I. INTRODUCTION
Pursuant to Resolution No.8343, A Resolution of the City
Council of the City of Moorpark to initiate proceedings for the
formation of the Moorpark Landscape Maintenance Assessment
District No. 83 -1, an Assessment District to be established
pursuant to the Landscaping and Lighting Act of 1972, the
undersigned does hereby submit this Engineer's Report to the City
Council.
This Report has been prepared in accordance with the
provisions of Sections 22565 through 22574, inclusive, of the
Streets and Highways Code of the State of California, and
contains the following:
1. Plans and specifications for the Improvements.
2. An estimate of the costs of the Improvements.
3. A diagram for District No. 83 -1.
4. An assessment of the estimated costs of the
Improvements.
Finally, this Report has been prepared for fiscal year
1984 -85 commencing on July 1, 1984.
II. PLANS AND SPECIFICATIONS FOR THE IMPROVEMENTS
The Improvement Areas as more particularly shown and
described in Master Plan & Design Development Report, Exhibit "C"
attached hereto will be improved with trees, shrubs,
miscellaneous ground cover, an automatic irrigation system and
separate water meter pursuant to landscaping plans to be approved
by the City (hereinafter collectively referred to as the
"Improvements") . The Developers of Tract No. 3841 -1 and Tract
No. 3841 -2 have filed a surety bond with the City for the full
amount of constructing, planting and otherwise installing the
Improvements on the Improvement Areas.

III. ESTIMATE OF MAINTENANCE COST OF THE IMPROVEMENTS
All costs and expenses of constructing, planting or
otherwise installing the Improvements shall be borne by
Developers. Additionally, all costs and expenses reasonably
incurred by the City in connection with the formation of District
No. 83 -1 (including, but not limited to, all costs of preparation
of this Report, the landscape plans and any other plans,
specifications or estimates, and all compensation to any outside
engineers or legal counsel employed by Developers and /or the
City) shall be borne by the Developers.
There is no surplus or deficit to be carried over from a
previous fiscal year.
The maintenance and servicing costs for fiscal year
1984 -85 are estimated to be as follows:

NET AMOUNT TO BE ASSESSED $38,640.00
IV. DIAGRAM OF DISTRICT NO. 83 -1.
The exterior boundaries of District No. 83 -1 are more
particularly described in Exhibit "B" attached hereto. The
boundaries of said District are coincident with those
subdivisions known as Tract 3841 -1 and Tract 3841 -2 consisting of
191 lots as shown on maps recorded in Book 95, Pages 15 to 25,
inclusive, of Miscellaneous Records (Maps) in the Office of the
County Recorder for Ventura County, California. Said lots are
shown on Exhibit "A" attached hereto.
There are no zones within District No. 83 -1. The
undersigned has determined that all lots in Tract 3841 -1 and
Tract 3841 -2 will be benefited equally by the Improvement Areas
and Improvements thereto by virtue of the fact that said Areas
and Improvements provide lateral support for all of said Lots,
and an aesthetically pleasing quality to overall Tract.
V. ASSESSMENT OF THE ESTIMATED COSTS OF THE IMPROVEMENTS.

SITE DESCRIPTION
Neatherglen is a multi- phased residential planned unit development. Heather-
glen is located in the City of Moorpark, between Los Angeles Avenue and the
Arroyo Simi. The site is generally flat with a slight gradient to the Arroyo.
The legal description is Lots 1 through 107, inclusive of Tract 3841 -1 as shown
on a map recorded on March 1, 1983 in Book 95, Pages 15 to 20, of the Miscel-
laneous Records in the Office of the County Recorder. Lots 108 through 191,
inclusive of Tract 3841 -2 as shown on a map recorded on March 1, 1983 in Book
95, Pages 21 to 25 of the Miscellaneous Records in the Office of the County
Recorder.

HEATHERGLEN PARK DESCRIPTION
OPEN PLAY /PICNIC AREA
There are two open play areas proposed. Both of these areas are turfed and
irregularly defined by trees and berming. In these two open play areas, less
organized play and activities can occur and in one of the areas, picnic
tables are located for individual or family use.
ACTIVE PLAY AREAS
The two (2) basketball courts will provide to all age groups the opportunity to
participate in an active recreational activity. The court locations are sited
as to minimize conflict between the active passive open play areas. A sand
VolleyBall Court has also been provided.
TOD MATMN
The entire-park area will be irrigated with an automatic sprinkler system.
Where practical, all lawn areas will be covered with large rotary heads. In
smaller areas where this is not practical, spray heads will be used. Rotary
heads within the open play areas will incorporate rubber protective covers
for safety purposes. Valves will be powered from controllers using low volt-
age electrical wire.
MEDIAN ISLAND LANDSCAPE
The median island on Tierra Rejada Road will be constructed the entire length
of the project from the intersection of Los Angeles Avenue. to the Arroyo Simi.
The construction shall be as per approved landscape plans.
The development shall be consistent with the City of Moorpark and County of
Ventura policies and ordinances.
The irrigation system is automatic, the controller and automatic valves are
manufactured by the Rainbird Company. All pipe main line and laterals are plastic,
heads are acceptable brass heads of various manufacturers. All installation
shall be as per manufacturers recommendations.
Plant material for the median islands consist of trees: Pinus canariensis -
Canary Island Pine. Shrubs, Arbutus unedo comacta, Strawberry Tree. Cistus
ladanifer, Spotted rock rose. Groundcover - Rosmarinus officinalis, Rosemary.
STREET TREE WELLS AND STREET CORNER RETURNS
Street tree wells shall be constructed in the sidewalk, The location of the
tree we'ils is at back of curb. They are located at 50 foot intervals on Los
Angeles Avenue and Tierra Rejada Road.
The street tree on Los Angeles Avenue is Ulmus oarvifolia drake - Evergreen Elm.
The street tree on Tierra Rejada Road are Platanus acerifolia, London Plane.
The irrigation sytstem is automatic, all controllers and control valves are as
manufactured by the Rainbird Company. All tree wells have a 'Toro' bubbler
in them. All trees have "Deep Root" devices installed at time of planting.
Street corner returns are located at Los Angeles Avenue and Tierra Rejada;
Tierra Rejada and Courtney Lane and Tierra Rejada and Harvester Street.
All of these returns are enclosed in raised planters.
The irrigation system is fully automatic. The controllers and control valves
are as manufactured by the Rainbird Company.
Plant material is Arbutus unedo compacta, Photinia frazeri - for groundcover.
Gelsemium sempervirens- for vines. These are typical of all corners on the
project.
THE GENERAL QUANTITIES OF PLANTS ARE AS FOLLOWS:

3. Tierra Rejada Road Median Trees 15
4. Corner Return Planters 673 SQ. FT.
5. Median Island 4188 SQ. FT.
6. Park Site Turf Area 120,000 SQ.FT.
7. Hydroseed Area 59,000 SQ. FT.
The approximate average cost of maintenance is 184,000 sq.ft. @$.21 per sq. ft.
per year equals $38,640.00
OPERATION AND MAINTENANCE SCHEDULE
For the first year following completion of Heatherglen Park and street landscape
improvements, Griffin Homes will be responsible for the maintenance. At the
expiration of Griffin Homes maintenance responsibility, the responsibility shall
be turned over to the City of Moorpark for maintenance and operation of the
property.
The following are recommendations by Lee Newman and Associates pertaining to
the future maintenance of Heatherglen Park, stree trees, median islands and
corner returns.
WORKING HOURS:
Maintenance work should be limited to 7:30 a.m. to 5:00 p.m.,
Monday through Saturday.
CLEAN -UP: Leaves, paper, weeds and any other litter will be removed from the
areas and disposed of off site.
TREE CARE: Maintain trees in a healthy, growing condition by the following
operations:
Watering - trees shall be sufficiently watered.
Pruning trees - prune trees to select and develop good structural form.
Stake trees - remove stakes and guys when tree is self- supporting.
Weed control - all trees in lawns should have open soil maintained
around the base of the trunk to reduce damage to tree
trunks by machinery and watering.
Insect and disease control - maintain control with approved materials
as necessary.
Fertilization - once early in Spring and once, late in Spring.
LAWN CARE: Lawns shall be maintained in ahealthy growing condition by the
following operations:
Mowing and Edging - mow to a minimum height of two inches in warm
weather and one and one -half inches during the rainy
season. Edges shall be trimmed as needed for neat
appearance.
Watering - lawns and groundcover shall be watered at such frequency
as weather conditions require to replenish soil moisture
below root zone.
Fertilization - all turfgrass and groundcovers shall be fertilized as
required to maintain vigorous growth and color (use 8.8.4)
Soil Aeration - soil aeration of all turfgrass areas shall be accomplished
one time per year, in September.
Thatch removal - removal of thatch build -up in the sod layer shall be
accomplished one time per year in September.
Weed Control - Control broadleaf weeds with selective herbicides. In
areas where crabgrass has infested, apply a selective
post- emergent herbicide as soon as possible per manu-
facturer's recommendations.
Insect and Disease Control - if necessary, apply with approved insect-
icides and fungicides when needed.
IRRIGATION SYSTEM
Maintenance responsibilities shall include maintenance of all irrigation
systems and their parts.
PAVING MAINTENANCE
All common area paving, including basketball courts and sidewalks shall be
maintained.
Maintenance Cost Break Down
Yearly Cost 184,000 square feet = $38,640.00
Overall Monthly Cost $3,220.00
1. Landscape Maintenance 184,000 sq. ft. @.015 = $2,160.00
(mowing, pruning, fertilizer, general maintenance)
2. Utilities Water and Electrical
Per Month Cost ....... (Allowance) $460.00 month.
MATNTFNANrF
Griffin Homes will maintain the District improvements for one (1) year in
accordance with the Operations and Maintenance schedule described below.
After the one year maintenance program has been completed by Griffin and
improvements accepted by the city, maintenance will be a responsibility
of the District #83 -1.
PAVEMENT CLEANING
Pavement shall be swept as necessary to remove accumulated debris, dirt or sand.
PLAYGROUND AND SPORTS FACILITIES
All playground /sports facilities, bike racks, drinking fountains, signs, picnic
benches and tables constructed or installed shall be maintained in a safe,
usable and attractive condition.
