HomeMy WebLinkAboutRES CC 1984 064 1984 0118RESOLUTION NO. 84 -64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK ADOPTING EXPRESS FINDINGS IN RE MODII'ICATION OF UNIFORM CODES WHICH REGULATE BUILDINGS SUBJECT TO THE STATE HOUSING LAW WHEREAS, pursuant to Health and Safety Code ;sections 17958.5 and 17958.7 a City may make such modifica- tion in the requirements of the regulations adopted pursuant to Health and Safety Code section 17922 as it determines to be reasonably necessary because of local conditions if it makes express findings that such modifications are needed and if such findings, together with the modifications, are made public records on file with the Division of Building and Safety, and filed with the Department of Housing and Com- munity Development pursuant to Health and Safety Code Section 17958.7; and WHEREAS, pursuant to the decision in the case of Baum Electric Co, v. City of Huntington Beach (1973), 33 Cal. App. 3rd 573, a city may make such modifications in the requirements of the regulations adopted pursuant to Health and Safety Code Section 17922 as it deems to be reasonably necessary in order to safeguard life and property if it makes express findings that such modifications are needed and if such findings, together with the modifications, arE made public records on file with the Division of Building and Safety; NOW, THEREFORE, BE IT RESOLVED that the City Couicil concur with Ventura County, and finds, as is pro - vidad in the Ventura County Building Code, that it is reasonably necessary because of local conditions to modify certain Sections of the Uniform Codes as follows: 1. Sections UBC 1201 and 1203; to establish a reasonable interpretation of provisions of the building codes which apply to fire protection in townhouses and condominiums in view of the fact that the Uniform Building Code 1982 Edition, as printed, sets out no such provision in detail. 2. Sections UBC 1601 and 1602; to protect against the high fire hazard which results from a combination of annual periods of hot, dry winds and the presence of highly flammable grass and brush in proximity to dwellings and other structures. 3. Sections UBC 1807(f), 1807(m), and 1807(n); to provide adequate structural fire protection for high -rise re:.idential structures and assure the capability of the fire service to protect against fire and life safety hazards in such buildings. 4. Sections UBC 2308(b), 2904(b), 2905(a), 2905(b), 2905(f), 2907(a), and Table UBC 29 -A; to protect against structural damage which may result from adverse soil, geologic, and topographic conditions. 5. Section NEC 110 -5; to protect against dwelling fires relatin to the use of aluminum wiring in sizes dmaller than h American Wire Gauge. 6. Section NEC 250- 83(e); to protect against the hazard of inadequate electrical system grounding which may be associated with certain local soil conditions. 7. Section UPC 110(a) and Sections UPC Appendix 1 -1(f), I -3, I -4, and 1 -7; to protect against contamination of underground water supplies and other health hazards which may occur when private sewage disposal systems are installed in local areas where adverse soil and topo- grapaic conditions exist. BE IT FURTHER RESOLVED, that the above listed express find.�ngs shall be made available as a public record and a copy of this Resolution shall be filed with the State Department of Housing and Community Development. 1984.
