HomeMy WebLinkAboutRES CC 1984 069 1984 0215RESOLUTION NO. 84 -69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK APPROVING THE ENGINEER'S REPORT FILED PURSUANT TO SECTION 22586 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE, DE- CLARING ITS INTENTION TO ORDER THE FORMATION OF THE "CITY OF MOORPARK LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT NO. AD -84 -1" IN ACCORDANCE WITH SECTION 22587 OF SAID CODE, AND ORDERING THE FORMATION OF SAID DISTRICT IN ACCORDANCE WITH SECTION 22594 OF SAID CODE. A. WHEREAS, Griffin Homes - Moorpark, a general partnership ( herinafter "Griffin "), owns that certain real property located in the City of Moorpark, County of Ventura, State of California, more particularly described as follows: Lots 1 through 75, inclusive of TR -2851 as shown on a map recorded on November 7, 1980 in book 89, pages 43 to 48, inclusive of maps in the office of the County Recorder (hereinafter the "Property "); and B. WHEREAS, Griffin intends to develop the property as a multi -phase residential planned unit development (herein- after the "Project ") ; and C. WHEREAS, as a condition for approval of the rec- ordation of the 'aforesaid final tract maps, the County of Ventura, as the predecessor of the City of Moorpark, required that that certain street median along Campus Park Drive; that certain landscape areas along Campus Park Drive contiguous and to the rear of lots 33 to 50 and Lot 73; landscape area along the County of Ventura Flood Control easement to the rear of Lots 1 to 15 and side yards for lots 22 - 23 and 61 - 62 (as more particularly shown on exhibit "A" attached hereto) (here- inafter the "Improvement areas "), be improved with landscaping and related improvements to a standard acceptable to the County of Ventura, and the City of Moorpark, that Griffin maintain the Improvement Areas for a period of twelve (12) months after the landscaping, and related improvements have been installed, and that a means for assuring the continued maintenance, oper- ation and servicing of the Improvement Areas, and all improve- ments thereto, be established by the reasonable satisfaction of the County of Ventura; and D. WHEREAS, Moorpark became an incorporated City on July 1, 1983, and has succeeded to the interest of the County of Ventura; and E. WHEREAS, in response to the aforesaid conditions of approval of the recordation of the final tract maps, Griffin has executed and filed with the Cit Clerk a Petition wherein Griffin has, among other things, (i� requested the formation of a landscape maintenance: assessment district; (ii) waived all statutory hearings of objections and protests by inter- ested property owners to the formation of said district; and (iii) proposed to improve the Improvement Areas and maintain same for a period of twelve (12) months; and F. WHEREAS, this Council has previously adopted Resolution No. 84 -65 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTEN- TION TO INITIATE PROCEEDINGS FOR THE FORMA11 ON OF THE "MOORPARK LANDSCAPE MAINTENANCE ASSESS- MENT DISTRICT NO. AD -84 -1" AN ASSESSMENT DISTRICT TO BE ESTABLISHED PURSUANT TO THE "LANDSCAPING AND LIGHTING ACT OF 1972 ". to provide for the continued maintenance, operation and servicing of the Improvement Areas, and all improvements thereto, and for the payment of all costs and expenses in- curred for such maintenance, operation and servicing; and G. WHEREAS, pursuant to the aforesaid Resolution No. 84 -65 an Engineer's Report has been prepared in accordance with Article 4 (Sections 22565 through 22574, inclusive ) of Chapter 1 of Part 2 of Division 15 of the Streets and Highways Code of the State of California, and has been filed with the City Clerk pursuant to Section 22586 of said Code. A Copy of the Report is attached hereto as Exhibit "B" (herein- after referred to as the "Engineer's Report "); and H. WHEREAS, it has been determined by the City Council of the City of Moorpark that the public interest, convenience and necessity require the maintenance of the Improvement Areas by a landscaping and lighting maintenance district; and I. WHEREAS, pursuant to Sections 22587 and 22594 of the aforesaid Code, this Council desires to adopt this Resolution approving the Engineer's Report, declaring its in- tention to form and ordering the formation of the City of Moorpark Landscaping and Lighting Maintenance District No. AD -84 -1 as more particularly described hereinbelow. NOW, THEREFORE, in furtherance of the foregoing recitals, the City Council of the City of Moorpark does hereby find, determine, resolve and order as follows: 1. Approval of Engineer's Report. This Council hereby approves the Engineer's Report as filed with the City Clerk. 2. Declaration of Intention to Form a Maintenance District and to Levy and Collect Assessments. This Council hereby declares its intention to form the City of Moorpark Landscaping and Lighting; Maintenance District No. AD,84 -1" (hereinafter referred to as "District No. AD- 84 -1 "), pursuant to and in accordance with the provisions of the "Landscaping and Lighting Act of 1972," as set forth in Part 2 of Division 15 (Sections 22500 et seq.) of said Code, to provide for the continued maintenance, operation and servicing of the Improve- ment Areas, and all improvements thereto. Further, this Council hereby declares its intention to levy and collect assessments to pay all costs and expenses incurred pursuant to and in accordance with said Act. The proposed assessments are more particulaiiy described in the Engineer's Report. 3. Description of Improvements. The improvements to the Improvement Areas shall include shrubbery, trees, ground cover, automatic irrigation equipment, separate water meter and other related improvements (hereinafter referred to as the "Improvements"). The Improvements are more particularly des- cribed in the Engineer's Report. The Improvements are to be located within public streets, rights -of -way, as shown in the Engineer's Report. 4. Description of Landscape Maintenance District. District No. AD -84 -1 shall consist of Lots 1 through 75, inclu- sive, of Tract 2851 as shown on a Map recorded in Book 89, pages 43 to 48, inclusive, of mapsin the office of the County Recorder for Ventura County, California. The exterior bound- aries of District No. AD -84 -1 are more Varticu larly described on Exhibit "B" attached to the Engineer s Report. 5. Distinctive Designation. The distinctive desig- nation for the District formed pursuant to this Resolution shall be "City of Moorpark Landscaping and Lighting Maintenance District No. AD- 84 -1." 6. Waiver of Hearings of Objections and Protests. This Council hereby finds that Griffin is the sole owner of all real property within District No. AD -84 -1; that pursuant to the Petition dated January 3, 1984, on file with the City Clerk, Griffin has waived all required statutory notices of hearings of objections and protests to the formation of said District; that said waiver is valid, effective and binding; and that this Council may, at this time, order the formation of District No. AD -84 -1 without further notice or hearings. 7. Order Authorizing Improvements. This Council hereby authorizes Griffin to commence constructing, planting and otherwise installing the Improvements described in para- graph 3 hereinabove. Griffin shall bear all costs and expenses of constructing, planting and /or otherwise installing said Improvements. Further, Griffin shall record withthe County Recorder for Ventura County, California, an irrevocable offer of dedication to the City of the Improvement Areas, and all Improvements thereto, prior to the first close of escrow for the sale of a Lot in District No. AD -84 -1. Such offer of dedica- tion shall be in form and content acceptable to the City Attorney. Griffin shall complete said Improvements to the -3- reasonable satisfaction of the City, and after completion and inspection approval by the City, shall, at its sole cost and expense,maintain the Improvement Areas in a good, clean, safe and attractive condition acceptable to the City and main- tain, repair and replace any Improvements thereto as reasonably required by the City for a period of one year, after which time the aforesaid offer of dedication shall be accepted by the City as set forth in paragraph 9 hereinbelow. It is the Council's express intent that all landscaping become established and the related Improvements be proven to function properly prior to District No. AD -84 -1 assuming responsibility for said Improve- ment Areas, and Improvements thereto. 8. Order to Form Maintenance District. This Council hereby orders the formation of City of Moorpark Landscaping and Lighting Maintenance District No. AD- 84 -1," to provide for the continued maintenance, operation and servicing of the Improvement Areas, and all Improvements thereto, and for the payment of all costs and expenses incurred for such maintenance, operation and servicing, and hereby confirms the diagram of and assessments for said District as set forth in the Engineer's Report. 9. Acceptance of Dedication. On or about June 1, 1985 (during the period Griffin is maintaining the Improvement Areas, and Improvements thereto, as provided in paragraph 7 hereinabove), the City shall inspect the Improvement Areas, and Improvements thereto, and shall promptly notify Griffin of any deficiencies or other adverse conditions which must be corrected prior to the acceptance of the offer of dedication by the City. If, at the time of such inspection, said Areas and Improvements thereto are established and functioning properly, the City shall accept the aforesaid offer of dedication at the next regularly scheduled meeting of the Council closest in time to June 30, 1985. 10. Maximum Assessment. The maximum assessment which may be levied against each assessable lot or parcel within District No. AD -84 -1 shall be as set forth in the Engineer's Report. 11. Commencement of Assessments. This Council hereby resolves and orders that the levy of assessments for District No. AD -84 -1 shall commence for fiscal year 1984 -85. Since Griffin is obligated to maintain the Improvement Areas until June 30, 1985, the proceeds of the assessments collected for fiscal year 1984 -85 shall be set aside as a reasonable reserve fund for District No. AD -84 -1. The maximum assessment shall be prorated in the event the acceptance of the offer of dedi- cation occurs after July 1 of said fiscal year. -4- 12. Recordation of Notice. The City Clerk is hereby directed to cause a Notice of the Formation of the City of Moorpark Landscaping and Lighting District No. AD 84 -1" to be recorded with the County Recorder. Said Notice shall set forth:a description of all of the real property within said District and the maximum assessment which may be levied against the assessable lots and parcels within the District for the fiscal year 1984 -85. 13. Certification of Adoption. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 15 day of _February 19 84. Griffin Park. The site slopes down from a hill on the north gently toward Campus Park Drive, on the south and borders a Ventura County Flood Control District channel on the west and Collins Avenue on the east. (See Exhibit "A ") The legal description from Tract 2851 includes Lots 1 through 75 inclusive of Tract 2851 as shown on a map recorded on November 7, 1980 in Book 89, pages 43 -48 inclusive of maps in the office of the County Recorder. LIGHTING & LANDSCAPE DISTRICT #84 -1 (hereinafter Maintenance District) MAINTENANCE DISTRICT SLOPES The site includes perimeter and interior slope planting easements at the Flood Control District west of Lots 1 -15, at Campus Park Drive south of Lots 1, 33 -49 and at Collins Drive east of Lots 49, 50 & 73 on the perimetev and, on Bambi Court south of Lots 22 & 23 and on Benwood Drive west of Lots 61 & 62 in the interior. Planting and irrigation shall be as per approved plans, prepared by Richard W. Campbell, A.S.L.A., Westlake Village, California. The development shall be consistent with the City of Moorpark policies and ordinances. The irrigation system shall be, backflow protected, automatically controlled and valved. All irrigation main supply and lateral pipe shall be poly vinyl chloride P.V.C. (plastic), except for galvanized iron piping on slope face (to prevent cutting into and disturbing slope sur- face),control valves (electrically actuated), gate valves, and quick couplers shall be brass,sprinkler heads shall be plastic. Automatic controller shall be solid state with variable timing program. All installation shall be per plans, specifications and as per manufacturer's recommendations. P.V.C. sleeves shall be provided under paved areas for maintenance of piping and wiring. Plant material shall be healthy in all respects and shall conform to the plans, specifications and direction of the Landscape Architect. Plants shall enhance and blend with the architectural theme of streetscape and residential character while favoring drought tolerant varieties. Flood control district slopes shall be planted with drought tolerant, coloful, erosion resistant root systems while providing screening and shade along the perimeter slope. Campus Park Drive plantings shall include a streetscape tree - Quercus ilex and to match contiguous trees on the Moorpark College Campus streetscape; and vines to "soften" the peri- meter wall in addition to the flowering shrubs. Collins Drive plantings shall be similar to Campus Park Drive except for a streetscape tree - Pinus pinea. MEDIAN ISLAND LANDSCAPE The median island located in Campus Park Drive shall be planted and irrigated contiguous to Lots 37 -44 as per approved plans prepared by Richard W. Campbell, A.S.L.A. The remainder of the "necks" for turn pockets shall be paved with "stamped" and colored concrete as per the approved plans. The development shall be consistent with the City of Moor- park policies and ordinances. The irrigation system shall be backflow protected automati- cally controlled and valved. STREETSCAPE TREES Interior streetscape trees are not included in the specific Maintenance District #84 -1 area and shall be maintained jointly by the individual homeowner and the City of Moorpark as per the policies and ordinances of the City of Moorpark. INTERIOR ON -LOT SLOPES Interior slopes not a part of Maintenance District 84 -1 are the sole responsibility of the individual lot owner as expressed in the CC &R's. ESTIMATED COST OF ON -GOING LANDSCAPE MAINTENANCE Total area of Maintenance District = 39,150 sq. ft. PARK GLEN exhibit "a" OPERATION AND MAINTENANCE SCHEDULE LIGHTING AND LANDSCAPE DISTRICT r84 -1 (THE DISTRICT) CITY OF MOORPARK 1. SCOPE OF WORK A. The contractor shall provide at his own risk and cost: all labor, tools, equipment, and other items needed to do landscape maintenance in a manner acceptable to the District. B. The contractor shall provide a performance bond acceptable to the District. C. The contractor shall maintain Worker's Compensa- tion and Public Liability Insurance with coverage acceptable to the District. II. DESCRIPTION OF WORK A. Watering: 1. Irrigation shall be applied at a rate not to exceed soil infiltration rate and repeat applications shall provide proper moisture for optimum plant growth. 2. Supplemental watering by hand shall be applied as needed. 3. Shrubs and trees shall be deep watered period- ically to promote healthy vigorous root systems. 4. All areas shall be thoroughly watered after fertilization. B. Fertilization: 1. Ground covers, shrubs and trees shall be fed a minimum of three (3) times per year using a high nitrogen commercial fertilizer (16 -20 -0) and applied (not to exceed 1* actual Nitrogen /1,000 SF) according to manufacturer's recommendations. 2. Where soil testing or physical evidence indi- cates deficiencies of other essential nutrients, applications of chelates or other forms of trace mineral fertilizers shall be made until symptoms disappear and plants regain their Vigorous condition. C. Mowing: 1. Mowing shall be scheduled so that no greater than one - quarter (1 /4) of the total leaf is cut at any one time. 2. Grass shall be cut between 1 -1/2" to 1 -3/4" height in winter months and between 2" to 2 -1/2" in summer months. 3. All clippings shall be collected and removed legally from the site. 4. Lawns shall not be mowed when either too wet or too dry. 5. Lawn areas adjacent to paving, walks, headers, etc., shall be edged at the time of each mowing. 6. Reel type mowers are preferred; however, rotary, if used, and reel types shall be sharpened prior to each mowing operation. D. Weed Control: 1. All planting and turf areas shall be continuously maintained in a weed free condition and cul- tivated quarterly to provide surface aeration. 2. Selective herbicides may only be used as approved by the County Agricultural Commissioner and the District. 3. Damage from misuse of weed control operations shall be corrected immediately by the contractor. E. Pest Control: 1. Control of pest infestations shall be the responsibility of the contractor. 2. Pesticides shall only be used after all other controls fail. 3. Selective pesticides may only be used as approved by the County Agricultural Commis- sioner and the D i st ?- ic,. . F. Plant Protection: 1. Trees and shrubs susceptible to kind damage shall be appropriately pruned and protected as approved by the District. 2. All plants shall be maintained in a healthy vigorous condition and replacement plants shall be made at contractor's expense in equivalent size and quality to the satisfac- tion of the District. G. Irrigation Systems: 1. Sprinkler systems shall be continuously main- tained in optimum working condition including but not limited to, repair of automatic controllers and control valves, sprinkler heads, risers, pipes, backflow preventors; and adjacent and replacement of worn and broker parts, as well as trimming around sprinkler heads. 2. Replacement parts shall match original equipment or be an equal as approved by the District. H. Drainage: 1. Existing drainage pattern and structures shall` be continuously maintained and repaired by the contractor in accordance with the requirements of the District. I. Clean Up: 1. All areas shall be kept continuously free of trash and debris by the contractor to the satisfaction of the District. 2. All paved surfaces including parking lot, pool deck, tennis court, walkways, steps, etc., shall be washed down with a high pressure hose at least once per week on either Friday after- noon or Saturday morning. 3. All roof surfaces shall be washed down at least four (4) times per year as directed by the District. J. Inspections: 1. A minimum of one (1) inspection per month of all areas shall be schedules, by the contractor, with the - District. K. Additional Work: 1. Additional work requested by the District, which is not a part of this specification, shall be submitted by the contractor in the form of an all inclusive program with costs to be incurred. L. Resume 1. Anything not herein specified, but necessary to maintain the health and appearance of items included in this specification shall be con- sidered by the maintenance contractor to be part of the contract. III. CERTIFICATION I hereby certify that I have personally prepared these specifications which, with strict adherance thereto, will provide the optimum establishment of permanent slope control plantina- Date: . :;
