HomeMy WebLinkAboutRES CC 1984 075 1984 0321RESOLUTION NO. 84 -75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK DECLARING ITS INTENTION TO ORDER THE FORMATION OF " MOORPARK LIGHTING MAINTENANCE DISTRICT AD- 84 -2," PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO. WHEREAS, the City Council, by Resolution No. 84 -71 , proposed to form an assessment district pursuant to the pro- visions of the Landscaping and Lighting Act of 1972 (Part 2, Division 15 of the California Streets and Highways Code); and WHEREAS, by said Resolution No. 84 -71 , the City Council ordered the Engineer to prepare a report pursuant to Article 4, Chapter 1, Division 15 of the said Streets and Highways Code; and WHEREAS, the Engineer did prepare and file such a report and the same was approved by the City Council on the 21 day of March , 1984, by Resolution No.84 -74 ; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience requires and it is the intention of the City Council of the City of Moorpark to order the formation of "Moorpark Lighting Maintenance District AD- 84 -2," consisting of a single Citywide zone within which electric current or energy, gas or other illuminating agent for street lights and traffic safety lights shall be furnished, and the usual maintenance and servicing of street and traffic safety lights shall be performed, in- cluding all work and materials appurtenant to such maintenance and servicing. In addition, said district is to be formed to levy and collect assessments for said illumination and main- tenance in accordance with the Act hereinafter designated. SECTION 2. That the foregoing described work is to be located within public streets and easements within said Assessment District, the boundry of which district is more particularly described on a map on file in the City Clerk's office entitled "Diagram of Moorpark I.,ighting District AD- 84 -2," filed in the office of the City Clerk on the 19th day of March , 1984. -1- SECTION 3. That the contemplated servicing and maintenance of street and traffic safety lights, in the opinion of said City Council, is of benefit to, and the said City Council hereby makes the expense of the said servicing and maintenance chargeable upon the district. SECTION 4. Reference hereby is made to the report of the Engineer on file with the City Clerk and open to inspection, for a full detailed description of the improve- ments, the boundries of the Assessment District and any zones therein and the proposed assessments upon assessable lots and parcels of land within the District. SECTION 5. Notice is hereby given that on the 16th day of May , 1984, at the hour of 7.00 p.m.in the Council Chambers of the City Council in the City Hall in Moorpark, California, any and all persons having any objections to the work or extent of the assessment district, may appear and show cause why said work should not be done or carried out or why said district should not be formed in accordance with this Resolution of Intention. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Any such protest shall state all grounds of the objection and if filed by a property owner shall contain a description sufficient to identify the property. SECTION 6. All the work herein proposed shall be done in accordance with the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the Streets and Highways Code of the State of California. SECTION 7. The City Clerk shall cause notice of the hearing to be given by causing the Resolution of Intention to be published and mailed in the manner required by Part 2 of Division 15 of the Streets and Highways Code.
