HomeMy WebLinkAboutRES CC 1984 113 1984 0718RESOLUTION NO. 84 -113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, CERTIFYING THE MITIGATED NEGATIVE DECLARATION, GRANTING A DENSITY BONUS, AND APPROVING RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. PD -999, ON APPLICATION OF CENTURY HOMES. WHEREAS, at duly noticed public hearings on June 24 and July 10, 1984, the Moorpark Planning Commission considered and adopted Resolution No. PC- 84 -19, entitled: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, RECOMMENDING CERTIFICATION OF THE MITIGATED NEGATIVE DECLARATION AND APPROVAL OF RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. PD -999, ON APPLICATION OF CENTURY HOMES for the construction of 30 senior citizens' apartments located adjacent to and southeast of the intersection of Charles Street and Magnolia Avenue; and WHEREAS, public notice having been given in time, form and manner as provided by law, the City Council of the City of Moorpark has duly considered said PD -999 and has reached its decision; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That this body has reviewed and considered the information contained in the Mitigated Negative Declaration, and a finding is hereby made that this project will not have a significant effect on the environment, and certifies that a Mitigated Negative Declaration has been completed in compliance with California Environmental Quality Act and the State Environ- mental Impact Report Guidelines issued thereunder. SECTION 2. The City Council adopts the findings con- tained in the staff report dated July 13, 1984, which report is incorporated herein by reference as though fully set forth herein. SECTION 3. That the City Council hereby grants a density bonus for the project as requested, in conformance with the provisions of the Government Code of the State of California. SECTION 4. The City Council hereby conditionally approves PD -999, subject to compliance with all the conditions -1- attached hereto, and that violation of any such conditions shall be grounds for revocation of said permit. That the permit is granted for the land as described in the application and any attachments thereto, and as shown on the plot plan submitted, labeled Exhibit "A ". 2. That the permit is granted for all of the buildings, fences, signs, roadways, parking areas, landscaping and other features which shall be located substantially as shown on Exhibit "B ", except or unless indicated otherwise herein. 3. That the elevations of all buildings shall be substantially in conformance with the elevation plans labeled Exhibit "B" inclusively. 4. That any minor changes may be approved by the Planning Director, but any major changes will require the filing of a modification application to be considered by the City Council. 5. That the final design of all buildings, communal open spaces, recreational facilities, walls and fences including materials and colors, is subject to the approval of the Planning Commission. 6. That all requirements of any law or agency of the State, City of Moorpark, and any other governmental entity shall be met. 7. That prior to construction, a zone clearance shall be obtained from the Planning Division and a building permit shall be obtained from the Division of Building and Safety. S. That unless the use is inaugurated on all phases not later than twelve (12) months after the date the permit is granted, this permit shall automatically expire on that date. The Planning Director may, in his discretion, grant one additional 12 -month extension for use inauguration provided: (a) the application for extension is made prior to the expiration of the initial twelve (12) month period; (b) there has been no changes in the approved plans; (c) there has been no change of circumstances which will prevent the preservation of the integrity, character, utility of value of the property in the zone and the general area in which the use is proposed to be located or will be detrimental to the public health, safety or welfare; and (d) the permittee has diligently worked toward the inauguration of use during the initial twelve (12) month period. 9. That all landscaping and planting in and adjacent to parking and vehicular areas shall be contained within raised planters surrounded by six (6) inch high concrete curbs. 10. That all utilities shall be placed underground. 11. That signs are subject to City of Moorpark Ordinance Code, Article 24, Sign Ordinance. All signs are subject to approval by the Planning Commission. ` 12. That a transfer of this permit shall not be effective until the name and address of the transferee and date when such transfer shall be effective, together with a letter from the new owner certifying agreement to comply with all conditions of the permit, is subject to approval by the City Council and the transfer is approved by the City Council. 13. That no construction, alteration, or use for which this permit is granted shall be commenced or continued unless and until permittee has entered into an agreement with City to complete all improvements specified in this permit and has posted a bond or other form of financial guarantee in an amount to be determined by the appropriate City agencies, subject to the approval of the Planning Director, to guarantee the completion of said improvements. The posting and accpetance of said bond(s) or other form(s) of financial guarantee shall be a condition precedent to the issuance of any zone clearance, building permit or occupancy permit, pertaining to this Residential Planned Development. CONDITIONS FOR: RPD -999 APPLICANT: Century Homes /Area Housing Authority of Ventura County RESOLUTION NO.: 84 -113 PAGE: 2 Adopted 7 -18 -84 14. That the development is subject to all applicable regulations of the "R -P -D" (Residential Planned Development) zone. 15. That prior to issuance of a zone clearance, a landscaping planting and fencing plan, together with specifications and a maintenance program, shall be prepared by a State- licensed Landscape Architect. The purpose of the landscping will be: 1) to enhance quality of the development by landscaping the common areas; and 2) to assure that California native plants are utilized in the landscaping of the propertv. Three sets of plans shall be submitted to and approved by the Planning Commissionfoll.owing review by the City's Landscape Consultant. The applicant shall bear the total cost of such review and of final installation inspection. 16. That all residential units shall be constructed, employing energy saving devices as may be appropriate to the state of the art. These are to include, but are not limited to, the following: 1. Low flush toilets (not to exceed 3' gallons). 2. Shower controllers. 3. Stoves, ovens and ranges, when gas fueled, shall not have continuous burning pilot lights. 4. All thermostats connected to the main space heating source to have night setback features. 5. Kitchen ventilation system to have automatic dampers to insure closure when not in use. 17. That if the use is changed from a senior citizens apartment project to an apartment project permitting a mixture of age groups, 30 additional parking spaces shall be provided within 500 feet of the project. 18. That any changes in use shall be subject to review and approval by the City Council. 19. That the subject development shall be occupied by persons 62 years or older. 20. That tenants will be screened by the Area Housing Authority of Ventura County to assure that they meet the age and income requirements of this permit. Prospective tenants will be of a low or moderate income as defined by the California Department of Housing and Community Development. ENVIRONMENTAL HEALTH DEPARTMENT CONDITIONS: 21. That in order to protect the public safety and prevent groundwater pollution, any abandoned wells on the property shall be destroyed in accordance with the Ventura County Well Ordinance prior to occupancy. y 22. That prior to issuance of building permits, the applicant shall demonstrate the availability of domestic water by submitting a "will- serve" letter from a domestic water purveyor licensed by the Ventura County Environmental Health Department or the State of California Department of Public Health to the Ventura County Environmental Health Department and the Ventura County Public Works Agency. 23. That at the time water service connection is made, cross- connection control devices shall be installed on the water system in accordance with the requirements of the Ventura County Environmental Health Department. 24. That prior to issuance of building permits, a "will- serve" letter shall be obtained for sewage service. Said letter shall be filed with the Ventura County Environmental Health Department and the Ventura County Public Works Agency. CONDITIONS FOP.: RPD -999 APPLICANT: Century Homes /Area Housing Authority of Ventura County RESOLUTION NO.: 84 -113 PAGE: 3 Adopted 7 -18 -84 FIRE DEPARTMENT CONDITIONS: 25. That the access roadway shall be extended to within 150 feet of all portions of the exterior walls of the first story of any building. Where the access roadway cannot be provided, approved fire protection system or systems shall be installed as required and acceptable to the Bureau of Fire Prevention. 26. Any gates, to control vehicle access, are to be located to allow a vehicle waiting for entrance to be completely off the public roadway. If applicable, it is recommended that the gate(s) swing in both directions. The method of gate control shall be subject to review by the Bureau of Fire Prevention. 27. That prior to construction, the applicant shall submit plans to the Ventura County Bureau of Fire Prevention for the approval of the location of fire hydrants. Show existing hydrants on plan within 300 feet of the development. 28. That fire hydrants shall be installed and in service prior to combustible construction and shall conform to the minimum standards of the Ventura County Water Works Manual. 29. That the minimum fire flow require shall. be determined by the type of building construction, fire walls, and fire protection devices provided, as specified by the I.S.O. Guide for Determining Required Fire Flow. 30. That a minimum individual hydrant flow of 1,250 gallons per minute shall be provided at this location. 31. That an approved spark arrester shall be installed on the chimney of any structure. California Administrative Code, Title 24, Section 1319. 32. That address numbers, a minimum of 4 inches high, shall be installed prior to occupancy, shall be of contrasting color to the background, and shall be readily visible at night. Where structures are set -back more than 150 feet from the street, larger numbers will be required so that they are distinguishable from the street. In the event a structure(s) is not visible from the street, the address number(s) shall be posted adjacent to the driveway entrance. 33. That a plan shall be submitted to the Ventura County Bureau of Fire Prevention for review indicating the method in which buildings are to be identified. 34. That building plans of public assembly areas, which have an occupant load of 50 or more, shall be submitted to the Ventura County Bureau of Fire Prevention for review. 35. That fire extinguishers shall be installed in apartment buildings according to National Fire Protection Association, Pamphlet #10. The placement of extinguishers shall be subject to the review of the Fire Chief. 36. That any structure greater than 5,000 square feet in area and /or 5 miles from a fire station shall be provided with an automatic fire sprinkler system in accordance with Ventura County Ordinance #14. 37. That roofing material shall be any fire retardant roofing as defined by the Uniform Building Code. PUBLIC WORKS AGENCY: 38. That prior to the issuance of a Building Permit, the permittee shall submit to the City of Moorpark for review and approval, a grading plan prepared by a Registered Civil Engineer; shall obtain a Grading Permit; and shall post sufficient surety guaranteeing completion. CONDITIONS FOR: RPD -999 APPLICANT: Century Homes /Area Housing Authority of Ventura County RESOLUTION NO.: 84 -113 PAGE: 4 Adopted 7 -18 -84 39. That prior to the issuance of a Building Permit, the permittee shall submit to the City of Moorpark for review and approval, improvement plans prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvements; and shall post sufficient surety guaranteeing the construction of the improvements. The improvements shall include installation of concrete curb and gutter, sidewalk, streetlights, striping, and paving, and removal of existing curb and gutter. These improvements shall be accomplished in accordance with the Ventura County Road Standards. The applicable Road Standard Plates are as follows: B -4B (modified with an Charles Street and Magnolia Street 8 -foot sidewalk E -8 Handicap Ramp At intersection of Charles Street and Magnolia Street E -1 Residential Driveway 30 -foot driveway on Charles Street 40. That prior to any work being conducted within the City right -of -way, the permittee shall obtain an Encroachment Permit from the appropriate agency. 41. That prior to the issuance of a Building Permit, the permittee shall submit to the City of Moorpark the Deed for Dedication for sufficient road easement to permit: a. A 15-foot right -of -way radius and sidewalk construction at the intersection of Charles and Magnolia Streets; and b. An adjustment of the existing right -of -way along Charles Street to accomodate the sidewalk at the pick -up and drop -off area. 42. That prior to the issuance of a Building Permit, the permittee shall deposit with the City of Moorpark a contribution for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit shall be the then current Los Angeles Avenue Improvement Area of Contribution applicable rate at the time the Building Permit is issued. 43. That prior to the issuance of a Zoning Clearance, the permittee shall submit to the City of Moorpark for review and approval drainage plans addressing the surface water drainage problem at the intersection of Charles and Magnolia Streets, hydrologic and hydraulic calculations prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvements; and shall post sufficient surety guaranteeing the construction of the improvements. 44. That prior to the issuance of the Certificate of Occupancy, the permittee shall have accompoli.shed the required improvements of this entitlement. SHERIFFS CONDITIONS: 45. That the landscaping of the project shall be designed in a manner which does not conceal any door or window. 46. That the driveway entrance shall be a minimum width of 30 feet with curb radius returns. 47. That a six foot concrete block wall shall be provided on the south and east side of the property. 48. That one parking space per unit shall be provided. 49. That a parking lot security gate shall be provided. That all doors should be of a solid core construction with a minimum thickness of one and three - quarter inches or with panels not less than nine - sixteenths inch thick. Each door shall have a minimum one -inch deadbolt lock and a panoramic door viewer. 51. That all windows shall be equipped with a metal guide track at top and bottom. The bottom track should be constructed so that the windows cannot be lifted from the track when the window is closed or in a locked position. 52. That a lighting plan shall be reviewed by the Sheriff's Department prior to zone clearance. 53. That during construction a six foot fence shall surround the entire project. RR:khD249 ADDITIONAL PLANNING COMMISSION CONDITIONS: 54. That prior to the issuance of zone clearance, the adequacy of existing streetlighting be examined by the City Engineer. Upon the recommendation of the City Engineer, the Planning Commission may require that additional streetlights be installed. 55. That, prior to issuance of a Zone Clearance, a security plan shall be approved by the Planning Commission. The plan shall address the control of the parking lot gate by the manager and /or residents, the use of the parking lot by visitors, a TV system for parking lot surveillance by the manager, and an intercom or phone system between tennants and manager. 56. That each unit be equipped with a fire extinguisher in the kitchen. 57. That prior to the issuance of a zone clearance, the design and location of all roof mounted equipment and vents shall be subject to the approval of the Director of Community Development. ADDITIONAL CITY COUNCIL CONDITIONS: 58. That Los Angeles Avenue Area of Contribution Road Improvement fees may be reduced by the Planning Commission pending the final approval of the final design of the project. 59.
