HomeMy WebLinkAboutRES CC 1984 148 1984 1024RESOLUTION NO. 84 -148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE LAND USE ELEMENT OF THE MOORPARK GENERAL PLAN BY ADOPTING GPA -84 -2. WHEREAS, at a legal public hearing on April 10, 1984, the Moorpark Planning Commission adopted its Resolution No. PC- 84 -13, recommending to the City Council of the City of Moorpark that staff findings be adopted, the Environmental Impact Report be certified, and that the City Council adopt General Plan Amendment No. 84 -1 amending the Land Use Element of the General Plan as follows: A. A.C. Construction, Inc. /Southeast Moorpark Neighbor- hood Core Component - the area bounded by Los Angeles Avenue, Moorpark Road, the Arroyo Simi and the Flory Drain be redesignated from Medium Density Residential to High Density Residential. B. Gilbert Component - the proposal site be redesignated from Medium Low Density Residential to General Com- mercial. C. Happy Camp Park Component - various designated amendments to reflect the actual boundaries of the Happy Camp Canyon Regional Park. D. Tierra Rejada Component - the Open Space 1 and 2 boundary be adjusted reflecting the property lines and roads instead of topographic features; and WHEREAS, at a duly noticed public hearing, held on April 18 and May 2, 1984, the City Council adopted Resolution No. 84 -84, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE LAND USE ELEMENT OF THE MOORPARK GENERAL PLAN BY ADOPTING GPA -84 -1 (HAPPY CAMP PARK - TIERRA REJADA) and instructed that a study be undertaken by City staff and the Planning Commission for the remainder of the properties the subject of said General Plan Amendment; and WHEREAS, at a duly noticed public hearing held September 19, 1984, the City Council did consider the remaining portion of the proposed General Plan Amendment, and referred the matter back to the Planning Commission for consideration and recommendation of the following: -1- 1. Consider establishment �)` "Commercial Office" Zone on property bounded by Los Angeles Avenue on t:-.e north, the Arroyo Simi on the south, Moorpark Road on the east, and on the west by the proposed southerly extension of Millard Street. 2. Change from "Commercial" to "Commercial Office" or "Residential" the property bounded by Los Angeles Avenue on the north, the Arroyo Simi on the south, Liberty Bell Road on the west, and the proposed southerly extension of Moorpark Avenue on the east. 3. Change from "General Commercial" to "Very High Density" the property bounded by Los Angeles Avenue on the north, the Arroyo Simi on the south, Liberty Bell Road on the east, to a point approximately 400 feet west of Liberty Bell Road; and WHEREAS, at a duly noticed public hearing held October 9, 1984, the Planning Commission recommended to the City Council of the City of Moorpark that the Environmental Impact Report be certified, that staff findings be adopted, and that the Land Use Element of the Moorpark General Plan be amended to remove the entire area from a Commercial designation and that it be designated for High Density residential pending further studies of development constraints and population impacts within the area; and WHEREAS, the City Council held legally noticed public hearings on October 17 and 24, 1984, on the matter of certifying the Environ- mental Impact Report, adopting staff findings, and considering the recommendation of the Planning Commission, which the City Council designated as GPA -84 -2; and WHEREAS, at the adjourned regular meeting of October 24, 1984 the Council did consider said matter and on advice from the City Attorney, the City Council took action to consider the component originally described in the environmental document entitled, "Environmental Impact Report, General Plan Amendment 83 -1 ", dated September 28, 1983, as the A.C.Construction, Inc. /Southeast Moorpark Core Component and hereinafter designated as GPA -84 -2, separately from the component originally described in said environmental docu- ment as the Gilbert Component and hereinafter designated as GPA -84 -3; further, to consider the balance of the properties the subject of the noticed public hearing of October 17, 1984 as a separate amend- ment to the General Plan, to be designated as GPA -84 -4; and -2- WHEREAS, the City Council has reviewed and considered the final Environmental Impact Report, et.-itled "Environmental Impact Report, General Plan Amendment 83 -1" dated September 28, 1983, the project description of which encompasses property considered in General Plan Amendment No. 84 -2, and has certified the same as the Environmental Impact Report for General Plan Amendment No. 84 -2; and WHEREAS, the City Council has considered oral and written testimony on this matter and the staff findings and recommendations, attached reports and addendums thereto, and has reached its decision; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the Moorpark City Council amends the Land Use Element of the Moorpark General Plan to reflect the changes designated on the map attached hereto, marked EXHIBIT B and incor- porated herein and made a part hereof, which amendment is General Plan Amendment No. 84 -2. SECTION 2. That the City Clerk is instructed to transmit to the planning agency of the County of Ventura a copy of the amendments to the Moorpark Land Use Element, pursuant to Government Code Section 65360.
