HomeMy WebLinkAboutRES CC 1985 188 1985 0415RESOLUTION NO. 85- 188 A JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF VENTURA AND THE CITY COUNCIL OF THE CITY OF MOORPARK, ADOPTING AND APPROVING THE EXCHANGE OF PROPERTY TAX REVENUES FOR A DETACHMENT OF TERRITORY FROM THE VENTURA REGIONAL SANITATION DISTRICT (MOORPARK DETACHMENT). WHEREAS, Section 99 of the Revenue and Taxation Code requires that prior to filing a request for any jurisdictional change with LAFCO, all agencies whose service areas or service responsibilities would be altered by such change shall determine the amount of property tax revenues to be exchanged between and among such affected agencies; and WHEREAS, it is specified that such jurisdictional change shall become effective only after each affected county and city agrees by resolution to accept a negotiated exchange of property tax revenues; and WHEREAS, in the event a jurisidctional change affects the service area or service responsibility of one or more special districts, the Board of Supervirors of the county in which such districts are located shall negotiate any exchange of property tax revenues on behalf of the district; and WHEREAS, the adopting agencies shall notify the County Auditor, who shall adjust the amount of property tax revenue determined for each local agency whose service area or service responsibility would be altered by such jurisdictional change; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED AS FOLLOWS: SECTION 1. The City of Moorpark intends to initiate the detachment of territory from the Ventura Regional Sanitation District; said proposal to be known as the "Moorpark Detachment ". SECTION 2. For this detachment, effective in the fiscal year commencing after the calendar year of the effective date of the detachment, the property tax allocation factors for the affected District shall be adjusted within each tax rate area within which both the City and the District are present; one -half (50 %) of the District's tax allocation shall be allocated to the City of Moorpark; the other half (50 €) shell be allocated to the General Fund of the County of Ventura. -1- SECTION 3. A certified copy of this resolution shall be submitted to the County Auditor.- Controller, who shall make the appropriate adjustments as provided in Section 99 of the Revenue and Taxation Code. SECTION 4. A certified copy of this resolution shall be submitted to the Ventura Local Agency Formation Commission. SECTION 5. The City Clerk shall certify to the passage and adoption of this Resolution. 1985.
