HomeMy WebLinkAboutRES CC 1985 192 1985 0518RESOLUTION NO. 85- 192 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, INITIATING PROCEEDINGS FOR THE FORMATION OF THE "PARKS MAINTENANCE ASSESSMENT DISTRICT NO. AD- 85 -1 ", AN ASSESSMENT DISTRICT TO BE ESTABLISHED PURSUANT TO THE "LANDSCAPING AND LIGHTING ACT OF 1972 "; CONSOLIDATING A PORTION OF "MOORPARK LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. AD -83 -1" THEREWITH; AND ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT IN ACCORDANCE THEREWITH. WHEREAS, at a Special Municipal Election held in the City of Moorpark on November 6, 1984, the voters of the City supported an advisory measure for the City Council to consider the formation of an assessment district pursuant to the Landscaping and Lighting Act of 1972 for the purpose of maintaining public parks and other landscaped areas within the City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Inititation of Proceedings to Form Assessment District. Pursuant to Section 22585 of the Streets and Highways Code of the State of California, this Council hereby proposes to form, and does initiate proceedings for the formation of a parks maintenance assessment district purusuant to, and in accordant with, the provisions of the " Lanscaping and Lighting Act of 1972 ", as set forth in Part 2 of Division 15, Section 22500 et seq., of said Code, to provide for the maintenance and improvement of parks and recreational facilities within the City. SECTION 2. Description of Service and Maintenace. The assessments proposed to be levied and collected shall be used for the maintenance and improvement of parks and recreational facilites pursuant to Section 22525 of the Streets and Highways Code of the State of California. SECTION 3. Description of Proposed Assessment District_. To ensure that the costs and expenses of maintaining and improving the parks and recreational facilities in the City are borne by the owners of the property to be benefited thereby, this Council resolves that the proposed parks maintenance assessment district consist of all property within the City. SECTION 4. Consolidation of Portion of "Moorpark Landscape Maintenance Assessment District No. AD- 83 -1 ". Said parks maintenance district shall specifically include the parksite with all improvements located therein, described by and heretofore included within "Moorpark Landscape Maintenance Assessment District No. AD- 83 -1 ", which was -1- formed and confirmed by this City Council by Resolution No. 83 -44, adopted October 3, 1983, and the above described portion of said "Moorpark Landscape Maintenance Assessment District No. AD -83 -1" shall be consolidated with said parks maintenance assessment district, pursuant to the provisions of Sections 22585 et seq, of said Streets and Highways Code. SECTION 5. Distinctive Designation. The distinctive desig- nation for the proposed assessment district to be formed pursuant to this resolution shall be "Parks Maintenanceā€¢Assessment District No. AD- 85 -1 ". SECTION 6. Preparation of Engineer's Report. The City Manager is directed to cause to be prepared an Engineer's Report, in accordance with Article 4, Chapter 1, Part 2, Division 15 of said Streets and Highways Code; and that upon completion, the report shall be filed with the City Clerk, who shall then submit the same to the City Council for its consideration, pursuant to Section 22586 of said Street and Highways Code. SECTION 7. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this 18th day of May, 1985.
