A RESOLUTION OF THE CITY COUNCIL OF' THE
CITY OF MOORPARK, CALIFORNIA, DECLARING
ITS INTENTION TO ORDER THE FORMATION OF
"PARKS MAINTENANCE ASSESSMENT DISTRICT
NO. AD- 85 -1 ", PURSUANT TO THE LANDSCAPING
AND LIGHTING ACT OF 1972; AND FIXING A TIME
AND PLACE FOR HEARING OBJECTIONS THERETO.
WHEREAS, the City Council, by Resolution No. 85- 192 ,
proposed to form a parks maintenance assessment district pursuant
to the provisions of the Landscaping and Lighting Act of 1972
(Part 2, Division 15 of the California Streets and Highways Code);
and
WHEREAS, by said Resolution No. 85- 192 , the City Council
ordered the City Manager to cause to be prepared an Engineer's Report,
pursuant to Article 4, Chapter 1, Part 2, Division 15 of the said
Streets and Highways Code; and
WHEREAS, the Engineer's Report was prepared and filed, and
the same was approved, as amended, by the Council on the 18th day of
May, 1985, by Resolution No. 85 -193;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest and convenience require
and it is the intention of the City Council of the City of Moorpark
to order the formation of "Parks Maintenance Assessment District
No. AD- 85 -1 ", consisting of a single City -wide zone for the maintenance
and improvement of parks and recreational facilites within the city,
pursuant to the Landscaping and Lighting Act of 1972. In addition,
said district is to be formed to levy and collect assessments for
such parks maintenance and improvement in accordance with said Act.
SECTION 2. That said parks maintenance assessment district
shall specifically include the parksite with all improvements
located therein, described by and heretofore included within
"Moorpark Landscape Maintenance Assessment District No. AD- 83 -1 ",
which was formed and confirmed by this City Council by Resolution
No. 83 -44, adopted October 3, 1983, and the above described portion
of said "Moorpark Landscape Maintenance Assessment District No.
AD -83 -1" shall be consolidated with said parks maintenance assess-
ment district, pursuant to the provisions of Section 22585 et seq.
of said Streets and Highways Code.
SECTION 3. That the foregoing described work is to be located
within said Assessment District, the boundary of which is more
particularly described on a map on file in the City Clerk's office

and is entitled, "Boundary Map, City of Moorpark Parks Maintenance
Assessment District No. AD- 85 -1 ", filed in the office of the City Clerk
on the 18th day of May, 1985.
SECTION 4. That the contemplated maintenance and improvement
of parks and recreational facilities, in the opinion of said City
Council, is of benefit to, and the said City Council hereby makes
the expense of the said maintenance and improvement chargeable
upon, the district.
SECTION 5. Reference is hereby made'to the report of the
Engineer on file with the City Clerk and open to inspection, for a
full and detailed description of the improvements, the boundaries
of the Assessment District and any zones therein, and the proposed
assessments upon assessable lots and parcels of land within the
District.
SECTION 6. Notice is hereby given that on the 3rd day of
June, 1985, at the hour of 7:00 p.m., in the Council Chambers in
the City Hall of said City, located at 799 Moorpark Avenue, Moorpark,
any and all persons having any objections to the work or extent
of the assessment district may appear and show cause why said work
should not be done or carried out or why said district should not be
formed in accordance with this Resolution of Intention. Protests
must be in writing and must be filed with the City Clerk prior to
the conclusion of the hearing. Any such protest shall state all
grounds of the objection and if filed by a property owner, shall
contain a description sufficient to identify the property.
SECTION 7. All the work herein proposed shall be done in
accordance with the Landscaping and Lighting Act of 1972, being
Part 2 of Division 15 of the Streets and Highways Code of the State
of California.
SECTION 8. The City Clerk shall cause notice of the hearing
to be given by causing the Resolution of Intention to be published
and mailed in the manner required by Part 2 of Division 15 of the
Streets and Highways Code.
SECTION 9. The City Clerk shall certify to the adoption of
this resolution.
