A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, APPROVING A MAJOR
MODIFICATION-TO RESIDENTIAL PLANNED DEVELOP-
MENT PERMIT NO. PD -851 (PACIFICA AND PARDEE),
INSOFAR AS SAME PERTAINS TO LOTS 2 THROUGH
304 AND LOTS 373 THROUGH 382 OF TRACT NO. 2865
(PARDEE).
WHEREAS, Residential Planned Development Permit No. PD -851
was approved by the County of Ventura prior to the incorporation of the
City of Moorpark, which occurred July 1, 1983; and
WHEREAS, on October 19, 1983, the City Council of the City
of Moorpark adopted Resolution. No. 83 -50, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK APPROVING RESIDENTIAL, PLANNED
DEVELOPMENT PERMIT PD -851 (PACIFICA AND PARDEE)
and placing additional conditions on said Residential Planned Development
Permit PD-851; and
WHEREAS, Pardee Construction Company has submitted an applica-
tion for a major modification to said Residential Planned Development Permit
PD -851, pertaining to the portion of Tract No. 2865 owned by Pardee Construc-
tion Company, being Lots 2 through 304, and Lots 373 through 382; and j
WHEREAS, at a duly noticed public hearing on October '24, 1985,
the Planning Commission of the City of Moorpark considered said application
for a major modification, and by its Resolution No. PC- 85 -66, adopted
November 14, 1985, recommended approval of said major modification to said
PD -851, subject to certain conditions; and
WHEREAS, on December 16, 1985, the City Council of said City
held a duly noticed public hearing on said major modification application,
which hearing had been continued from December 2, 1985, and did also con-
sider the recommendations of the Planning Commission in the matter; and
WHEREAS, at said public hearing oral testimony was given
regarding said application; and
WHEREAS, the City Council is now fully informed in the matter;
has given careful consideration thereto; has determined that the major modifica-
tion will not have a significant effect on the environment and has approved
the Negative Declaration; and has reached its decision in the matter;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK,- CALIFORNIA, DOES RESOLVE AS FOI.LOWS:

SECTION 1. The amendments and deletions hereinafter in this
resolution set forth are applicable only to Lots 2 through 304 and 373 through
382 of Tract No. 2865 (PD -851) .
SECTION 2. That the findings contained in the Staff Report dated
October 24, 1985 ( revised October 30, 1985) , which report is incorporated by
reference as though fully set forth herein, are hereby adopted and approved.
SECTION 3. That Paragraph A of Resolution No. 83 -50, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK APPROVING RESIDENTIAL PLANNED DEVELO-
OPMENT PERMIT PD -851 (PACIFICA AND PARDEE)
adopted by the City Council of said City on October 19, 1983, is hereby amended
to read as follows:
"A. That prior to occupancy, a slumpstone block wall shall be
provided along the exterior side yard of corner lots which abut at the
rear. The walls shall be 4 to 6 feet in height, and, in the event of side
yard slopes, shall be located at the top of the slope. The side yard slopes
shall be planted and irrigated as part of the front yard. Details for these
improvement shall be included with the fencing plans to submitted and
approved in accordance with Condition No. 7 of the permit. All side and
rear lot lines shall be fenced (slumpstone, wrought iron, pilasters and
wrougth iron, etc. ,but no wood) . The fencing plan shall be approved by
the Planning Commission. "
SECTION. 4. That Paragraph B of Section 1 of said Resolution No.
83 -50 is hereby amended to read as follows:
"B. That prior to occupancy, side and/or rear yard fencing shall
be provided by the builder on the north side of all lots adjacent to and
south of Tierra Rejada Road. Where a slope is less than ten (10) feet in
height, a slumpsone wall shall be provided; and where a slope is more than
ten (10) feet in height, wrought iron with slumpstone pilasters shall be
provided, in accordance with the CC &R's. Fencing plans shall be reviewed
and approved in accordance with Condition No. 7 of the permit. All side and
rear lot lines shall be fenced (slumpstone, wrought iron, pilasters and
wrought iron, etc., but no wood) . The fencing plan shall be approved by
the Planning Comission."
SECTION 5. That Paragraphs I, J, K. L, M, N, and P of Section 1
and Section 2 of said Resolution No. 83 -50 are hereby deleted.
SECTION 6. That in all other respects, Resolution No. 83 -50 shall
remain in full force and effect.
SECTION 7. That the major modification to Residential Planned
Development Permit No. PD -851, filed by Pardee Construction Company, which
major modification relates to model home sales complex, change of models (elevation
and - floor_ plans ) and certain conditions of the permit and also to various conditions

thereof, is hereby approved, subject to compliance with all of the conditions set
forth in EXHIBIT A attached hereto and made a part hereof, and does hereby find,
determine and resolve that violation of any such conditions shall be grounds for
revocation of said permit. Said major modification pertains only to Lots 2 through
304 and Lots 373 through 382 of Tract No. 2865 (PD -851) .
SECTION 8. That this resolution shall take effect immediately.
SECTION 9. That the City Clerk shall certify to the passage and
adoption of this resolution.

COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS:
1. Prior to the issuance of a zone clearance, an unconditional "Will Serve"
letter for water and sewer service shall be obtained from Ventura County
Waterworks District #1.
2. The existing masonry/ slumps tone wall along Moorpark Road adjacent to
Lot 376 shall be extended westerly along the northerly boundary of Lot 377
approximately 174 feet from back of sidewalk. The fence along the common
boundary between Lots 378 and 379 and the park site shall be a combination
of slumpstone and wrought iron.
The type or kind of wall surfacing facing the park' side - the north side of
the wall - shall be to the satisfaction of the Parks and Recreation Commission.
The
developer shall be permitted
to install temporary fence /wall
improvements
along Moorpark Road adjacent to the lots used as
part of the model complex.
The
temporary improvements may
include wrought
iron and the
final design
and
location shall be as approved
by the Director
of Community
Development.
The
replacement of the temporary
improvements with permanent
improvements
shall
be included in the bond amount in Condition
No. 5.
3. The proposed underground drain located between Lot 378 and 377 shall be
designed to accept surface water from the adjacent park site. The design
of the facility shall be to the satisfaction of the City Engineer.
Temporary siltation basins shall be provided to eliminate the conveyance of
siltation onto Oakcliff Drive. Said basins shall be maintained by owner and
shall be removed and replaced with permanent drainage facilities upon the
closing of the model home complex. The design of said basins and drainage
facilities shall be subject to the approval of the City Engineer.
4. The existing driveway located approximately 580 feet north of Christian Barrett
Road shall be removed and replaced with standard curb, gutter and sidewalk
to the satisfaction of the City Engineer. The model home complex driveway
shall be constructed to conform to Moorpark Road Standard Plate E -2
(revision B), modified to require a 30 -foot width and 8 -foot radius curb returns.
5. Prior to obtaining a zone clearance for any unit within the model complex, the
developer shall post a bond with the City in the amount of $40,000.00. The
bond is to assure the City that all temporary improvements /access, including
but not limited to lane striping, driveway, curb and gutter and fence /wall
treatment, to the model complex have been removed and replaced with
permanent improvements. The bond shall be released to the developer only
upon replacement of improvements satisfactory to the City Engineer.

A northbound left turn pocket from Moorpark Road into the model home
complex shall be constructed, complete with necessary road widening,
signing, striping and appurtenances. The design of the foregoing shall
provide at a minimum, 100 feet of vehicle storage and a 100 -foot reverse
taper into the left turn pocket, and shall be submitted for review and
approval by the City Engineer. The model home complex entrance off
Moorpark Road shall not be utilized until the left turn construction has been
completed and approved by the City Engineer. Left turn signing and
striping shall be removed within five (5) working days of the closing of the
model home complex. In addition, the driveway entrance shall be removed
and replaced with standard curb, gutter and sidewalk to the satisfaction
of the City Engineer.
In the event that the existing blockade is removed at the interesection of
Oakcliff Drive and Christian Barrett Drive prior to the closing of the model
home complex, a blockade per Moorpark Std. Plate F -1 shall be constructed
across Oakcliff Drive at the southerly property line of Lot 382. Said
blockade design shall be submitted to the City Engineer's office for review
and approval.
6. The construction of an individual lot fencing plan shall not encroach upon
the required or, designated front, rear, or side yard setback area.
7. Gutters and downspouts shall be provided over all garage doors and front
entryways, and all landscaped areas as well, except for gable -end roofs.
8. The location of patio covers and accessory structures shall conform to
"Patio Cover Policy", as adopted by the Moorpark City Council on
May 15, 1985.
9. Prior to obtaining a zone clearance for any unit within RPD -851, the developer
shall submit plans, indicating location and landscaping of collective mailbox
stations, to the Moorpark Postmaster and the Planning Department for review
and approval.
10. Prior to the issuance of a Zone Clearance, the developer shall submit a
fencing plan illustrating a combined slumpstone and wrought iron fence to be
located along the southerly right -of -way line of Tierra Rejada Road. The
fence /wall design is to be consistent with the wall design approved for the
adjacent tract to the east.
The fence /wall is to be completed no later than thirty (30) days following
occupancy of the adjacent dwelling units.

- An increase or decrease of 5% or less to Plans 2, 3 and 4A, an increase
of 5% or less to Plans 4B and 4C, and a decrease of .5% or less to Plan 1
may be approved by the Director of Community Development as a Minor
modification. Changes greater than 5% to items above, or any decrease
to Plans 4B and 4C, or increase to Plan 1, shall be considered as a Major
Modification by the Planning Commission.
SCHOOL DISTRICT CONDITIONS:
12. Prior to issuance of a zone clearance for any dwelling unit within RPD- 851
arrangements shall be made with the Moorpark Unified School District for
payment of all necessary school facilities fees.
ADDITIONAL COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS:
13(a) A decorative slough wall approximately 18" in height shall be constructed
adjacent to the back of sidewalk along the easterly right-of-way of Peach
Hill Road. The wall shall be constructed along the western or rear property
line of Lots 168 (51), 169 (111), 171 (81), 172 (9'), 173 (81), 174 (71), 175 (6'),
176 (41), 177 (41), 178 (4') , and Lot 2 (41) to the satisfaction of the
Director of Community Development.
NOTE: The number in parenthesis adjacent to a lot number is the height
of the building pad above the curb top in adjacent street, or the
difference in elevation between the curb top and the building pad.
(b) Prior to the issuance of the first zone clearance, an easement for land-
scape maintenance purposes for the area generally from the wall at the
rear of the building pad to rear property line shall be offered to and
- accepted by the City for the purpose of landscape maintenance of said
area. Said area shall be incorporated into the Assessment District 84 -2.

(c) Prior to the issuance of the first zone clearance, the developer shall
submit to the City three (3) copies of a landscaping and maintenance plan
prepared by a State licensed Landscape Architect. Landscaping improvements
shall be subject to approval by the Director of Community Development
consistent with the City's applicable landscape standards and guidelines
to provide for permanent landscaping and irrigation systems. The land-
scape improvements shall be installed to the satisfaction of the Director
of Community Development prior to the occupancy of dwelling units on
any of the subject eleven (11) lots. The developer shall be responsible
for the maintenance of the subject slopes for a minimum period of twelve (12)
months after completion of the improvements pursuant to the
approved plans as determined by the Director of Community Development.
The City will accept the maintenance responsibility effective as of the
next July 1 after satisfactory completion of the minimum twelve (12)
month maintenance period. The slopes adjacent to Peach Hill Road and
Tierra Rejada Road maintained by the City's Assessment District shall be
placed in a separate zone. The maintenance of these areas shall be
financed by the property owners within both the Pacifica and Pardee portions
of PD -851 ( Tract 2865) .
14. A decorative slough wall approximately 18" in height shall be constructed
adjacent to the back of sidewalk along the southerly right -of -way of Tierra
Rejada. The wall shall be constructed along the north property line
of Lots 209 (281), 208 (281), 207 (30') , 206 (291), 205 (231), 204 (231),
203 (14'), 253 (11), 252 (5'), 251 (5'), 250 (15'), 249 (211), 248 (251),
246 (36'), 244 (51'), and Lot 242 (651).
15. That no roofing materials other than cement or clay tile be used in
construction. A mix of tile color shall be demonstrated throughout the
project by the use of at least three (3) different colors. The red and burnt
red colors are as approved by the City Council. The third color of dark
brown or slate shall be as approved by the Director of Community
Development.
16. Prior to the issuance of the first zone clearnace for a building permit, the
developer shall complete the following to the satisfaction of the City Engineer:
(A) All required improvements to Peach Hill Road.
(B) Christian Barrett Road:
(1) Pavement testing and completion of any required remedial work.
(2) Weed removal.- -
(3) Upgrading of the school zone, including sidewalk construction and
signing to the east boundary of the school.

(4) Placement of an additional pavement layer from approximately the east
boundary of the Peach Hill School to the intersection of Christian
Barrett with Peach Hill Road.
(5) Installation of a barrier at approximately the east boundary of
Peach Hill School to prevent the use of Christain. Barrett Drive
for through traffic.
(6) Provision of a temporary access for construction related vehicles, to
avoid use of Christian Barrett Drive by construction related
vehicles.
SHERIFF'S DEPARTMENT CONDITIONS:
17. All appliances (microwave ovens, dishwashers, trash compactors, etc.) shall
be properly secured prior to installation during non - working hours. All
serial numbers shall be recorded for identification purposes.
18. Addresses shall be clearly visible to approaching emergency vehicles and
mounted against a contrasting color.
19. All exterior doors shall be constructed of solid wood core minimum of 1 -3/4"
thick.
20. Doors utilizing a cylinder lock shall have a minimum five (5) pintumbler
operation with the locking bar or bolt extending into the receiving guide a
minimum of one inch. All front doors must have single deadbolt lock on
entry door when decorative glass panels are located adjacent to door jambs.
21. All exterior sliding glass doors or windows shall be equipped with metal guide
tracks. at the top and bottom and be constructed so that the window cannot be
lifted from the track when in the closed or locked position.
22. Upon occupancy by the owner or proprietor, each single unit in a tract or
commercial development, constructed under the same general plan, shall have
locks using combinations which are .interchange -free from locks used in all
other separate dwellings, proprietorships, or similar distinct occupancies.
ADDITIONAL CITY COUNCIL CONDITION:
23. That a five (5) foot wide sidewalk shall be constructed adjacent to the curb
along Peach Hill Road between Christian Barrett Road and Tierra Rejada Road.
