A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AMENDING SUBSECTIONS 2.1
OF SECTION 2 AND SUBSECTION 3.1 OF SECTION 3 OF
RESOLUTION NO. 85 -160 OF SAID CITY, PERTAINING
TO RULES OF PROCEDURE FOR COUNCIL MEETINGS.
THE CITY COUNCIL OF THE CIT OF MOORPARK, CALIFORNIA, DOES
RESOLVE AS FOLLOWS:
SECTION 1. That Resolution No. 85 -160, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, ADOPTING RULES OF PROCEDURE
FOR COUNCIL MEETINGS AND RELATED FUNCTIONS AND
ACTIVITIES; AND REPEALING RESOLUTION NO. 83 -61,
ADOPTED DECEMBER 21, 1983
adopted January 16, 1985 is hereby amended as follows:
SECTION 2. That Subsection 2.1 of Section 2 be amended as follows:
"2.1 AGENDA:
"The Order of Business of each meeting shall be as
contained in the Agenda prepared by the City Clerk. The Agenda .
shall be a listing by topic of the subjects which shall be
taken up for consideration in the following order:
"1. Call to Order
2. Pledge of Allegiance
J. Roll Call
4. Approval of Minutes
5. Proclamations, Commendations /Special Presentations
6. Public Comments
7. Public Hearings
8. Ordinances /Resolutions
9. Comments from Councilmembers
10. Staff Reports - Recommended Action Items
11. Staff Reports - Information Items
12. Consent Calendar
13. Future Agenda Items
14. Closed Session (if need to hold a closed session
is known prior to the agenda deadline)
15. Adjournment
"Except with majority consent of the Council, items may
not be taken out of order.
"Any public hearing which is continued from one meeting
to another shall be placed first on the agenda under Public

Hearings, and if more than one, shall appear in the same
order as shown on the_previous agenda. The order of the
agenda under Public Hearings may not be changed without
the consent of all members of the Council present at the
meeting, as well as any applicant affected by such a change.
"No matters other than those on the agenda shall be
finally acted upon by the Council provided; however, that
matters not on the agenda, but deemed to be emergencies or of
an urgent nature by any Councilmember, the City Manager, or
the City Attorney, or such other matters which phall have
been discussed at a preceding study session, may be submitted
for Council consideration and action."
SECTION 3. That Subsection 3.1 of Section 3 be amended as follows:
"3.1 PRESIDING OFFICER:
"The Mayor shall be the-Presiding

"In accordance with Government Code Section 36801, the
Council shall meet on the Tuesday after certification of the
results of each general municipal election (even numbered
years), and shall also meet at the last regular meeting in
November of each odd numbered year, and shall choose one
of its number as Mayor and one as Mayor pro tem. Each selection
shall be by three (3) or more affirmative votes, and a failure to
achieve such total of affirmative votes shall be deemed as selection
of the incumbent(s) to remain in office. Each person so selected
shall serve until a successor is chosen (at any time) by -three
or more affirmative votes.
"If the Mayor resigns the Mayor seat or his /her seat otherwise
becomes vacant, effective immediately, the Mayor Pro Tem shall
become Mayor for the remainder of the one year term and a new
Mayor Pro Tem shall be elected by the City Council for the
remainder of the one'year term.
SECTION 4. That this resolution shall take effect immediately.
SECTION S- That the City Clerk shall certify to the passage and
adoption of this resolution.

No. 86-32 was adopted by the City Council of the City of Moorpark
at a regular meeting thereof held on the 21st day of July
1986, and that the same was adopted by the following roll call vote:
AYES: Councilmembers Yancy- Sutton, Woolard, Prieto,
Hartley and Mayor Ferguson
