HomeMy WebLinkAboutRES CC 1986 340 1986 0902I RESOLUTION NO. 86 -340 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK ADOPTING THE RULES & REGULATIONS GOVERNING THE USE OF THE MOORPARK COMMUNITY CENTER AND THE ATTACHED FEE SCHEDULE. The City Council of the City of Moorpark does hereby resolve as follows: SECTION 1. The attached Rules and Regulations governing the use of the Moorpark Community Center are hereby adopted and shall be in full force and Pffect on or after September 2, 1986. SECTION 2. The attached Fee Schedule for use of the Moorpark Community Center is hereby adopted and shall be in full force and effect on or after September 2, 1986. SECTION 3. The attached Rules and Regulations governing the use of the Moorpark Community Center and attached Fee Schedule does hereby supercede any previously adopted Rules and Regulations and Fee Schedule for the Moorpark Community Center. If any provision of these regu- lations is held invalid or unconstitutional, such declaration shall not effect the validity of the other clauses or provisions of these regu- lations. 102 DEFINITIONS a) "Community Center" shall mean the building at 799 Moorpark Avenue including: front and rear patio, multi - purpose room (large). Room A (smaller), kitchen, foyer and rest rooms.City offices and parking lot. b) "City" - shall mean the City of Moorpark. c) "Person" - means any individual, group, organizatign, association, partnership. firm or corporation. d) "Community Group" - shall mean nonprofit groups and organizations Wherein more than SOx of the members are City residents. e) "Alcoholic Beverages" - shall mean alcohol, spirits, liquor, wine, beer, and every liquid or solid containing one -half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or combined with other substances. f) "Shall" - means mandatory. "May" - means permissive. g) "Amplified Sound" - shall mean sound projected and transmitted by electronic equipment, including amplifiers. h) "Section" - shall mean a section of these regulations unless otherwise stated. i) "Alcohol Use" - shall mean the serving of alcohol to guests or participants. J) "Alcohol Sale" - shall mean the exchange, deliverance, or serving of alcohol for money either by the drink, cover charge, or entry fee. k) "Reserved Use Time" - shall mean the time which any activity participants. lessee contractors, or lessee representatives are in use of the said facility. 103 ENFORCEMENT The City Manager is hereby authorized to implement and administer the policies and regulations contained herein. Duties may be exercised or performed by the City Manager or by any other employee designated by the City Manager. 104 APPLICATIONS The Community Center is available for the use of individuals or groups subject to the issuance of a permit and payment of all fees. All applications must be signed by an adult who shall aorvo — t• responsible for said use. No use permit shall be granted if there is conflict with a prior reservation. Applications are immediately revocable if false statements are made in reserving a facility or if the individual or group willfully violates any rule or regulation established by the City. Fees may be retained in the event the activity is terminated due to violation of any rule or regulation, or the falsification of the application. Requests for use utilizing payment by check shall be made in writ- ing a minimum of 21 days prior to the event. Requests for use utiliz- ing payment by cash shall be made a minimum of 10 days prior to the event. An application requesting use in advance of six months must be-coasidered by the Parks and Recreation Commission for approval. A non - refundable processing fee shall be paid at the time of the reservaton of the facility. 105 EXTENDED USE Any group requesting use on a regular basis extending over several months must make written application to the Moorpark Parks and Recrea- tion Commission. Each extended use permit must be reapplied for after each 6 month period and will be for a maximum of time period of 6 months. i 106 HOURS In no case shall an event finish later than 12 midnight. Exceptions are subject to the approval of the Parks and Recreation Commission. Exceptions are to be applied for in writing a minimum of 10 days prior to the Parks and Recreation Commission meeting at which the application is to be reviewed by the Commission. 107 FEES All fees and deposits are to be set by Resolution of the City Council. The fee schedule for any event will be those in force at the time of the event. Such fees shall apply to all reserved use time. All fees and deposits are due as per the deposit schedule noted in Section 104. 106 ADDITIONAL CHARGES Additional charges will be levied over the basic rate under the following conditions: a) When staff is needed for additional setup. breakdown, or cleanup beyond normal time requirements. b) When additional staff is needed for facility control c) When facility is damaged and /or liability insurance fees are required. d) When alcohol is being served or sold. The determination of requirements for additional personnel and associated charges shall be made by the City Manager or his designa- ted representative. 109 STAFFING City personnel will open and close buildings and grounds and be on duty to supervise the use of the facility. City staff is required to be on the premises at any time the building is in use. The numberof staff required for any event shall be at the discretion of the City Manager or his designated representative and, based of the number of persons in attendance of the activity and /or the type of activity. The cost of having said personnel present shall be the responsibility of the lessor. All staffing is based on a minimum of four hours for any event requiring their presence regardless of length of the activity of rental. Exception to this rule may be made at cne discretion of City staff. 110 SECURITY To ensure proper use and control of facilities and equipment, security guards shall be required under the following conditions: a) When alcohol is being served, sold, or consumed. b) When the event is of such a nature that the City staff determines the necessity for security personnel. Security guards shall be provid- ed from one of the companies of the City's approved list. The lessee shall be responsible for the cost of providing security. A minimum of two security guards are reguired for any event determined to be in need of security personnel. The number of security guards and any additional security measures necessary to protect the general public and City property shall be at the discretion of the City Manager or his designated representative. 111 ALCOHOL The sale. serving, or consumption of alcohol is prohibited in the Community Center except by a group making such a request and all neces- sary permits have been approved and fees paid. Alcohol may not be sold or served, if persons under 21 years of age are present without prior staff approval. A State Alcoholic Beverage Control Board permit is required when alcoholic beverages are sold. Said permit shall be obtained by the person using the facility. 112 AMPLIFIED SOUND SYSTEMS Any amplified sound system shall require an Amplified Sound Permit. Persons using sound amplification equipment shall keep the sound level of such equipment at a reasonable level to avoid disturbing nearby residents. The determination of a reasonable sound level shall be the judgement of the City employee on duty or the local law enforcement agent, and all instructions of such persons shall be complied with immediately. 113 SMOKING Smoking is permitted in the Community Center facility at the discretion of the user provided there is no fire hazard created by the smoking activity_ Such determination shall be made by City staff. Lessee is required to provide its own ashtrays. Cigarette butts and burns may result in loss of cleaning deposit. 114 CLEAN UP Clean up shall be charged to the lessee as actual time required for services with the minimum charge of one hour of clean up. Exception to this rule may be made at the discretion of City staff. 115 DECORATIONS Decorations are restricte and /or designated beam areas. prior approval by City staff. Any event exceeding these limits are subject to immediate closure and retention of all fees and deposits. 117 RIGHT OF APPEAL Any applicant may appeal a decision of City staff personnel regarding additional charges and /or retention of deposits. The lessor or applicant must file said appeal with the City of Moorpark within five (5) days of notification of the related decision.. The City Manager or designee shall affirm or deny the appeal within (10) working days of receipt of said appeal. Any further appeal must be made in writing to the Parks and Recreation Commission within 10 days of the City's decision on the appeal. 118 LIABILITY All persons to whom use permits are granted must agree in writing to hold the City harmless and indemnify City from any and all liability for injury to persons or property occurring as the result of the activity sponsored by lessee, and said person shall be liable to the City for any and all damages to parks, equipment, and buildings owned or controlled by City which result from the activity of lessee or is caused by any participant in said activity. A person exercising any or the privileges authorized by this policy does so at his /her own risk without liability on the part of the City of Moorpark for any injury to persons or property resulting therefrom. The City may require proof of liability insurance with limit of bodily injury and property damage of not less than $100,000 and a certificate of co- insurance for any individual or group when it is determined that: a) Liquor is to be sold and /or served can City property and b) The proposed activity is determined by City staff to warrant the need for such insurance. 119 DEPOSITS A refundable deposit will be required for any event held at the Community Center. The amounts of deposits shall be set by resolution of the City Council as part of the Community Center Fee Schedule. The deposit may be used for clean up of facilities, any damages to premises, and any additional staffing Got included in fees paid. Should charges exceed the amount on deposit, lessor shall be billed for the difference and allowed thirty (30) days in which to make payment. 120 REFUNDS Refunds of deposits are contingent upon meeting all the requirements for the rental of facility. Any amount remaining in the deposit following the payment of all charges shall be refunded to the person listed on the application. 121 COMPLAINTS All complaints must be in writing and sent to: City of Moorpark Parks and Recreation Department 799 Moorpark Avenue Moorpark, CA 93021 122 EMERGENCIES Days, 8:30 a.m. to 5:00 p.m., contact City Hall at (805)529 -6864.
