A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DENYING THE APPLICATION OF G.H. PALMER AND
ASSOCIATES FOR PLANNED DEVELOPMENT PERMIT NO. PD -1014.
ASSESSOR PARCEL NO. 511- 08 -1.9 -, -20, -21, -24, -25, -26,
-31, and -32.
WHEREAS, at a duly notice public hearing on December 3, 1986, the
Moorpark Planning Commission considered the application filed by G.H. Palmer
and Associates,requesting the approval of 287 residential apartment units located
on a portion of a 30.51 acre site between Poindexter Avenue and Los Angeles
Avenue and east of Sierra Avenue, and an associated Parcel Map (LDM -9); and
WHEREAS, after careful consideration, the Planning Commission reached
its decision in the above matters, as is set forth in its Resolution Nos. PC -86 -121
& PC -86 -122 adopted December 15, 1986, recommended denial of the G.H. Palmer
and Associates Planned Development Permit No. PD -1014 request and denied Parcel
Map LDM -9; and
WHEREAS, the City Council reviewed and considered the contents
of the Final Environmental Impact Report, considered the Planning Commission's
recommendation, and has reached its decision on the matter; and
WHEREAS, pursuant to the requirements of Article 5 of Chapter 3
of Title 7 (beginning at Section 65300) of the Government Code of the State
of California ( "The Planning and Zoning Law "), the City of Moorpark has adopted
a General Plan; and
WHEREAS, public notice having been given in time, form and manner
as prescribed by law, the City Council of the City of Moorpark has taken testimony
regarding said property, has duly considered the entitlement applied for, and
has reached its decision;
NOW, THEREFORE, THE CITY COUNCIL. OF THE CI'T'Y OF MOORPARK, CALIFORNIA,
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby adopts by reference the findings
contained in the Resolution of the Planning Commission regarding the proposed
Planned Development herein with the exception of fact #A -3 of Section 2, and
the additional facts that the EIR does not: 1) adequately address school finance
law to be effective January 1, 1987 that would be in effect when the project
would expect to be constructed; 2) adequately address the growth inducing impacts
to the existing single - family subdivision between the westerly industrial land
use and multi - family high density; and 3) include the comments by the Neighborhood
Council No. 1 and other public comments given at the public hearing on the
EIR;
SECTION 2. That the certification of the E1R for Planned Development
Permit No. PD -1014 is denied and the applicantion of G.H. Palmer and Associates
for Planned Development Permit No. PD -1014 is hereby denied without prejudice.
SECTION 3. That this Resolutioni shall take effect immediately.

SECTION 4. That the Citv Clerk shall certify to the adoption of
this Resolution and shall cause this Resolution and his certification to be
filed in the office of the City Clerk.
