HomeMy WebLinkAboutRES CC 1986 268 1986 0203RESOLUTION NO. 86- 968 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING RESOLUTION NO. 83 -54 OF THE CITY OF MOORPARK, AND APPROVING A MAJOR MODIFICATION TO RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. RPD -857; AND APPROVING REVISED TENTATIVE TRACT NO. TR -4170 (FORMERLY TR- 3070 -5) ON APPLICATION OF U. S. CONDOMINIUM CORPORATION. WHEREAS, Residential Planned Development Permit No. RPD -857 was approved by the County of Ventura prior to the incorporation of the City of Moorpark, which occurred July 1, 1983; and WHEREAS, on November 16, 1983, the City Council of the City of Moorpark adopted Resolution No. 83 -54, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING RESIDENTIAL PLANNED DEVELOPMENT PERMIT PD -857, PHASES III, IV AND V (U. S. CONDOMINIUM) and placing additional conditions on said Residential Planned Development Permit PD -857; and WHEREAS, U. S. Condominium Corporation has submitted an applica- tion for a major modification to said Residential Planned Development Permit PD -857, and approval of a new Tentative Tract map, designated as TR -4170 (formerly TR- 3070 -5), the subject property being located north of and adjacent to the intersection of Princeton Avenue and Campus Park Drive, within said City; and WHEREAS, at duly noticed public hearings held on November 14 and December 11, 1985, the Planning Commission of the City of Moorpark considered said application for a major modification and said proposed revised Tentative Tract No. TR -4170 (formerly TR- 3070 -5), and by its Resolution No. PC -85 -72 recommended approval thereof, subject to certain conditions; and WHEREAS, on January 6, 1986, the City Council of said City held a duly noticed public hearing on said major modification application and said revised tentative tract, and did also consider the recommendations of the Planning Commission in the matter; and WHEREAS, at said public hearing oral testimony was given regarding said application; and WHEREAS, the City Council is now fully informed in the matter; has given careful consideration thereto; has determined that the major modification requested and the revised Tentative Tract No. TR -4170 (formerly TR 3070 -5) -1- do not necessitate the preparation of a subsequent environmental document because the modifications and revisions contained therein will not result in new significant environmental impacts; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the findings contained in the staff reports dated November 14 and December 23, 1985, are hereby adopted, and said reports are incorporated herein by reference as though fully set forth. SECTION 2. That insofar as the same pertain to this Major Modification application and Revised Tentative Tract No. TR -4170 (formerly 3070 -5), the following amendments to Resolution No. 83 -54, entitled as hereinabove in the preamble of this resolution set forth, shall apply: A. Condition No. 7 of said Resolution No. 83 -54 shall read as follows: "That on single family dwelling units, at a minimum, entry -way fencing shall be no closer to the street than the entrance to the dwelling unit for those units which have an adjacent downhill slope four feet or greater in height, unless said fence is no greater than 42" in height. " B. Condition No. 9 of said Resolution No. 83 -54 shall read as follows: "That all permanent down drains shall be colored to an earth tone to blend into the hillside. Color to be uniform throughout and selected from standard colors provided from the manufacturer of applied concrete stain." C. That Condition No. 15 of Resolution No. a3 -54 be deleted. D. That Condition No. 19 shall read as follows: "That PD -857 shall be extended to December 31, 1987." E. That Condition No. 20 shall read as follows: That all composition materials to be used for all dwellings within Phase V shall conform to the following classification: (1) Class A, 300 lbs . , 30 years (Johns Mansville "Woodland ", GAF "Timberland" or equivalent) If composition material conforming to the condition is no longer manufactured, or otherwise not available, the Director of Community Development may approve an alternative composition material." F. That Condition No. 21 shall read as follows: -2- "That it is the intent of the City that PD -857 shall be subject to any rule, regulation, policy, ordinance or resolution relating to the public health or safety that may be adopted subsequent to this Resolution, including any enactment to maintain consistency with the County Air Quality Management Program. It is also the intent of the City that PD -857 be exempt from any roofing or side materials ordinance, or any other ordinance intended to regular aesthetics. " SECTION 3. That in all other respects, Resolution No. 83 -54 shall remain in full force and effect. SECTION 4. That the major modification to Residential Planned Development Permit No. PD -857, and Revised Tentative Tract No. TR -4170 (formerly TR- 3070 -5), are hereby conditionally approved, subject to compliance with all the conditions attached hereto, and the City Council does hereby find, determine and resolve that violation of any such conditions shall be grounds for revocation of said permits. SECTION 5. That this resolution shall take effect immediately. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution. Condominium DATE: February 3, 1986 PAGE: 1 COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS: l.. The conditions of approval of this Tentative Map supersedes all conflicting notations, specifications, dimensions, typical sections and the like which may be shown on said map . 2. That all requirements of any law or agency of the State, Ventura County, City of Moorpark or any other governmental entity shall be met. 3. Recordation of this subdivision shall be deemed to be acceptance by the property owner(s) of all conditions of said map. 4. All utlities shall be placed underground. 5. That prior to obtaining a grading permit, the Director of Community Development shall approve the grading plans. 6'. Interior noise levels of dwelling units on Lots. 408 and 486, and applicable townhouse units, shall be attenuated in conformance with the noise insulation standards of Chapter 1, Article 4, Section 1092 of Title 25 of the California Administrative Code. Noise source levels shall be based upon the 1990 traffic volumes. projected along Campus Park Drive and in the Environmental Impact Report for this project. Determination as to whether the architectural design for these dwelling units complies with this condition shall be made by the Building and Safety Department prior to the issuance of building permits. 7. That in order to protect the public safety and prevent groundwater pollution, any abandoned wells on the property shall be destroyed in accordance with City of Moorpark standards. 8. Cross-connection control devices shall be installed on the water system in accordance with the requirements of the Ventura County Division of Environmental Health. 9. Prior to recordation, an Unconditional Availability Letter shall be obtained from County Waterworks District #1 for sewage and water service for each lot created. Said letter shall be filed with the Department of Community Development. Or if said Unconditional Availability Letter, in a form satis- factory to the City, cannot be obtained from the County Waterworks District, the developer shall execute a Subdivision Sewer Agreement, in a form satisfactory to the City. Said agreement will permit deferral of the unconditional guarantee for sewer and water service until issuance of a building permit for each lot in the subdivision. - _ 10. - Prior to recordation, the applicant shall pay all fees pursuant to the City of Moorpark Municipal Code, Sections 8297-4 et seq. , for the purpose of _ providing fees in lieu of-land dedication_for local park acquisition and/or - development of park facilities For the--future residents of the subdivision. CONDITIONS FOR: Tract 4170 APPLICANT: U. S. Condominium DATE: February 3, 1986 PAGE: 2 FIRE DEPARTMENT CONDITIONS 11. That prior to construction, the permittee shall submit plans to the Ventura County Fire Protection District for approval of the size and location of fire hydrants. 12. That a minimum fire flow of 1000 gallons per minute is required at this location. Fire hydrants shall be installed and serviceable prior to construction and shall conform to the minimum standards of the Ventura County Waterworks Manual. (a) Each hydrant shall be a 6" wet barrel design, and shall have one 4" and one 2" outlet. (b) Fire flow shall be achieved at no less than 20 psi residual pressure. (c) Fire hydrants shall be spaced 300 feet on 'center, and so located that no structure will be further than 150 feet from any one hydrant. (d) Fire hydrants shall be 24" on center recessed in from curb face. 13. All grass or brush surrounding any structures shall be cleared prior to framing, according to the Ventura County Weed Abatement Ordinance. 14. Address numbers shall be of contrasting color to the background, and shall be readily visible at night. The numbers shall be subject to approval by the Director of the Community Development and the Fire Chief. 15. Fire extinguishers in the community buildings shall be installed in accordance with National Fire Protection Association Standard #10. 16. Portions of this tract are in Fire Zone Four (4) and shall meet Building Code requirements for the brush zone. 17. Street names shall be submitted to the Fire Department for approval prior to their recordation. 18. Street signs shall be installed prior to occupancy. 19. An approved spark arrester shall be provided for each chimney. 20. A private driveway serving two or less homes with exterior walls greater than 150 feet from the public roadway shall be constructed 15 feet wide and able to accommodate a 20-ton fire-fighting apparatus. - 21. Access roads to open areas shall be_subject to Fire Department approval. CONDITIONS FOR: Tract 4170 APPLICANT: U. S. Condominium DATE: February 3, 1986 PAGE: 3 CITY ENGINEER CONDITIONS 22. All public roads within the tract, including Campus Park Drive, shall be dedicated on the tract map as required, and improved to include concrete curb and gutter, street lights, sidewalks, traffic signs and striping, and paving according to City and applicable standards. Prior to recordation, the developer shall submit to the City of Moorpark improvement plans prepared by a Registered Civil Engineer, shall enter into an agreement with the City of Moorpark to complete the improvements, and shall post bonds in the amount to be approved by the City Engineer guaranteeing construction of improvements. The applicable City of Moorpark standard plates are as follows: Plate B-4A: Marymount Street, Loyola Street. Plate B-4B: Queens Court, Luther Court, Trojan Court, Wheaten Court. Campus Park Drive shall be constructed as follows (refer to Exhibit "A" for conceptual sketch): East of the Princeton Avenue ECR, Campus Park Drive has been constructed per Plate B-2B. West of the Princeton Avenue ECR, the street shall be constructed such that the full width improvements taper down to 34 feet of paving on 43.5 feet of right-of-way at a point approximately 450 feet west of the Loyola Street centerline. Lane-drop signing and striping shall be installed per CalTrans standards east of Princeton Avenue. Smooth transitions between Princeton Avenue and Loyola Street shall provide the following: At Loyola Street, a 5-foot bike lane eastbound, a 12-foot travel lane eastbound, a 10-foot left turn pocket westbound, a 12-foot travel lane westbound, and a 5-foot bike lane westbound; at Princeton Avenue, an 8-foot bike lane eastbound, two 12-foot travel lanes eastbound, a 10-foot ± striped median lane, a 22-foot ± travel lane westbound, and an 8-foot bike lane westbound. An 8-foot sidewalk shall be constructed on the north side of Campus Park Drive east of Loyola Street. The right-of-way lane on the north side of Campus Park Drive between Loyola Street and Princeton Avenue shall be at the back of sidewalk. Smooth transitions west of Loyola Street shall provide the following: At Loyola Street, a 5-foot bike lane eastbound, a 12-foot travel lane easbound, a 10-foot left turn pocket eastbound, a 12-foot - — - — travel lane westbound, and a- 5-foot bike lane westbound; at a - point approximately 450 feet west of Loyola Street centerline, a CONDITIONS FOR: Tract 4170 APPLICANT: U. S. Condominium DATE: February 3, 1986 PAGE: 4 5-foot bike lane eastbound, a 12-foot travel lane eastbound, a 12-foot travel lane westbound, and a 5-foot bike lane westbound. The right-of-way line on the north side of Campus Park Drive west of Loyola Street shall be 1.5 feet behind face of curb or behind the flood control drainage structure, whichever is appropriate as determined by the City Engineer. 23. Prior to issuance of a building permit, the developer shall deposit with the Cityof Moorpark a contribution for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit shall be the current Los Angeles Area of Contribution applicable rate at the time the building permit is issued. 24. In conjunction with recordation, the developer shall dedicate to the City on the final map the access rights adjacent to Campus Park Drive along the entire frontage of the property, except for approved access roads as delineated on the approved tentative map. 25. Prior to recordation, grading plans and hydraulic calculations shall be sub- mitted to the City Engineer for approval. So that building pads, street rights-of-way and streets are protected from 100-, 50-, and 10-year storms, respectively, drainage plans and calculations shall indicate the following conditions before and after development: Quantities of water, rates of flow, major water courses, drainage areas and patterns, diversions, collection systems and drainage course. 26. Prior to recordation of each phase of development, developer shall submit improvement plans for water and sewer facilities prepared by a Registered Civil Engineer, shall enter into an agreement with the Ventura County Waterworks District No. 1 to complete the improvements, shall obtain water and sewer "Unconditional Will Serve" letters, and shall post a bond in an amount approved by the District guaranteeing construction of improvements. 27. Prior to the issuance of a building permit for any dwelling unit in the tract the developer shall pay Moorpark County Sanitation District necessary fees for sewage treatment purposes precedent to receiving sewage treatment capacity, shall enter into an appropriate agreement, and shall obtain an "Unconditional Will Serve" letter from Waterworks District No. 1, agent for Moorpark County Sanitation District. 28. Ornamental streetlight standards shall be installed; and all energy charges shall be paid by developer until the area appears on service area tax rolls and for the first year thereafter, over and above anticipated tax revenue. 29. Cut and fill slopes shall be maximum 2:1, except for minor slopes less than _ five (5) feet in height and approved by the-City Engineer and the - - — - -Developer's Soils Engineer. - - -- 1 CONDITIONS FOR: Tract 4170 APPLICANT: U. S. Condominium DATE: February 3, 1986 PAGE: 5 30. That remedial grading based on additional geotechnical investigation, as required by the City Engineer, shall be incorporated in the grading plans of each phase of development. 31. Lot-to-lot drainage easements and secondary drainage easement shall be delineated on the final map. Assurance shall be provided to the City Engineer that these easements will be adequately maintained by property owners to safely convey storm water flows. 32. Developer shall round off all daylight lines and hillside grading to blend in with existing ground. This rounding shall apply only to areas which will not interfere with terrace drains and down drains. 33. If the grading operation occurs during the rainy season (between October and April), an erosion control plan shall be submitted along with the grading plan. Along with the erosion control measures, hydroseeding of all graded slopes shall be required within 60 days of completion of grading. MOORPARK UNIFIED SCHOOL DISTRICT 34. The developer shall construct a bus turnout at the north side of Campus Park Drive, between Loyola Street and Princeton Avenue, to the satis- faction of the City Engineer. 35. Prior to the issuance of a building permit for any dwelling unit. payment of school facilities fees shall be made pursuant to Article 4, Chapter 9 of the Moorpark Municipal Code. CITY COUNCIL CONDITIONS 36. A decorative slough wall approximately 18" in heighrshall be constructed adjacent to the back of sidewalk along the easterly right-of-way of Campus Park Drive. The wall shall be constructed along the west property line of Lots 408 and 464, as determined by the City Engineer 37. Prior to issuance of a zone clearance for any unit within Tract No. TR-4170 (formerly TR-3070-5), the developer shall submit plans indicating location and landscaping of collective mailbox stations to the Moorpark Postmaster and the Department of Community Development for review and approval. 1 _ _
