HomeMy WebLinkAboutRES CC 1986 354 1986 1117RESOLUTION NO. 86- 354 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION, CONSOLIDATED WITH THE STATEWIDE GENERAL ELECTION HELD IN THE CITY ON NOVEMBER 4, 1986, AND DECLARING THE RESULTS AND SUCH OTHER MATTERS AS REQUIRED BY LAW. WHEREAS, a Special Municipal Election was held and conducted in the City of Moorpark, California, on Tuesday, November 4, 1986, as required by law; and WHEREAS, notice of the election was duly and regularly given in time, form and manner as provided by law, voting precincts were properly established, election officers were appointed, and in all respects, the election was held and conducted and-`the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 86- 272 , adopted February 3, 1986, the County Clerk of Ventura County canvassed the returns of the Special Municipal Election held to consider Estab- lishing a Residential Development Management System, and the County Clerk has certified the results to this City Council, and the results are received, attached and made a part hereof as "Exhibit A "; and WHEREAS, pursuant to Resolution No. 86- June 2, 1986, the County Clerk of Ventura County returns of the Special Municipal Election held to a Development Agreement, and the County Clerk has results to this City Council, and the results are and made a part hereof as "Exhibit A "; and 310 , adopted canvassed the consider Approving certified the received, attached WHEREAS, pursuant to Resolution No. 86- 322 , adopted July 7, 1986, the County Clerk of Ventura County canvassed the returns of the Special Municipal Election held to consider Adoption of a Measured Growth Plan, and the County Clerk has certified the results to this City Council, and the results are received, attached and made a part hereof as "Exhibit A "; and WHEREAS, pursuant to Resolution No. 86- 324 , adopted July 7, 1986, the County Clerk of Ventura County canvassed the returns of the Special Municipal Election held to consider Filling the Remainder of the Term of the Vacated City Council Seat, and the County Clerk has certified the results to this City Council, and the results are received, attached and made a part hereof as "Exhibit A "; -1- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the measure voted upon at the Special Municipal Election is as follows: Shall the Initiative Ordinance entitled: "Proposed Initiative Ordinance an Ordinance Establishing a Residential Development Management System of the City of Moorpark" be adopted? That the whole number of votes cast in the City, except absent voter ballots was 4,249 That the whole number of absent voter ballots cast in the City was 443 , making a total of 4,692 votes cast in the City on this measure. That the number of votes given in the City for and against the measure were as listed in Exhibit "A" attached. The City Council does declare and determine that as a result of the election, a majority of the qualified voters voting on the measure did vote in favor of it, and that the measure was carried, and shall be deemed adopted and ratified. SECTION 2. That the measure voted upon at the Special Election is as follows: Shall Ordinance No. 69, entitled: "An Ordinance of the City of Moorpark, California, Approving a Develop- ment Agreement Between the City and UWC Moorpark Investors (Planned Community No. 3)" passed by the City Council, become effective? That the whole number of votes cast in the City, except absent voter ballots was 4,249 That the whole number of absent voter ballots cast in the City was 443 , making a total of 4,692 votes cast in the City on this measure. That the number of votes given in the City for and against the measure were as listed in Exhibit "A" attached. The City Council does declare and determine that as a result of the election, a majority of the qualified voters voting on the measure voted against it, and that the measure did not carry and shall be deemed to have failed. SECTION 3. That the measure voted upon at the Special Municipal Election is as follows: "Shall an ordinance entitled: "An Ordinance of the City Council of the City of Moorpark, Adopting a Measured Growth Plan" be enacted by the City Council? -2- That the whole number of votes cast in the City, except absent voter ballots was 4,249 . That the whole number of absent voter ballots cast in the City was 443 , making a total of 4,692 votes cast in the City on this measure. That the number of votes given in the City for and against the measure were as listed in Exhibit " A " attached. The City Council does declare and determine that as a result of the election, a majority of the qualified voters voting on the measure voted against it, and that the measure did not carry and shall be deemed to have failed. SECTION 4. That the names of persons voted for at the Special Municipal Election for members of the City Council to fill the remainder of the term of the vacated office are as follows: JOHN GALLOWAY BILL LaPERCH JAMES KEENAN TOM SCHLEVE That the whole number of votes cast in the City, except absent voter ballots was 4,249 That the whole number of absent voter ballots cast in the City was 443 making a total of 4,692 votes in the City. That the number of votes given at each precinct and the number of votes given in the City to each such persons above named for the respective offices for which the persons were candidates, were as listed in Exhibit " A " attached. The City does declare and determine that: JOHN GALLOWAY was elected as Member of the City Council of the City for the term of two years; The City Clerk shall immediately make and deliver to the person so elected a Certificate of Election signed by the City Clerk and duly authenticated. The City Clerk shall also administer to the person elected the Oath of office prescribed in the State Constitution of the State of California and shall have him subscribe to it and file it in the office of the City Clerk. The person so elected shall then be inducted into the respective office to which he has been elected. SECTION 5. The City Clerk shall the City Council of the City, a statement Special Municipal Election, showing: -3- enter on the records of of the result of the (1) The whole number of votes cast in the City; (2) The measures voted upon; (3) The number of votes given at each precinct for and against the measure; (4) The number of votes given in the City for and against the measure. (5) The names of the persons voted for and what office each person was voted for; (6) The number of votes given at each precinct for each person; (7) The number of votes given in the City for each person. SECTION 6. That the City Clerk shall certify to the passage and adoption of this Resolution and shall enter it into the book of original Resolutions.
