HomeMy WebLinkAboutRES CC 1987 407 1987 0715RESOLUTION NO. 87 - 407 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, NOVEMBER 3, 1987, FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE OFFICER NAMED IN THE RECALL PETITION SHALL BE RECALLED, AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF VENTURA CONSOLIDATE SAID SPECIAL MUNICIPAL ELECTION WITH THE REGULAR ELECTION TO BE HELD BY THE MOORPARK UNIFIED SCHOOL DISTRICT ON SAID DATE, PURSUANT TO SECTION 27231 OF THE ELECTIONS CODE AND AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES. WHEREAS, on July 8, 1987 there was filed with the City Clerk of said City a recall petition asking for the recall of Thomas C. "Bud" Ferguson from the office of Councilman of the City of Moorpark; and WHEREAS, Section 27211 of the Elections Code provides that should a recall petition shall be signed by a number equal to not less than twenty -five percent (25 %) of registered voters of the City, the recall qualifies for the ballot; and WHEREAS, at the City Council meeting of July 15, 1987, the City Clerk presented a certification of said recall petition dated July 8, 1987, signed by Richard D. Dean, County Clerk, County of Ventura, certifying that 1,841 signatures on said petition had been found sufficient and that 329 signatures had been disqualified; and WHEREAS, Section 27230 of the Elections Code provides that should a certificate of sufficiency be received, the City Council shall issue an order stating that an election shall be held to determine whether or not the officer named in the petition shall be recalled. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to general law cities within the State, and pursuant to the provisions of Section 27230 of the Elections Code of said State, there is called and ordered held in the City of Moorpark, California, on Tuesday, November 3, 1987, a Special Municipal Election of the qualified electors of the City for the purpose of determining whether or not the officer named in the petition shall be recalled. SECTION 2. That the ballots to be used at the election shall be, in form and content, such as may be required by law to be used in the election. SECTION 3. That the City Clerk of the City is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 4. That the polls for the election shall be open at seven (7:00) o'clock a.m. of the day of the election and shall remain open continuously from that time until eight (8:00) o'clock p.m. of the same day, when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 5. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding a municipal election in the City. SECTION 6. That notice of the time and place of holding the election is given, and the City Clerk is authorized, instructed and directed, to give such further or additional notice of the election in time, form and manner required by law. SECTION 7. That pursuant to the requirements of Sections 23300 and 27231 of the Elections Code, the Board of Supervisors of the County of Ventura is hereby requested to consent and agree to the consolidation of said special municipal election with the regular election to be held by the Moorpark Unified School District on Tuesday, November 3, 1987. SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of originAl resolutions. PASSED AND ADOPTED this 15th day of July, 1987.
