A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A
SPECIAL MUNICIPAL ELECTION, TO BE HELD IN THE CITY ON
TUESDAY, JUNE 7, 1988 FOR THE SUBMISSION OF A QUESTION OR
MEASURE TO THE QUALIFIED ELECTORS OF THE CITY, RELATING
TO CHANGING THE APPROPRIATIONS LIMIT OF THE CITY OF
MOORPARK FOR FISCAL YEARS 1986/87 THROUGH 1989/90 TO BE
EQUAL TO THE PROCEEDS OF TAXES RECEIVED BY THE CITY WITH
THE ADDITIONAL AVAILABLE PROCEEDS TO BE USED TO MAINTAIN
ESSENTIAL CITY SERVICES AND TO SUPPLEMENT THE CITY'S
CAPITAL IMPROVEMENTS BUDGET FOR POLICE, STREETS AND
PARKS; AND REQUESTING THE BOARD OF SUPERVISORS OF THE
COUNTY OF VENTURA TO CONSOLIDATE SAID SPECIAL MUNICIPAL
ELECTION WITH THE STATEWIDE PRESIDENTIAL PRIMARY ON SAID
DATE, PURSUANT TO SECTION 23302 OF THE ELECTIONS CODE.
WHEREAS, pursuant to Section 4017 of the Elections Code, the City
Council of the City of Moorpark may submit to the voters, without a petition
therefor, the enactment of an ordinance to be voted upon at a special city
election.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That pursuant to the requirements of the laws of the
State of California relating to General Law Cities within the State of
California, and pursuant to the provisions of Section 4017 of the Elections
Code of said State, there is called and ordered held in the City of
Moorpark, California, on Tuesday, June 7, 1988, a Special Municipal Election
of the qualified electors of the City for the purpose of submitting to said
qualified electors said question or measure changing the appropriations
limit of the City of Moorpark for fiscal years 1986/87 through 1989/90 to be
equal to the proceeds of taxes received by the City with the additional
available proceeds to be used to maintain essential City services and to
supplement the City's capital improvements budget for police, streets and
parks.
Section 2. That the City Council, pursuant to its right and
authority, does order submitted to the qualified electors of the City at the
Special Municipal Election hereinabove called to be held, the following
question or measure:
Shall an Ordinance be adopted changing the
appropriations limit of the City of Moorpark
for fiscal years 1986 -87 through 1989 -90 to YES
be equal to the proceeds of taxes received
by the City with the additional available
proceeds to be used to maintain essential
City services and to supplement the City's
capital improvements budget for police,
streets, and parks? This change in the NO
appropriations limit will not cause an
increase in the property tax rate.
A mark placed in the voting square, rectangle or other specified voting
space after the word "yes" in the manner provided shall be counted in favor
of the adoption of the question. A mark placed in the voting square,
rectangle or other specified voting space after the word "no" in the manner
provided shall be counted against the adoption of the question.
Section 3. That notice of the time and place of holding the special
election is given and the City Clerk is authorized, instructed and directed
to give such further or additional notice of the election, in time, form and
manner as required by law.
Section 4. That pursuant to the requirements of Section 23302 of
the Elections Code, the Board of Supervisors of the County of Ventura is
hereby requested to consent and agree to the consolidation of said Special
Municipal Election with the Statewide Presidential Primary on Tuesday, June
7, 1988.
Section 5. That said Board of Supervisors is hereby requested to
issue instructions to the County Clerk to take any and all steps necessary
for the holding of said consolidated election.
Section 6. That the City Clerk of the City is authorized,
r irctriir +ed and directed to procure and furnish any and all official ballots,
notices, printed matter and all supplies, equipment and paraphernalia that
may be necessary in order to properly and lawfully conduct the election.
Section 7. That the ballots to be used at the election shall be, in
form and content, such as may be required by law to be used in the election,
and that said election shall be held in all respects as if there were only
one election, and only one form of ballot shall be used.
Section 8. That the polls for the special election shall be open at
seven o'clock a.m. of the day of the election, and shall remain open
continuously from that time until 8:00 o'clock p.m. of the same day, when
the polls shall be closed, except as provided by law for holding municipal
elections in the City.
Section 9. That in all particulars not recited in this resolution,
the special election shall be held and conducted as provided by law for
holding municipal elections in the City
Section 10. That the City Clerk of the City of Moorpark is hereby
directed to file a certified copy of this resolution with the Board of
Supervisors and the County Clerk of the County of Ventura.
Section 11. That the City Clerk shall certify to the passage and
adoption of this Resolution and shall enter it into the book of original
Resolutions of said City.

hereby certify under penalty of perjury, that the foregoing Resolution No.
88 -446 was adopted by the City Council of the City of Moorpark at their
meeting thereof held on the 10th day of February, 1988, and that the same
was adopted by the following vote:
AYES: Councilmembers Brown, Harper, Lane and Mayor Galloway.
NOES: None.
ABSENT: None.
ABSTAIN: None.
