Home My WebLink AboutRES CC 1988 457 1988 0316RESOLUTION NO. 88- 457 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTENTION TO ABANDON CERTAIN PARK LAND. WHEREAS, the County of Ventura received certain land now known as Assessor's Parcel Number 500 -0- 281 -073 on September 29, 1976 for park purposes; said land is shown on Exhibit "A" attached hereto; and WHEREAS, upon incorporation of the City of Moorpark, title to said land should have been transferred to the City but was inadvertently not transferred; and WHEREAS, upon discovery of the above referenced oversight, the County of Ventura transferred said land to the City of Moorpark in November of 1987; and WHEREAS, Varsity Park Estates, a California General Partnership (Developer) received approval of Tentative Tract Map No. 3049 on November 3, 1986 which included the subject land within the Map's boundaries; and WHEREAS, the terrain of the subject land exceeds 20% slope, has poor access and is in an isolated location relative to the residents of the City; and WHEREAS, the subject land has not been used for park purposes, no consideration has been paid for the land, and no public funds have been expended to improve the land as a park. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Pursuant to Government Code Section 38501, et. seq., the City Council of the City of Moorpark declares its intention to abandon the park land described in attached Exhibit "A" and sets the time of 7:00 p.m. on April 20, 1988 to consider objections to the proposed abandonment. SECTION 2. Directs the City Manager to implement the publication and posting requirements of this resolution.
