HomeMy WebLinkAboutRES CC 1989 564 1989 0517RESOLUTION NO. 89- 564 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING RESOLUTION NO. 86 -263 FOR THE PURPOSE OF EXTENDING THE TIME OF RECORDATION AND APPROVAL OF ADDITIONAL CONDITIONS FOR TRACT 4081 (COLMER). WHEREAS, on January 6, 1986, the City Council of the City of Moorpark adopted Resolution No. 86 -263 entitled: A RESOLUTION OF THE CITY COUNCIL OF MOORPARK, CALIFORNIA, APPROVING TENTATIVE TRACT NO. TR -4081, ON APPLICATION OF FRANK M. CHADWICK. WHEREAS, the City Council desires to extend the time of recordation and require additional conditions to Resolution No. 86 -263; WHEREAS, at a regularly scheduled meeting on May 3, 1989, the City Council of said City as an agenda item discussed this time extension and these additional conditions; WHEREAS, the representative of developer /owner of the project, Colmer Development Company, stated on the record at the May 3, 1989 City Council meeting his acceptance of the amended and additional conditions of approval; WHEREAS, the City Council has been duly informed in the matter; has given careful consideration thereto; has determined that the time extension and additional conditions requested do not necessitate the preparation of a subsequent environmental document because the time extension and additional conditions contained therein will not result in new significant environmental impacts: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the additional conditions to Resolution No. 86 -263 described in Exhibit 1 (attached) and the revised Tentative Map dated April, 1989 are hereby approved. SECTION 2. That the time of recordation for Tract Map 4081 of Resolution 86 -263 be extended to January 6, 1990. SECTION 3. That in all other respects, Resolution No. 86 -263 shall remain in full force and effect. SECTION 4. That this resolution shall take effect immediately. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution. Rancho Real (the cul -de -sac street running in the north -south direction from Grimes Canyon Road) and Rancho Grande (the street running in an east -west direction from Rancho Real to the eastern tract boundary) shall be irrevocably offered to the City of Moorpark. These streets shall be constructed and maintained to City standaras by the homeowner's association. These streets shall be owned by the homeowner's association and remain private until such time that development occurs to the east of Tract 4081 and these streets may be required for circulation within and out of the new development. At that time the City may at it's option accept the offer of dedication and accept these streets into the City system so long as they are maintained to City Standard. 2. All storm drains within the tract are to be owned and maintained by the homeowner's association. Storm drains which carry waters under Rancho Real and Rancho Grande shall be irrevocably offered to the City of Moorpark, and may be accepted by the City when the referenced streets are accepted by the City for maintenance. Only those sections of storm drain required to carry storm water under public streets, as determined by the City Engineer, will be accepted by the City of Moorpark. 3. All channels and any slopes directly affecting drainage or street facilities within the tract (natural and improved) shall be maintained by, and necessary easements deeded to, the homeowner's association. 4. All common- shared drives as shown in Tract No. 4081 shall be maintained by, and necessary easements deeded to, the homeowner's association. 5. A homeowner's association shall be formed. The CC &R's shall be approved by the City. The homeowner's association shall be responsible for, but not limited to, the following responsibilities: Maintenance of all streets and common - shared driveways, all storm drains and channels, and any slope directly affecting drainage or street facilities (collectively "Maintenance Areas "). Page -2- Should the homeowner's association fail to maintain the Maintenance Areas, or any portion thereof, in a satisfactory manner, the Maintenance Areas, or portion thereof, shall be annexed, at the City's option, to City Assessment District No. 84 -2 or 85 -1. The total cost of the maintenance provided by the Assessment District shall be borne by the lot owners within Tract 4081. Prior to recordation of the final map, an easement covering the Maintenance Areas shall be irrevocably offered to the City for maintenance purposes. 6. The applicant will be required to pay all additional map check and improvement plan check fees for the revised map and improvement plan submittals plus all costs of CC &R review by the City Attorney. 7.
