A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DECLARING ITS INTENTION TO
MAKE CERTAIN CHANGES AND TO ORDER THE ANNUAL
ASSESSMENTS FOR THE "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO.
AD -84 -2" FOR THE FISCAL YEAR COMMENCING JULY 1,
1989 AND ENDING JUNE 30, 1990 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING
A TIME AND PLACE FOR HF,ARTNG OAJI.CTIONS THERETO.
WHEREAS, pursuant to the provisions of the "Landscaping and
Lighting Act of 1972 ", being Division 15, Part 2 of the Streets and
Highways Code of the State of California, the City Council of the City
of Moorpark, by its Resolution No. 89 -533, proposed to make certain
changes to the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE
ASSESSMENT DISTRICT NO. AD -84 -2" and to extend the improvements
specified in said district for the fiscal year commencing July 1, 1989
and ending June 30, 1990; and
WHEREAS, by said Resolution No. 89 -533, the City Council ordered
the City Manager to cause to be prepared an Engineer's Report, pursuant
to Article 4, Chapter 1, Part 2, Division 15 of said Streets and
Highways Code; and
WHEREAS, the Engineer's Report was prepared and filed, and the
same was approved by the City Council on the 7t4 day of June, 1989,
by Resolution No. 89 -568;
NOW, THEREFORE, THE CITY COUNCII. OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest and convenience require and
it is the intention of the City Council of the City of Moorpark to make
certain changes to the "Moorpark Lighting and Landscaping Maintenance
Assessment District No. AD -84 -2" to order extension of the annual
assessments for said district for the fiscal year commencing July 1,
1989 and ending June 30, 1990. Said "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT y0. AD -84 -2" consists of a single
city-wide zone to provide electric current or energy for public
lighting within the City, to provide for installation or maintenance
landscaping and the construction or maintenance of curb, gutter, or
sidewalk structures and facilities, to install or construct facilities,
which are appurtenant to any of the foregoing, for the maintenance or
servicing or both, of any of the foregoing and to provide incidental
expenses in connection therewith.
SECTION 2. That said parks maintenance assessment district shall
specifically include the park sites with all improvements located
therein, described by and heretofore included within "MOORPARK LIGHTING
AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD- 84 -2."
SECTION 3. That the foregoing described work is to be located
within said Assessment District, the boundary of which is more
particularly described on a map on file in the City Clerk's office, and
entitled "Boundary Map, City of Moorpark Lighting and Landscaping
Maintenance Assessment District No. AD- 84 -2 ", filed in the office of
the City Clerk on the 1st of .Tune, 1989.
SECTION 4. Reference is hereby made to the report of the
Engineer on file with the City Clerk and open to inspection, for a full
and detailed description of the improvements, the boundaries, of the
Assessment District and any zones therein, and the proposed assessments
upon assessable lots and parcels of land within the District.
SECTION 5. Notice is hereby given that on the 21st day of June,
1989, at the hour of 7:00 p.m., in the Council Chambers of the City
Hall of said City, located at 799 Moorpark Avenue, Moorpark, any and
all persons having any objections to the work or extent of the
assessment district may appear and show cause why said work should not
be done or carried out or why said district should not be extended for
the fiscal year commencing July 1, 1989 and ending June 30, 1990.
Protests must be in writing, and must be filed by the property owner
with the City Clerk prior to the conclusion of the hearing and such
protest shall state all grounds of the objection and shall contain a
description sufficient to identify the property.
SECTION 6. All the work herein proposed shall be done in
accordance with the Landscaping and Lighting Act of 1972, being Part 2
of Division of 15 of the Streets and Highways Code of the State of
California.
SECTION 7. The City Clerk shall cause notice of the hearing to
be given by causing the Resolution of Intention to be published and
mailed in the manner required by Part 2 of Division 15 of the Streets
and Highways Code.
SECTION 8. The City Clerk shall certify to the adoption of this
resolution.
