A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, CALLING AND GIVING NOTICE OF THE
HOLDING OF A SPECIAL MUNICIPAL ELECTION, TO BE HELD IN
THE CITY ON TUESDAY, NOVEMBER 7, 1989 FOR THE
SUBMISSION OF A QUESTION OR MEASURE TO THE QUALIFIED
ELECTORS OF THE CITY, WHICH APPROVES AN AMENDMENT TO
THE MOORPARK REDEVELOPMENT PLAN PROHIBITING THE USE OF
EMINENT DOMAIN FOR CERTAIN RESIDENTIAL PROPERTY WITHIN
THE PROJECT AREA, BE ADOPTED; AND REQUESTING THE BOARD
OF SUPERVISORS OF THE COUNTY OF VENTURA TO CONSOLIDATE
SAID SPECIAL MUNICIPAL ELECTION WITH THE SCHOOL AND
SPECIAL DISTRICTS ELECTION ON SAID DATE, PURSUANT TO
SECTION 23302 OF THE ELECTIONS CODE.
WHEREAS, pursuant to Section 4017 of the Elections Code, the City
Council of the City of Moorpark may submit to the voters, without a
petition therefore, the enactment of an ordinance to be voted upon at a
special city election.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That pursuant to the requirements of the laws of
the State of California relating to General Law Cities within the State of
California, and pursuant to the provisions of Section 4017 of the Elections
Code of said State, there is called and ordered held in the City of
Moorpark, California, on Tuesday, November 7, 1989, a Special Municipal
Election of the qualified electors of the City for the purpose of
submitting to said qualified electors said question or measure which
approves an amendment to the Moorpark Redevelopment Plan prohibiting the
use of eminent domain for certain residential property within the Project
Area, be adopted.
Section 2. That the City Council, pursuant to its right and
authority, does order submitted to the qualified electors 'of the City at
the Special Municipal Election hereinabove called to be held, the following
question or measure:
Shall Ordinance No. 111 of the City Council
of the City of Moorpark which approves an
amendment to the Moorpark Redevelopment Plan
prohibiting the use of eminent domain for
certain residential property within the
Project Area, be adopted?

A mark placed in the voting square, rectangle or other specified voting
space after the word "yes" in the manner provided shall be counted in favor
of the adoption of the question. A mark placed in the voting square,
rectangle or other specified voting space after the word "no" in the manner
provided shall be counted against the adoption of the question.
Section 3. That notice of the time and place of holding the
special election is given and the City Clerk is authorized, instructed and
directed to give such further or additional notice of the election, in
time, form and manner as required by law.
Section 4. That pursuant to the requirements of Section 23302
of the Elections Code, the Board of Supervisors of the County of Ventura is
hereby requested to consent and agree to the consolidation of said Special
Municipal Election with the School and Special Districts Election on
Tuesday, November. 7, 1989.
Section 5. That said Board of Supervisors is hereby requested
to issue instructions to the County Clerk to take any and all steps
necessary for the holding of said consolidated election.
Section 6. That the ballots to be used at the election shall
be, in form and content, such as may be required by law to be used in the
election, and that said election shall be held in all respects as if there
were only one election, and only one form of ballot shall be used.
Section 7. That the polls for the special election shall be
open at 7:00 o'clock a.m. of the day of the election, and shall remain open
continuously from that time until 8:00 o'clock p.m. of the same day, when
the polls shall be closed, except as provided by law for holding municipal
elections in the City.
Section 8. That in all particulars not recited in this
resolution, the special election shall be held and conducted as provided by
law for holding municipal elections in the City.
Section 9. That the City Clerk of the City of Moorpark is
hereby directed to file a certified copy of this resolution with the Board
of Supervisors and the County Clerk of the County of Ventura.
Section 10. That the City Clerk shall certify to the passage
and adoption of this Resolution and shall enter it into the book of
original Resolutions of said City.
