A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVAL OF INDUSTRIAL PLANNED
DEVELOPMENT PERMIT NO. IPD -88 -5 ON THE APPLICATION OF
SIEGEL & ASSOCIATES, INC./WEST AMERICAN CONSTRUCTION
WHEREAS, at a duly noticed public hearing on July 19, 1989, the City Council
considered the application filed by Siegel & Associates, Inc./West American Construction
requesting approval to construct a 58,166 square foot industrial building on a 128,502
square foot vacant lot located at the southeast corner of Poindexter Avenue and Commerce
Avenue, City of Moorpark; and
WHEREAS, the City Council after review and consideration of the information
-contained in the Staff Report dated June 12, 1989 and the Negative Declaration has found
that the subject project will not have a significant effect on the environment, and has
reached its decision in the matter, and
WHEREAS, the Planning Commission held a public hearing on June 19 and on July
17, 1989, adopted Resolution No. PC -89 -198 recommending that the City Council accept
and certify the Negative Declaration and make certain findings and conditionally approve
Industrial Planned Development Permit No. IPD -88 -5. The action with the foregoing
direction was approved by the following roll call vote:
AYES: 5 Commissioner Schmidt, Butcher, Holland, Lanahan, and Wozniak;
NOES: 0
WHEREAS, at its meeting of July 19, 1989, the City Council opened the public
hearing, took testimony from all those wishing to testify, closed the public hearing, and
directed staff to prepare a resolution for the City Council's decision;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to the provisions of the California Environmental Quality
Act (Division 13 of the Public Resources Code of the State of California (beginning at
Section 21000) the City Council of the City of Moorpark hereby approves the Mitigated
Negative Declaration.
SECTION 2. That the City Council hereby adopts the findings contained in the
Staff Report dated June 12, 1989, and said report is incorporated herein by reference as
though fully set forth.
SECTION 3. That the City Council does hereby find that the approval of the
requested permit is consistent with the City's General Plan.
SECTION 4. That the City Council hereby conditionally approves Industrial
Planned Development Permit No. IPD -88 -5 subject to compliance with all of the conditions
attached hereto, and does hereby find, detemune, and resolve that violation of any such
conditions shall be grounds for revocation of said Industrial Planned Development Permit.
The action with the foregoing direction was approved by the following roll call vote:
AYES: Councilmembers Lawrason, Montgomery, Perez and Mayor Brown.
NOES: None.
ABSENT: Councilmember Harper.
PASSED, APPROVED AND ADOPTED THIS 2ND DAY OF AUGUST, 1989.

foregoing Resolution No. 598 was adopted by the City Council of
the City of Moorpark at a meeting held on the 2nd day of
August , 1989, and that the same was adopted by the

AYES: Councilmembers Lawrason, Montgomery, Perez and Mayor Brown.
