HomeMy WebLinkAboutRES CC 1989 616 1989 0920RESOLUTION NO. 89- 616 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DENYING WITHOUT PREJUDICE INDUSTRIAL PLANNED DEVELOPMENT PERMIT NO. IPD -88 -2 AND VARIANCE NO. V -88 -2 ON THE APPLICATION OF ROBERT AND SHARON RIDDLE: WHERAS, at duly not-.iced public hearings on August 16, September 6, and September 13, 1989, the City Council considered the application filed by Robert and Sharon Riddle requesting approval to construct a 21,000 to 24,000 square foot automotive center on a 1.35 -acre site located at 13840 East Los Angeles Avenue (State highway 118), approximately one - fourth mile east of the intersection of Spring Road, high Street, and Los Angeles Avenue; and WHEREAS, the Planning Commission after review and consideration at a public hearing on June 19, 1989, adopted a resolution recommending that the City Council deny the requested project without prejudice; and WHEREAS, the City Council reviewed and considered the information contained in the Staff Report dated May 30, 1989, and the Mitigated Negative Declaration; and WHEREAS, at its meeting of August 16, 1989, the Council opened the public hearing, took testimony from all those wishing to testify, and then continued the hearing to September 6, 1989, to allow time for the Community Development Committee to review an alignment study for East Los Angeles Avenue (State Highway 118) and make recommendations related to the design of the project; and WHEREAS, at its meeting of September 6, 1989, the Council made a determination related to the future alignment and right -of -way width for East Los Angeles Avenue and then continued the public hearing to September. 13, 1989, to allow the Community Development Committee additional time to meet with the applicant to resolve design and variance issues; and WHEREAS, at its September 13, 1989, meeting, the City Council considered recent design changes made to the project, closed the public hearing, considered the recommendations of the Community Development Committee and staff related to the design of the project, and then directed staff to prepare a resolution denying the project without prejudice; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby adopts the findings contained in the Staff Report dated May 30, 1989, which report is incorporated herein by reference as though fully set forth. SECTION 2. The City Council hereby denies the requested Industrial Planned Development Permit and Variance without prejudice based on the findings contained in the Staff Report dated May 30, 1989, and based on the reasons given in the Staff Report dated September 12, 1989, which report is incorporated herein by reference as though fully set forth. SECTION 3. At the City Council's meeting of September 20, 1989, the Council took action to approve a resolution denying without prejudice Planned Development Permit No. 88 -2 and Variance No. 88 -2. That action, with the foregoing direction, was approved by the .following roll call vote: AYES: Councilmembers Harper, Lawrason, Montgomery, Perez and Mayor Brown NOES: None ABSENT: None PASSED, APPROVED AND ADOPTED THIS 20TH DAY OF SEPTEMBER, 1989.
