HomeMy WebLinkAboutRES CC 1989 623 1989 1206RESOLUTION NO. 89--623 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELEC'T'ION HELD ON NOVEMBER 7, 1989, AND DECLARING THE RESULTS OF MEASURE A AND SUCH OTHER MATTERS AS REQUIRED BY I.AW WHEREAS, a Special Municipal Election was held and conducted in the City of Moorpark, California on Tito-day, November 7, 1989 as required by law; and WHEREAS, notice of the election was duly and regularly given in time, form and manner as provided by law, voting precincts were properly established, election officers were appointed, and in all respects, the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the Elections code of the State of California for holding of elections in cities; and WHEREAS, pursuant to Resolution No. 89 -592, adopted July 19, 1989, the County Clerk of Ventura County canvassed the returns of the Special Municipal election held for the purpose of submitting a question or measure to the qualified electors of the City on an amendment to the Moorpark Redevelopment Plan prohibiting the use of eminent domain for certain residential property within the project area; and the County Clerk has certified the results to this City council and the results are received, attached and made a part hereof a�, "Exhibit A "; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That th,• measure voted upon at the Special election is as follows: Shall Ordinance No. 111 of the City Council of the City of Moorpark which approves an amendment to the Moorpark Redevelopment Plan prohibiting the use of eminent domain for certain- Tosidontial property within the Project Area, be adopted? That the whole number of votes Gast in the City for the measure, except absent voter ballots was 1,372. 'that the whole number of absent voter ballots cast for the measure was ;fit, making a total of 1,734 votes cast in the City on this measure. That the number of votes givers h; t.l,c, C i t y for and against the measure were as listed on Exhibit A attached. The City does declare and determiTle +.fiat: Ordinance No. 111 of the City Council of the City of Moorpark which approves an amendment to the Moorpark Redevelopment Plan prohibiting the use of eminent domain for cerini„ vosidf-ntial property within the Project. Area, shall be adopted. Section 2. That the City Clerk shall enter on the records of the City Council of the City, a stntoment of the result of the Special Municipal Election showing: 1. The whole number of votes cast in the City for the measure; 2. The measure voted upon; 3. The number of votes given at each Precinct for and against the measure. 4. The number of votes given in tho City for and against the measure; Section 3. That the City Clerk shall certify to the passage and adoption of this Resolution a,id shall enter it in to the book of original Resolutions. PASSED AND ADOPTED this 6th day of December 1989.
