A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA ESTABLISHING A SOLID WASTE
MANAGEMENT (AB 939) FEE RELATIVE TO RESIDENTIAL,
COMMERCIAL, AND 'TEMPORARY COMMERCIAL REFUSE
COLLECTION SERVICES TO FUND THE STATE MANDATED AB
939 PROGRAMS.
WHEREAS, it is appropriate for the City to establish fees and charges for
City services which fully reimburse the City for the associated services,
unless specified otherwise by the City Council;
WHEREAS, the Integrated Waste Management Act of 1989 (Assembly Bill 939),
California Public Resources Code, Section 4000 et. seq., requires each
city and county in the State to prepare local waste management plans,
referred to as the Source Reduction and Recycling Element (SRRE) and
Household Hazardous Waste Element (HHWE), presenting a specific strategy
for recycling and diverting waste from local landfills, 25 percent of the
waste currently generated in the City by 1995, and 50 percent by the year
2000;
WHEREAS, the Integrated Waste Management Act of 1989 (AB 939), California
Public Resources Code, Section 41901 states that a city and \or county may
impose fees in amounts sufficient to pay the costs of preparing,
adopting, and implementing the integrated waste management plans
(SRRE \HHWE) prepared pursuant to the Act;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. For the purposes of compliance with the California
Integrated Waste Management Act of 1989 (AB 939), a separate fee
applicable to all solid waste billing units is established within the
City for the purpose of funding the implementation of an AB 939 solid
waste reduction program.
SECTION 2. Each solid waste billing unit, which shall be either a
single family residence, a separate residential component of a multiple
dwelling, a commercial unit, or temporary commercial collection service
that is individually billed for solid waste collection service, shall be
billed as follows:
$1.00 per month Single - family residential unit
$ .50 per month Multi- family\ Mobile home residential unit
8% of monthly bill Commercial unit
8% of total bill Temporary Commercial Service

SECTION 3. Said fees shall be based on total gposs revenues,
calculated on the monthly base rate for refuse collection services. For
Temporary Commercial Service only, the AB 939 fee shall be based on the
bin rental and transportation; landfill tipping \dumping fees will be
excluded from the eight (8) percent fee calculation.
SECTION 4. Such fees shall be paid within thirty (30) days after
the close of each quarter of the Collector's fiscal year, commencing with
the first billing period following the effective date of July 1, 1992, of
this section. The fees shall be paid in addition and separate to the
Franchise fees paid by the solid waste collector.
